JUSTIFICATION FOR AN EXECPTION TO FAIR OPPORTUNITY
1. Contracting Activity
The contracting activity is the Mid-Atlantic Regional Maintenance Center (MARMC), United States Navy (USN), Norfolk, Virginia, and field activity of the Naval Sea System Command (NAVSEA), Washington, DC.
2. Description of the Action Being Approved
This justification provides for restricting the 30 days solicitation requirement to 8 days for the procurement of this emergent work as an exception to the fair opportunity process under multiple-award contract numbers N00024-16-D-4411, N00024-16-D-4412, and N00024-16-D- 4413; which was awarded using the full and open competition process. Award to be made to Marine Hydraulics International, LLC (MHI), as an exception to fair opportunity process under contract N00024-16-D-4412.
3. Description of Supplies/Services
The work to be performed under this procurement consists of repair services for the Main Propulsion Diesel Engine (MPDE) in accordance with the Work Specification 233-12-001 1B Main Propulsion Diesel Engine (MPDE); overhaul and Work Specification 233-13-001, 2A Main Propulsion Diesel Engine (MPDE); overhaul Emergent Availability; SSP TPPC-LPD24- MARMCN20-E001. To support the maintenance and repair of USS ARLINGTON (LPD 24) that is currently carrying a CAT 3 CASREP. The dollar value for this award is $12,600,000, and the procurement will be funded using FY20 Emergent Maintenance funds. The certifying technical and requirements personnel have verified the Government’s minimum needs. The required period of performance is for 298 days from 19 November 2019 – 11 September 2020.
4. Identification of the Exception to Fair Opportunity
The regulatory authority for this procurement is FAR 16.505(b)(2)(i)(A). The agency’s need for the supplies or services is so urgent that providing a fair opportunity would result in unacceptable delays.
5. Rationale Justifying the Exception to Fair Opportunity
Due to the USS ARLINGTON (LPD 24) operational schedule, the urgency of the required supplies precludes the procurement through the fair opportunity process. This procurement was solicited to all the Indefinite Delivery Indefinite Quantity Multiple Award Contract (IDIQ-MAC) contract holders with an expedited solicitation period of 8-days. There will be insufficient time to solicit this procurement for more than 8-days due to the urgency of this requirement. The current ship's operational schedule does not support a 30-day solicitation period due to urgency.
Therefore, an 8-day solicitation period was sufficient opportunity for this urgent procurement that has become ship disabling on this MPDE critical system. This solicitation anticipated competition, but only one bid was received from the contractor MHI for the 8-days solicitation period. In order to allow sufficient time for the award, the solicitation period was restricted for this CAT 3 CASREP requirement to meet USS ARLINGTON (LPD-24) operational schedule to meet its fleet mission commitments. Two out of the three IDIQ-MAC holders were unable to meet the needs of the scope of work and declined the request for a proposal. A prior solicitation under Request for Proposal (RFP) number N50054-19-R-5006 was solicited on August 12, 2019, for 30 days to all three MAC holders and received no bids. The requirement was re-solicited to all MAC holders under the current RFP N50054-20-R-9001 for eight days and received one bid from MHI.
The USS ARLINGTON (LPD 24) is a San Antonio Class Landing Platform Dock ship that provides multi-purpose as well as multi-mission offensive and defensive capabilities in support of Marine Expeditionary Forces. Its aviation facilities include a hangar to accommodate a flexible mix of helicopters and the Marine Corps' tilt-rotor V-22 Osprey aircraft, and a large flight deck capable of supporting Marine Corps rotary and tilt-wing operations. USS ARLINGTON 's well deck is sized for the launch and recovery of one Landing Craft Air Cushion (LCAC). The USS ARLINGTON also provides support for U.S. Navy humanitarian efforts. USS ARLINGTON (LPD- 24) is the eight Multi-Purpose Amphibious Dock Ship in its class, and the propulsion system consists of two propulsion shafts, each powered by two MPDE engines. USS ARLINGTON’s mission readiness is a U.S. Navy requirement.
Diesel engine inspections completed in August 2019 identified the Lube Oil systems on MPDE 1B and 2A being contaminated by metal particulates. Further inspection of engine components determined metal particulate contamination throughout each engine, lube oil pumps, filters, and plate coolers. Both engines were declared not safe to operate until complete repair, cleaning, and testing can be completed.
The ship’s non-operational 1B and 2A MPDEs is essential to accomplishing all of the ship’s operations underway. Any prolonged postponement in the award of this procurement would result in serious injury to the U.S. Government. The necessary repairs to the USS ARLINGTON (LPD 24) MPDE’s would not be completed in time for the vessel to meet its scheduled operational commitments. The ship will not be able to perform its national mission in a time of war until the MPDE repairs are complete.
This is an urgent requirement providing the necessary repairs to the USS ARLINGTON (LPD
24) 1B and 2A MPDE’s in order for the USS ARLINGTON (LPD 24) to meet is fleet mission commitments. This repair is a confirmed Category 3 Casualty Repair (CASREP) generated for each MPDE, CASREP Message #19087 DTG 110036Z JUL19, and CASREP #19052 DTG
231118Z AUG 19.
A delay in this award of this procurement would result in unacceptable delays and serious injury to the Government, resulting in an inability of USS ARLINGTON (LPD-24) to meet its scheduled operational commitments and performance of its national mission.
6. Determination of Fair and Reasonable Costs
The Contracting Officer has determined that the anticipated cost to the Government for this supply covered by the J&A will be fair and reasonable. The cost of this work item was based upon the Project Manger’s and the Technical Advisory Team’s trade knowledge and review of historical data and similar work. The labor rates and material burden rates for the work covered by this justification will be in accordance with the basic contract and delivery order rates. The supporting information provided should be sufficient to support the fair and reasonable cost determination of the procurement.
7. Actions to Remove Barriers to Competition
Future acquisitions for similar work will be reviewed by the Contracting Officer on a case-by-case basis to promote the use of fair and full competition in the delivery order award process under this multiple delivery order contract, where possible and practicable in accordance with FAR Subpart 16.5. In addition, a copy of the change(s) covered by this justification will be forwarded to Code 200, Planning and Engineering, for consideration of similar work requirements in future solicitations.
