52.212-2 EVALUATION--COMMERCIAL ITEMS (OCT 2014)

(a) The Government will award a purchase order resulting from this solicitation to the responsible Offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:

(1) BASIS FOR AWARD: The Government will utilize the best value tradeoff process for source selection to determine best value. This process permits tradeoffs among price and non-price factors. The Government intends to award to the Offeror proposing the combination most advantageous to the Government based upon an integrated assessment of the quotations received, and evaluation factors described in this provision.

The Government considers it to be in its best interest to allow award to other than the lowest priced Offeror or other than the highest technically rated Offeror. NON- PRICE FACTORS, WHEN COMBINED, ARE APPROXIMATELY EQUAL IN IMPORTANCE TO PRICE.

(2) NON-PRICE FACTORS TO BE EVALUATED: All quotations will be evaluated on the factors listed below. Offerors are required to provide data addressing all stated factors in a clear and understandable format. Quotations that do not clearly address all factors may be considered unacceptable and may not receive further consideration. A quotation that receives an “unacceptable” rating on any technical factor will be considered unacceptable and may not receive further consideration. A detailed explanation of the criteria for the evaluation is set forth below in this provision. Evaluators will ensure Offerors have complied with all “submission requirements” set forth in this provision.

(3) TECHNICAL EVALUATION: The term “technical,” as used herein, refers to non-price factors other than past performance. The purpose of the technical factors is to assess the ability of an Offeror’s quotation to satisfy the Government’s requirements.

Table 1- Technical Evaluation Factor 1

Evaluation Criteria
Submission Requirement

Technical Factor 1- Understanding of the Work

For this factor, evaluators will determine whether the Offeror’s submission demonstrates a thorough understanding of the complexity and magnitude of service requirements set forth in the Performance Work Statement (PWS).

The submission for this factor shall include a brief narrative that clearly demonstrates an understanding of the requirements of the solicitation and the Offeror’s plan for meeting these requirements. The narrative shall address and contain a description of the following:

1) A description of how the Offeror is able to support simultaneous leases at or above the government’s estimated amount as shown in attachment 2 of the solicitation.

2) The difficulties, uncertainties and risks associated with the work and how the Offeror will minimize these risks, this should also address how the Offeror is capable of providing for surges in lease amounts if a large requirement is needed by the Government;

3) How the Offeror plans to provide forklifts within short notice receipt of task orders as required by the section 6 of the performance work statement (PWS), to include the planned location of the Offeror’s forklift inventory in relation to Puget Sound Naval Shipyard (PSNS)

Offerors are required to provide a narrative in either Microsoft word or PDF on company letterhead and format with a total page length of no more than seven (7) pages. The narrative should be clear, coherent, and prepared in sufficient detail for effective evaluation and answer, at a minimum, the specific narrative elements as laid out in this factor.

Narratives shall be submitted as a stand-alone electronic file (in word or PDF) and include “Technical Factor 1” in the title for easy identification.

NOTE: If more than seven (7) pages are submitted, the Government will only evaluate the first seven pages.

For technical evaluation factor 1, quotes will be rated utilizing the following table. The combined technical/risk rating includes consideration of risk in conjunction with the strengths, weaknesses, significant weaknesses, uncertainties, and deficiencies in determining the Offeror’s final rating:

Table 2- Combined Technical Rating

Technical Evaluation Factor 2

Evaluation Criteria
Submission Requirement

Technical Factor 2- The prospective Offeror must demonstrate that the forklifts they intend to provide to the Government (in accordance with the PWS) are crane lifetable per section 3.6 of the PWS.

Offerors are required to provide the OEM equipment data sheets to include lift drawings, with additional mark-ups on the lift drawings as necessary, to show compliance with the crane lift specifications as required by the PWS.

The data sheets must be combined into one Microsoft word or PDF document and should only include the required data and drawing pages. Submission of entire OEM manuals WILL NOT be evaluated and will result in an “unacceptable” rating.

Data sheets shall be submitted as a stand-alone electronic file (in word or PDF) and include “Technical Factor 2” in the title for easy identification.

For technical evaluation factor 1, quotes will be rated utilizing the following table.

Technical Acceptable/Unacceptable Rating

(4) Past Performance Factor Evaluation:

The past performance evaluation results in an assessment of the Offeror’s probability of meeting the solicitation requirements. The past performance evaluation considers each Offeror’s demonstrated recent and relevant record of performance in supplying products and services that meet the contract’s requirements. The recency, relevance, and quality (including general trends in contractor performance and source of information) of the Offeror’s past performance shall be considered. These are combined to establish one performance confidence assessment rating for each Offeror. This subjective assessment will be based on consideration of all relevant facts and circumstances gathered by the Government’s evaluation team.

