About this file
This is a Justification and Approval (J&A) document for use of an exception to fair opportunity requirements under FAR 16.507-6(b)(1).
The Mid-Atlantic Regional Maintenance Center (MARMC), a field activity of Naval Sea System Command, seeks to add work to Firm Fixed Price Contract N0002422D4408 and Delivery Order N5005426FL012, awarded to East Coast Repair & Fabrication on a non-competitive basis. The work involves industrial support for 30-Ton Cargo Crane repairs aboard USS CARTER HALL (LSD 50) in accordance with Specification Item 589-11-001, generated by Request for Contract Change (RCC) 1N. The work must commence immediately and be completed within a specified timeframe (redacted) and integrated into the existing specification package. The government's minimum needs have been verified by certifying technical and requirements personnel.
The justification for non-competitive procurement cites urgent agency need under FAR 16.507-6(b)(1), as providing fair opportunity would result in unacceptable delays of at least (redacted) to the overall schedule. The 30-Ton Cargo Crane is essential to USS CARTER HALL's amphibious operations, supporting onload and offload of small boats, supplies, and Marine vehicles while underway. East Coast Repair & Fabrication already has equipment in place; awarding to another contractor would require additional time and result in costly delays. The repairs are critical for delivering a mission-capable ship within the Continuous Maintenance Availability (CMAV) period. Cost was determined fair and reasonable based on historical data, Independent Government Estimate, and Project Manager technical knowledge. Market research was not conducted due to the critical, time-sensitive nature of the work.
