About this file

This Justification and Approval (J&A) document from the Department of the Navy's Mid-Atlantic Regional Maintenance Center seeks to procure urgent repairs for the USS CARTER HALL (LSD 50). The critical work involves replacing the Rolling Airframe Missile (RAM) Launcher foundation, which has deteriorated to less than 50% of its original material thickness, rendering it structurally unsound. The excessive corrosion poses significant safety risks, potentially compromising the ship's self-defense capabilities and placing personnel in danger.

The document justifies a sole-source contract to BAE Systems under the authority of 10 U.S.C. 2304(c)(2) for unusual and compelling urgency. BAE Systems is deemed the only company capable of performing the work under the ship's condensed maintenance schedule. The contract (N00024-24-C-4414) will be funded by Operation and Maintenance, Navy (O&M) funds for Fiscal Year 2025. The work must be integrated into the existing maintenance package and completed within a tight timeline to prevent disruption of the ship's operational commitments and potential deployment schedule impacts.

J&A Number: N50054 25 179

The mission of the USS CARTER HALL (LSD 50) is to transport and deploy Marine personnel, landing craft, vehicles, and cargo using landing craft and helicopters in support of military and humanitarian assistance operations. The LSD class of ship acts as an invaluable component to a joint Navy-Marine expeditionary unit (ARG/MEU). This naval vessel has significant corrosion on its AFT Rolling Airframe Missile Launcher foundation.

A Rolling Airframe Missile Launcher (RAM) is a defense system that detects and destroys short-range incoming missiles and aircraft. RAM systems are typically mounted on naval ships. The RAM Launcher foundation secures the launcher platform on a naval ship, houses 21 missiles and is designed to detect and destroy incoming short-range threats like anti-ship missiles. The excessive corrosion of the steel structure of the foundation has deteriorated to less than 50% of the original material thickness, which has rendered the foundation structurally unsound.

It is imperative that the Rolling Airframe Launcher foundation is replaced to prevent a potential safety hazard to personnel responsible for securing this weapon to the deck of the ship, to perform all scheduled fire drills, and to meet all Damage Control Maintenance Assessments (DCMA) Safety Requirements. Without these repairs, the Ship will not be able to have the RAM weapons system installed, placing the Ship at severe risk of no self defense. An inoperable RAM could result in serious injury to the personnel and/or loss of life and excessive financial and physical damage to the ship. The urgent repairs are necessary for the vessel to meet its scheduled operational commitments and perform its national mission in time of war.

Due to the condensed maintenance schedule of the USS CARTER HALL (LSD 50), and the unusual and compelling urgency, using Full and Open Competition would result in unacceptable delays. The work must begin no later than ,_, , be completed by , and must be integrated into the existing work package under Contract N00024-C-4414 in order to support the Work Completion Date and avoid disruption to testing other systems in the base work package. A competitive award would take approximately 45 days. There would be a minimum of 10 days to prepare the solicitation, and 30 days to post the Request for Proposal (RFP) on

FedBizOpps as required by DFARS 215.371-2, and an additional 5 days to analyze the proposals and provide debriefings to unsuccessful offerors. Failure to accomplish this work would be unacceptable and cause serious injury to the government as it would impair the DSRA schedule, resulting in an inability of the vessel to meet its scheduled, post-DSRA operational commitments. Any delay would cause a disruption to the ship's operational commitments and hinder various milestones, which could potentially impact the ship's deployment schedule.

BAE Systems is the only company that is able to perform this work under short notice during the current availability and is capable of meeting the Government's requirement to perform this work and allow USS CARTER HALL (LSD 50) to meet its fleet mission commitments.

6. DESCRIPTION OF EFFORTS MADE TO SOLICIT OTHER OFFERS

In accordance with FAR 5.202(a)(2), a synopsis has not been issued for the supplies and services described herein. Due to the determination that the nature of this work is of such unusual and compelling urgency, the Government would be seriously injured unless the number of sources from which offers are solicited is limited.

7. DETERMINATION OF FAIR AND REASONABLE COSTS

The Contracting Officer has determined that the anticipated cost to the Government for the supplies/services covered by the J&A will be fair and reasonable. The estimated cost of this work item is based upon historical data as well as the Independent Government (IGE) and technical knowledge associated with estimated man hours and materials costs to complete this work. The supported information provided should be sufficient to support the fair and reasonable cost determination of the procurement.

8. ACTIONS TO REMOVE BARRIERS TO COMPETITION

For reasons set forth in paragraphs 5 and 6, market research was not conducted. The critical nature of the work required that it be started immediately. Future acquisitions for similar work will be reviewed by the Contracting Officer on a case by case basis to promote the use of full and open competition in the acquisition process where possible and practicable in accordance with FAR Part 6. In addition, a copy of the change(s) covered by this justification will be forwarded to MARMC Code 200, Planning and Engineering, and Code 300, Waterfront Operations for consideration of similar work requirements in future solicitations.