In the case of Offerors for which there is no information on past contract performance or where past contract performance information is not available, the Offeror may not be evaluated favorably or unfavorably on the factor of past contract performance (see FAR 15.305(a)(2)(iv).) In this case, the Offeror’s past performance is unknown and assigned a performance confidence rating of “neutral”.

Past Performance Evaluation Factor

Evaluation criteria
Submission Requirements

No less than two (2) and no more than four (4) recent contract actions and/or projects that demonstrate successful performance relevant to providing and managing the lease of forklifts similar to the type required in the PWS, as well as the amount of simultaneous forklifts leases as projected in attachment 2 of the solicitation. To be considered recent past performance, submitted actions must be no older than three (3) years from the closing date of the solicitation.

The Government will also obtain Past performance information from established systems such as the Past Performance Information Retrieval System (PPIRS), Federal Awardee Performance and Integrity Information System (FAPIIS), Electronic Subcontract Reporting System (eSRS), or other databases. Past performance information may also be obtained from other sources available to the Government, such as (but not limited to) the Defense Contract Management Agency; and interviews with Program Managers, Contracting Officers, Fee Determining Officials.

Offerors are required to provide a completed past performance data sheet (see Exhibit B of the solicitation) on no less than two (2) and no more than four (4) recent and relevant contract actions/projects. The narrative portion of the data sheet must be clear, coherent, and prepared in sufficient detail for effective evaluation.

Past performance data sheets shall be submitted as a stand-alone electronic file (in word or PDF) per sheet and include “past performance data sheet” in the title for easy identification.

Offerors must include the contracting officer’s name, telephone number, and email address for all referenced Government contracts.

Offerors must include a customer point of contact (POC) with name telephone number, and email address for referenced private sector projects.

Altered, partially completed, or substituted data sheets may not be evaluated.

For the past performance evaluation factor, Offeror’s will be rated utilizing the following table:

Performance Confidence Assessments Rating

(5) Price Evaluation:

Price to the Government shall be evaluated. However, no adjectival ratings shall be utilized for evaluating price.

If the Government determines an Offeror’s estimates to be inexplicably low or otherwise not fair and reasonable, that Offeror may be eliminated from the competition without further discussion.

The price of CLIN 0001 will be evaluated as the total price of the proposal and shall be equal to the total price from the completed price proposal worksheet (Exhibit A), as highlighted in green within the Exhibit. Partially completed price worksheets will not be evaluated and a quote may be eliminated from the competition without further discussion.

The “estimated lease months” annotated in Exhibit A are for the weighted price evaluation of the base award and WILL NOT be incorporated into the final contract.

The proposed monthly lease rates WILL be incorporated into the final contract as the pre-price rates used throughout the ordering period.

(b) Options. If options are included in this solicitation, the Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).

(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful Offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

52.212-1 INSTRUCTIONS TO OFFERORS--COMMERCIAL ITEMS (DEVIATION 2018-O0018) (JUN 2020)

(a) North American Industry Classification System (NAICS) code and small business size standard. The NAICS code(s) and small business size standard(s) for this acquisition appear elsewhere in the solicitation. However, the small business size standard for a concern which submits an offer in its own name, but which proposes to furnish an item which it did not itself manufacture, is 500 employees.

(b) Submission of offers. Submit signed and dated offers to the office specified in this solicitation at or before the exact time specified in this solicitation. Offers may be submitted on the SF 1449, letterhead stationery, or as otherwise specified in the solicitation. As a minimum, offers must show--

(1) The solicitation number;

(2) The time specified in the solicitation for receipt of offers;

(3) The name, address, and telephone number of the Offeror;

(4) A technical description of the items being offered in sufficient detail to evaluate compliance with the requirements in the solicitation. This may include product literature, or other documents, if necessary;

(5) Terms of any express warranty;

(6) Price and any discount terms;

(7) "Remit to" address, if different than mailing address;

(8) A completed copy of the representations and certifications at FAR 52.212-3 (see FAR 52.212-3(b) for those representations and certifications that the Offeror shall complete electronically);

(9) Acknowledgment of Solicitation Amendments;

(10) Past performance information, when included as an evaluation factor, to include recent and relevant contracts for the same or similar items and other references (including contract numbers, points of contact with telephone numbers and other relevant information); and

(11) If the offer is not submitted on the SF 1449, include a statement specifying the extent of agreement with all terms, conditions, and provisions included in the solicitation. Offers that fail to furnish required representations or information, or reject the terms and conditions of the solicitation may be excluded from consideration.

