JUSTIFICATION AND APPROVAL

FOR USE OF OTHER THAN FULL AND OPEN COMPETITION

1. CONTRACTING ACTIVITY

The Southwest Regional Maintenance Center (N55236), Contracting Department Code 410B, 3755 Brinser Street, Suite #1, San Diego, CA 92136-5299.

2. DESCRIPTION OF THE ACTION BEING APPROVED:

This justification seeks approval to solicit an emergent requirement for the repairs of the bow ramp of the Landing Craft Utility (LCU) 1665 and to shorten the solicitation period due to unusual and compelling urgency in accordance with FAR 5.202 and FAR 6.302-2.

3. DESCRIPTION OF SUPPLIES/SERVICES:

The craft, LCU 1665, is a type of small boat used by amphibious forces to transport troops and equipment to shore. Emergent repairs on the LCU 1665 include: repairs to the bow ramp electrical system (Work Item No. 320-11-001), as well as inspect, repair, align, and test the bow ramp, chain, cable, sheave, and related components (Work Item No. 584-31-001). The bow ramp serves as the exit and entrance to the craft. The repairs were originally identified by the craft owners, Assault Craft Unit One (ACU-1) at Naval Amphibious Base Coronado, in October 2020. The LCU 1665 is scheduled for deployment in the near future. The LCU 1665 will require dryberthing at a contractor’s facility within a 125-mile radius of Naval Base San Diego. The period of performance is 15 December 2020 through 12 February 2021. Immediately upon contract award, the contractor will be required to order the long lead time material to accomplish the repairs to the bow ramp within the performance period. The Government’s estimate is $ The requirement will be funded with FY-21 OM&N funding.

4. STATUTORY AUTHORITY PERMITTING OTHER THAN FULL AND OPEN COMPETION

10 U.S.C. 2304(c)(2): Unusual and Compelling Urgency (FAR 6.302-2).

5. RATIONALE JUSTIFYING USE OF CITED STATUTORY AUTHORITY

Casualty Reporting (CASREP) identifies the criticality of failure of equipment/systems that will result in the inability of the ship to get underway or meet its primary mission requirements. This requirement is a C3 CASREP (DTG 0820392OCT20) and, as such, the craft is incapable of performing its mission. Damage to the LCU 1665 bow ramp was a result of a recent collision. The bow ramp is unable to open and close.

Delay in contract award could result in serious injury to the Government. Following completion of emergent repairs, ships force will have to complete deployment preparation training and establish a pre-deployment COVID-19 quarantine. Failure to timely complete the repairs and pre-deployment items will jeopardize the LCU 1665 ability to get underway on time and meet its primary mission requirements.

J & A Number: N55236210004

Further, the LCU 1665 has a pending scheduled deployment. If not repaired in time, ACU 1 will have to forfeit the upcoming deployment or assign another craft, which places a strain on limited craft resources.

6. DESCRIPTION OF EFFORTS MADE TO SOLICIT OFFERS FROM AS MANY OFFERORS AS

PRACTICAL:

The requirement was not synopsized in beta.SAM.gov because the repair to the LCU 1665 bow ramp has unusual and compelling urgency. The LCU 1665 is scheduled to deploy. Per FAR 5.202(a)(2), the Government would be seriously injured if the agency complies with the time periods specified in FAR 5.203.

The Contracting Officer has emailed all known Agreement of Boat Repair (ABR) holders within the Southern California area for market research purposes. At least two (2) responsible small business concerns who possess an ABR have expressed interest in the submitting an offer once the Request for Proposal (RFP) is released in the beta.SAM.gov website.

7. DETERMINATION OF FAIR AND REASONABLE COSTS:

The Contracting Officer has determined that the anticipated cost to the Government for the supplies/services covered by the J&A will be fair and reasonable. The Contracting Officer has a reasonable expectation of adequate price competition in accordance with FAR 15.404-1(b)(2)(i). Per FAR 15.404- 1(b)(2)(i), normally adequate price competition establishes a fair and reasonable price. Historical pricing for similar work will also be examined to determine a fair and reasonable price.

8. ACTION TAKEN TO REMOVE BARRIERS TO COMPETITION:

For future requirements, the Government will continue to synopsize and solicit requirements in accordance with FAR 5.101 and FAR 5.102. All known responsible ABR holders within the determined proposal area will be contacted to solicit at least two (2) proposals for source selection.
