About this file
This document is a Justification and Approval (J&A) for a sole source award to BAE Systems for the installation of a temporary fire main and valve repairs on a naval vessel during an Emergent Availability (EMAV). The J&A states that BAE personnel have the expertise and knowledge required to complete this critical work in a timely manner, and that using the fair opportunity process would result in unacceptable delays that would impact the vessel's operational commitments. The Contracting Officer has determined that the anticipated costs are fair and reasonable based on the Independent Government Estimate and past history with this requirement. No market research was conducted due to the urgent nature of the work, but the Contracting Officer will review future acquisitions on similar work to promote fair competition where possible.

The delay required for a competitive award would result in serious injury to the Government, as the ship will be unable to perform its previously scheduled, operational commitments. BAE was the most recent contractor to provide the temporary fire main system IAW NAVSEA Standard item 009-08 Shipboard Fire Prevention and Protection onboard and performed exemplary on the last EMAV.
6. DETERMINATION OF FAIR AND REASONABLECOSTS
The Contracting Officer has determined that the anticipated cost to the Government for the supplies/services covered by the J&A will be fair and reasonable. The estimated cost of this work item is based upon the Independent Government Estimate (IGE), the project technical knowledge, and past history related to this work requirement. The supported information provided should be sufficient to support the fair and reasonable cost determination of the procurement.
7. ACTIONS TO REMOVE BARRIERS TOCOMPETITION
For reasons set forth in paragraphs 5 and 6 above, market research was not conducted. The critical nature of the work required that it be started immediately. For future acquisitions on similar work will be reviewed by the Contracting Officer on a case-by-case basis to promote the use of fair competition award process under this contract, where possible and practicable in accordance with FAR Subpart 16.5. In addition, a copy of the change(s) covered by this justification will be forwarded to Code 200, Planning and Engineering, for consideration of similar work requirements in future solicitations.
