About this file

This is a Justification and Approval for Use of Exception to Fair Opportunity (J&A) issued by the Department of the Navy's Mid-Atlantic Regional Maintenance Center (MARMC) in Norfolk, Virginia.

The procurement seeks to award additional work to East Coast Repair and Fabrication on a non-competitive basis under Delivery Order N5005426FL001, issued under the USS GUNSTON HALL (LSD-44) Continuous Maintenance Availability (CMAV) contract with SSP TPPC-LSD44-MARMC26-S001. The work involves installation of a replacement vaneaxial fan for Ships Service Generators Number 1 and 2. Specifically, work item 512-11-001 requires creating structural hull openings to remove the inoperative ventilation fan, installing a replacement unit, replacing insulation and lagging, and reinstalling structural hull openings to ensure safe operation. The contracting officer determined this work is urgent and compelling because the current ventilation fan has become inoperative through normal wear and tear, creating an operational hindrance that affects normal and emergency generator operation. Awarding to any contractor other than East Coast Repair and Fabrication would cause unacceptable delays to the USS GUNSTON HALL's fleet mission commitments and disrupt the integrated work schedule. The statutory authority cited is FAR 16.505(b)(2)(i)(A), which permits non-competitive procurement when the agency's need is so urgent that providing fair opportunity would result in unacceptable delays. The contracting officer determined the estimated cost is fair and reasonable based on historical data, an Independent Government Estimate (IGE), and Project Manager technical knowledge of estimated man hours and materials. The J&A is signed by Lauren Heard, Contracting Officer, Code 426.2.

5. RATIONALE JUSTIFYING USE OF CITED STATUTORY AUTHORITY

IAW FAR 16.505(b)(2)(i)(A) this procurement must be issued on a non-competitive basis due to the urgency of the required support which is under the same availability currently in execution and includes the same period of performance as the awarded delivery order period of performance. This additional work must be issued under a non-competitive basis because if the Government were to provide for fair opportunity, the entire schedule would be delayed

East Coast Repair and Fabrication will be tasked to perform the installation of the vaneaxial fan. Although not discovered during initial work package development for the CMAV, normal wear and tear has rendered the current ventilation fan inoperative. This creates a potential operational hinderance as this ventilation fan is required for normal and emergency operation of Ships Service Generators Number 1 and 2. Estimated time of repair work . Based on estimated start date and length of repairs, work item 512-11-001 is urgent and compelling to start earliest convenience. Repairs will consist of creating structural hull openings to allow for the removal of the current ventilation fan, installation of a replacement ventilation fan, replacing insulation and lagging, and reinstallation of removed structural hull openings to ensure the safe and proper operation of the ventilation fan in the fan room. Without these repairs, the Ship will cannot

To award this work to a contractor other than East Coast Repair and Fabrication would result in unacceptable and costly delays to the USS GUNSTON HALL (LSD 44). The work must be integrated with the existing work package, the actual start date and production duration will be determined by the LMA during work integration analysis in order to support Key Event Work Complete (WC) and avoid delays and disruption to testing other systems in the base work package. Failure to accomplish this work would be unacceptable

East Coast Repair has required equipment and is the only company able to meet the

Government's immediate requirement to provide repair to the USS GUNSTON HALL (LSD 44) repairs in order for the USS GUNSTON HALL (LSD 44) to meet is fleet mission commitments. To Award this East Coast Repair provides the Government the appropriate avenue to accomplish this repair within the allotted Period of Performance. These repairs are essential for the delivery . Without the repairs scheduled for the CMAV, the Vaneaxial Fan would
