About this file
This document is a Justification and Approval (J&A) for a sole source contract modification to BAE Systems San Diego Ship Repair Inc. for the USS GREEN BAY (LPD-20) Fiscal Year 2025 Dry Docking Selected Restricted Availability. The specific work item is ShipAlt LPD17-87785, AS-4775 Link 16 Antenna installation, which addresses a critical communications system upgrade. The Navy determined this modification is necessary because the existing AS-4127A antenna cannot accommodate upgrades to cryptographic algorithms, potentially compromising the ship's operational capabilities.
The contract modification is being awarded under 10 U.S.C. § 3204(a)(2), which allows for sole source procurement when only one responsible source can satisfy agency requirements. The work is time-sensitive, with a required completion date of 06 November 2026, coinciding with the ship's availability and upcoming deployment. BAE is uniquely positioned to perform the work since the USS GREEN BAY is already undergoing repairs at their shipyard, and competitive solicitation would cause unacceptable delays in the ship's maintenance and operational readiness schedule. The total price for the modification was not fully disclosed in the redacted document.

d. and accurate by the technical and requirements personnel.
4. STATUTORY AUTHORITY PERMITTING OTHER THAN FULL AND
OPEN COMPETITION
The statutory authority permitting other than full and open competition is 10 U.S.C. § 3204 (a)(2) as implemented by the Federal Acquisition Regulation (FAR) 6.302-1 this authority applies in those situations where only one responsible source and no other supplies or services will satisfy agency requirements and precludes full and open competition, and delaying in award would result in serious injury to the Government. This availability is the last opportunity to complete this upgrade during the ships availability window and this work is needed to fulfill required operational capability.
5. RATIONALE JUSTIFYING USE OF CITED STATUTORY AUTHORITY.
Request for Contract Change (RCC) 28N was generated to address the need to replace the current aging AS-4127A antenna with the AS-4775/U Multifunctional Information Distribution System (MIDS) Joint Tactical Radio System (JTRS) antenna onboard the USS GREEN BAY. On December 18th, 2024, or 25 days after award of the contract on November 22nd, 2024, technical representatives from the Navy Information Warfare Center (NIWC) reported that the AS-4127 antenna onboard the USS GREEN BAY cannot accommodate upgrades to cryptographic algorithms applied to Link-16 shipboard terminals connected to the antenna. This significantly inhibits the capacity of the existing antenna to receive and transmit information in a format that limits the risk of interception and decryption of said information by hostile parties. Leaving the existing antenna in place thus significantly impedes the capacity of the ship to fulfill its operational role when the USS GREEN BAY departs on deployment.
To address this discrepancy, the Government intends to replace the existing AS-4127A antenna with the new AS-4775/U antenna. The AS-4775/U can receive and transmit information to Link-16 terminals onboard the USS GREEN BAY to the appropriate level of encryption. Failure to take this step as part of the USS GREEN BAY FY25 DSRA will not provide the Government with enough time to replace the AS-4127A antenna prior to the departure of the USS GREEN BAY for deployment. Timely replacement of the AS-4127A antenna with the AS-4775/U antenna is therefore imperative to limit potential risks to the ship, and its crew.
During this window of the D negatively impacting timely completion of the availability. With the USS GREEN BAY located at
BAE is uniquely positioned to support receipt, and installation of elements of the JTRS antenna onboard the USS GREEN BAY. Opening this requirement to competition would incorporate unnecessary delays into an increasingly tight production schedule as the awardee coordinates entry into the shipyard, receipt of materials required for antenna replacement, inspection of the repair area, the setup of temporary services, and the installation of the antenna with BAE, and its subcontractors. Following the incorporation of a 3-month delay to the commencement of the dry-docking period of the USS GREEN BAY FY25 DSRA via Contract Modification A00012, the production schedule for the USS GREEN BAY FY25 DSRA cannot accommodate further significant delays to production work. Time spent awarding and coordinating the execution of this requirement concurrently with the USS GREEN BAY FY25 DSRA meets the criteria of a significant delay.
If competed, the timeline for solicitation is projected as follows: Development of Requirements Package due to contracts by June 6th, 2025, Solicitation/Request for Proposal (RFP), Respond to Preproposal Inquiries (PPI) and submit required Solicitation Amendments (06 June -20 June 2025), Receipt and Evaluation of proposals by mid-July 2025 and execute Contract Award by August 2025. Thus, efforts to coordinate installation of the AS-4775/U antenna with BAE could not take place until August of 2025. Every day that BAE and the new awardee spend coordinating the concurrent accomplishment of production work on the USS GREEN BAY delays installation of the AS-4775/U antenna which creates a day-to-day delay in schedule. As outlined above, soliciting this requirement to provide full and open competition would result in unacceptable delays to the Work Complete Date of 06 November 2026. Any delay will impact the milestones and key events in support of the end of availability, and deployment readiness.
This work needs to be accomplished by the Work Complete Date of November 6, 2026 in order for the ship to meet its operational and testing requirements that are scheduled after the DSRA. For every day this RCC is not on contract, it has the potential to cause a day-to-day delay in the established milestones and potentially the delivery date. Timely completion of this work is critical.
Failure to complete the repairs by the delivery date will prevent the ship from achieving certification. BAE has the means to incorporate the scope of work in 28N without significant delays or duplication of costs.
The current scope of work enables BAE to develop an efficient installation plan to install the antenna.
The RCC was revised and sent to the Contractor on 07 April 2025, and an acceptable proposal was received on 13 May 2025 for a total price of $ .
6. DESCRIPTION OF EFFORTS MADE TO SOLICIT OFFERS FROM AS MANY
OFFERORS AS PRACTICABLE:
The original contract was awarded competitively in which BAE was the selected awardee and this work was not on contract under the award. During this window of maintenance availability, no other source can sat on the availability completion schedule. BAE is uniquely positioned to perform the work as the ship is currently under repair by BAE at their shipyard undergoing a Dry-Dock Selected Restricted Availability (DSRA), and it is impracticable for another company to perform these support services concurrently with other ongoing repairs currently being completed by BAE. A publication will be posted in accordance with FAR 5.201 once the RCC is settled.
7. DETERMINATION OF FAIR AND REASONABLE COST:
The Contracting Officer has determined that the anticipated cost to the Government of this acquisition will be fair and reasonable based on cost and price analysis to be conducted pursuant to FAR Part 15. In addition, technical analysis will be performed with the Project Manager to ensure the proposed labor hours, material cost, and subcontractor cost correspond with the expected cost or Independent Government Estimate (IGE). The basis of estimate for the IGE was developed utilizing
The ship repair market is well known to the contracting officer based on his in-depth experience in the field. That said, additional market research beyond the above was not conducted due to the fact that the ship is already in BAE repairs and it is impracticable for another company to perform the work.
