About this file
This is a Justification and Approval (J&A) document for use of an exception to fair opportunity requirements for a non-competitive procurement by the Department of the Navy's Mid-Atlantic Regional Maintenance Center (MARMC).
The contracting activity is issuing additional work under Firm Fixed Price Contract N0002422D4408 and Delivery Order N5005426FL012, previously awarded to East Coast Repair & Fabrication on a non-competitive basis. The work involves industrial support for deck replacement onboard USS CARTER HALL (LSD 50) in accordance with Specification Item 150-10-003, generated by Request for Contract Change (RCC) 2N. The statutory authority for this non-competitive procurement is FAR 16.507-6(b)(1), justified by urgent mission requirements. The government determined that providing fair opportunity would result in unacceptable delays, as East Coast Repair & Fabrication already has equipment in place and integration of work from another contractor would extend the timeline. The USS CARTER HALL's mission to transport and deploy Marine personnel, landing craft, vehicles, and cargo in support of military and humanitarian operations requires safe transit of personnel, which necessitates completion of this deck replacement work within the existing period of performance. The estimated cost was determined fair and reasonable based on historical data, an Independent Government Estimate (IGE), and Project Manager technical knowledge of man hours and material costs. Market research was not conducted due to the critical nature and immediate start requirement. The Lead Ship Building Specialist (Patrick A Holden, Code 332) certified technical accuracy, legal sufficiency was reviewed, and the Contracting Officer approved the award citing urgent agency need.
