About this file

This is a Justification and Approval (J&A) for use of an exception to fair opportunity in federal procurement, issued by the Department of the Navy's Mid-Atlantic Regional Maintenance Center (MARMC) in Norfolk, Virginia.

The procurement involves adding work to an existing Firm Fixed Priced (FFP) Delivery Order (N5005426FL001) awarded to East Coast Repair under the USS GUNSTON HALL (LSD-44) Continuous Maintenance Availability (CMAV) contract. The additional work consists of critical repair services identified in Request for Contract Changes (RCC) 76N Work Item 321-10-002, specifically the installation of a Tilt Rotate Zoom (TRZ) Dome Low Light Mono Camera Cable system on the USS GUNSTON HALL. The repairs include installation of approximately 150 feet of cable and conduit, camera connections, and testing to ensure proper operation. The work is being awarded on a non-competitive basis under the statutory authority of FAR 16.505(b)(2)(i)(A) due to urgency and operational necessity. The Contracting Officer determined that providing fair opportunity would result in unacceptable schedule delays to the vessel's fleet mission commitments, and East Coast Repair is the only company with the required equipment and capability to meet the immediate timeline. Cost determination was based on historical data, an Independent Government Estimate (IGE), and Project Manager technical knowledge, with labor rates and material burden rates deemed fair and reasonable at time of contract award. The justification was approved by Contracting Officer Lauren Heard on March 31, 2026.
