J&A Number 4086-0024

J&A Number: 4086-0024

Code:

P.R.Number: 1300408144

JUSTIFICATION AND APPROVAL (J&A)

TO PROCURE USING OTHER THAN FULL AND OPEN COMPETITION

JUSTIFICATION

1. Contracting Activity

The Naval Sea Systems Command (NAVSEA), Naval Surface Warfare

Center, Panama City Division (NSWC PCD), 110 Vernon Avenue, Panama

City, FL 32407-7001, Contracts Department, Code .

2. Description of the Action Being Approved

Authorization to solicit ProModel Corporation, 556 East Technology

Avenue, Orem, UT 84097 on a sole source basis to procure enhancements to commercially available ProModel® software for the

NSWC PCD Process Analysis Laboratory (PAL) The Government anticipates issuing a Firm Fixed Price (FFP)contract.

3. Description of Supplies/Services

This requirement is to develop and deliver specific functional enhancements to the ProModel® software used in the NSWC PCD Process

Analysis Laboratory (PAL) to facilitate and streamline currently manual processes. The enhancements consist of integration of the

ProModel® software with the Microsoft SharePoint Server 2010 used on the PAL network and implement a Multi-View Enhancement to provide the capability to view different, non-overlapping parts of a model simultaneously.

The Government’s minimum needs have been verified by the certifying technical and requirements personnel. The total estimated amount of this acquisition is $460,000 funded by Fiscal Year 2013 Capital

Improvement Plan (CIP) funds that have been extended through FY

2014. A firm fixed price supply type contract is anticipated for award with a performance period of twelve months.

4. Statutory Authority Permitting Other Than Full and Open

Competition

10 U.S.C. 2304(c) (1) - Only one responsible source and no other supplies or services will satisfy agency requirements

(FAR 6.302-1(a)(2)(ii)).

5. Rationale Justifying Use of Cited Statutory Authority

The NSWC PCD PAL requires certain enhancements to the ProModel® software in order to facilitate and streamline currently manual processes. This requirement is not suitable for full and open competition for the following reasons. ProModel® is required in order to maintain and utilize the existing models in their present format. Enhancements to the ProModel® software will facilitate the merging of present models to create large scope operational scenarios. The PAL has been using ProModel® since 2003 and built a collection of models that can be used in combination with one another for larger operations. The result of changing to different simulation software would cause either recreating or loss of existing models. Considering that ProModel® is a closed source software program, the alternative to the enhancements of the software would require re-programming the existing models to function in a different discrete event simulation software.

The existing models are not compatible with any other discrete event simulation software. The enhanced version of ProModel® must be able to read, run, and edit models developed using earlier versions of ProModel®. Since the ProModel® software is commercial the Government has no rights in data to the design, architecture, or coding of the software. ProModel Corporation is the original developer and sole provider of the ProModel® proprietary software.

Given these facts, ProModel Corporation is the only vendor that can meet this requirement.

6. Description of Efforts Made to Solicit Offers from as Many

Offerors as Practicable

This acquisition was synopsized in the Government Wide Point of

Entry (FEDBIZOPPS) on 04 April 2014 as required by FAR 5.2. As of the approval date of this justification there have been no inquiries regarding this requirement. No additional market research was conducted because it is not practicable for the reasons discussed in paragraph 5 above, and no other sources than the one specified above can meet the Government’s requirement.

7. Determination of Fair and Reasonable Costs

The Contracting Officer has determined that the anticipated cost to the Government for the supplies/services covered by the J&A will be fair and reasonable.

8. Actions to Remove Barriers to Competition

This is a one-time requirement to implement specific enhancements to a commercial software package used in the NSWC PCD PAL.