(c) Period for acceptance of offers. The Offeror agrees to hold the prices in its offer firm for 30 calendar days from the date specified for receipt of offers, unless another time period is specified in an addendum to the solicitation.

(d) Product samples. When required by the solicitation, product samples shall be submitted at or prior to the time specified for receipt of offers. Unless otherwise specified in this solicitation, these samples shall be submitted at no expense to the Government, and returned at the sender's request and expense, unless they are destroyed during preaward testing.

(e) Multiple offers. Offerors are encouraged to submit multiple offers presenting alternative terms and conditions, including alternative line items (provided that the alternative line items are consistent with subpart 4.10 of the Federal Acquisition Regulation), or alternative commercial items for satisfying the requirements of this solicitation. Each offer submitted will be evaluated separately.

(f) Late submissions, modifications, revisions, and withdrawals of offers:

(1) Offerors are responsible for submitting offers, and any modifications, revisions, or withdrawals, so as to reach the Government office designated in the solicitation by the time specified in the solicitation. If no time is specified in the solicitation, the time for receipt is 4:30 p.m., local time, for the designated Government office on the date that offers or revisions are due.

(2)(i) Any offer, modification, revision, or withdrawal of an offer received at the Government office designated in the solicitation after the exact time specified for receipt of offers is “late” and will not be considered unless it is received before award is made, the Contracting Officer determines that accepting the late offer would not unduly delay the acquisition; and--

(A) If it was transmitted through an electronic commerce method authorized by the solicitation, it was received at the initial point of entry to the Government infrastructure not later than 5:00 p.m. one working day prior to the date specified for receipt of offers; or

(B) There is acceptable evidence to establish that it was received at the Government installation designated for receipt of offers and was under the Government's control prior to the time set for receipt of offers; or

(C) If this solicitation is a request for proposals, it was the only proposal received.

(ii) However, a late modification of an otherwise successful offer, that makes its terms more favorable to the Government, will be considered at any time it is received and may be accepted.

(3) Acceptable evidence to establish the time of receipt at the Government installation includes the time/date stamp of that installation on the offer wrapper, other documentary evidence of receipt maintained by the installation, or oral testimony or statements of Government personnel.

(4) If an emergency or unanticipated event interrupts normal Government processes so that offers cannot be received at the Government office designated for receipt of offers by the exact time specified in the solicitation, and urgent Government requirements preclude amendment of the solicitation or other notice of an extension of the closing date, the time specified for receipt of offers will be deemed to be extended to the same time of day specified in the solicitation on the first work day on which normal Government processes resume.

(5) Offers may be withdrawn by written notice received at any time before the exact time set for receipt of offers. Oral offers in response to oral solicitations may be withdrawn orally. If the solicitation authorizes facsimile offers, offers may be withdrawn via facsimile received at any time before the exact time set for receipt of offers, subject to the conditions specified in the solicitation concerning facsimile offers. An offer may be withdrawn in person by an Offeror or its authorized representative if, before the exact time set for receipt of offers, the identity of the person requesting withdrawal is established and the person signs a receipt for the offer.

(g) Contract award (not applicable to Invitation for Bids). The Government intends to evaluate offers and award a contract without discussions with Offerors. Therefore, the Offeror's initial offer should contain the Offeror's best terms from a price and technical standpoint. However, the Government reserves the right to conduct discussions if later determined by the Contracting Officer to be necessary. The Government may reject any or all offers if such action is in the public interest; accept other than the lowest offer; and waive informalities and minor irregularities in offers received.

(h) Multiple awards. The Government may accept any item or group of items of an offer, unless the Offeror qualifies the offer by specific limitations. Unless otherwise provided in the Schedule, offers may not be submitted for quantities less than those specified. The Government reserves the right to make an award on any item for a quantity less than the quantity offered, at the unit prices offered, unless the Offeror specifies otherwise in the offer.

The Offeror shall enter, in the block with its name and address on the cover page of its offer, the annotation "Unique Entity Identifier" followed by the unique entity identifier that identifies the Offeror's name and address. The Offeror also shall enter its Electronic Funds Transfer (EFT) indicator, if applicable. The EFT indicator is a four-character suffix to the unique entity identifier. The suffix is assigned at the discretion of the Offeror to establish additional SAM records for identifying alternative EFT accounts (see FAR subpart 32.11) for the same entity. If the Offeror does not have a unique entity identifier, it should contact the entity designated at www.sam.gov for unique entity identifier establishment directly to obtain one.
