Naval Sea Systems Command (NAVSEA), Norfolk Naval Shipyard (NNSY) intends to award a Firm Fixed Price (FFP) contract for seven (7)
8’x20’ HAZMAT Conex boxes. The required items are for commercial items prepared in accordance with the information in FAR subpart 12.6 and FAR part 13, as supplemented with the additional information included in this notice.
The requirement will be solicited as unrestricted. The North American Industry Classification Standard (NAICS) code applicable to this procurement is 562112. The small business size standard is 41.5 million. The Product Service Code is W039.
The period of performance for this acquisition is anticipated to begin April 15, 2024 through April 14, 2025. Inclusion of FAR 52.217-8 is recommended.

Prospective Offeror's are responsible for downloading their own copy of the solicitation and for frequently monitoring the SAM website for solicitation amendments. All responsible sources may submit a quotation, which shall be considered by the Government. By submitting a quotation, the offeror will be self-certifying that neither the principal corporate officials nor owners are currently suspended, debarred, or otherwise ineligible to receive contracts from any federal agency. Failure to do so may represent grounds for refusing to accept the quotation.
By submission of a quotation, the offeror acknowledges the requirement that a prospective awardee must be registered in the System for Award Management (SAM) database prior to award, during performance, and through final payment of any contract resulting from the solicitation, except for awards to foreign vendors for work to be performed outside the United States. Lack of registration in the

STATEMENT OF WORK
Seven (7) 20-ft HAZMAT Container for George H.W. Bush
Contractor shall provide seven (7) HAZMAT container with minimum dimensions of 8’ width x 9’ height x 20’ length. Contractor shall provide all labor, materials, equipment, tools, transportation and supervision necessary to provide, install, and remove the HAZMAT container in support of the Bush Project at Pier 5A.
This specification covers the design, fabrication, quality assurance, delivery, removal, and onsite assistance of HAZMAT container for use in Norfolk Naval Shipyard in Portsmouth, VA.
The HAZMAT Container shall be leased for one base-year (12-months) and includes the option to extend the period of performance for two twelve-month option period. The period of performance for the base year shall be April 11, 2024 through April 10, 2025.
The HAZMAT container shall provide a space that is suitable for the storage of hazardous material. It shall contain a sump to collect leakage and a dry chemical fire suppression system as described in the following sections.
1. Government Responsibility
1.1 Government shall provide contractor ready access to the job location during contractor’s working hours (i.e., weekdays between the hours of 7:30 AM and 4:00 PM). Emergent services outside these hours will require government approval and will be no cost to the government. The government is responsible for the cost of all additional approved or requested maintenance and repairs not specifically covered under this Agreement or any applicable warranties. The government will prevent anyone other than contractor from maintaining, repairing or modifying its product.
1.2 NNSY is an industrial facility, therefore, wear and tear beyond what is normal wear and tear is typical and should be expected
1.3 The government agrees to, upon satisfactory delivery and installation; connect HAZMAT container to temporary services. The government will also have temporary services disconnected upon completion of the contract in order to allow the contractor to remove the container from the shipyard.
1.4 The government will provide a COR to this project to maintain the contract is being completed and a C400/COR representative will be the point of contact to escort, if needed, once the contract is award.

2. Contractor Responsibilities
2.1. Provide all HAZMAT containers on or prior to 11-April-2024 to Norfolk Naval Shipyard in Portsmouth, VA or to an agreed upon location with the Shipyard POC.
2.2. Delivery crew security clearance request is required for shipment offload within the Controlled Industrial Area at NNSY. Contractor shall arrange the Security clearance request with the pass office at NNSY.
2.3. The contractor shall dispatch a representative within 24 hr. of notification in order to activate fire suppression system after the Government has connected temporary utilities.
2.4. The contractor shall dispatch a representative in response to a service request to repair and/or replace any equipment within 24 hours of notification by Norfolk Naval Shipyard at no additional charge.
2.5. Provide representative within 24 hours in order to modify units in the event the customer determines the units do not meet contract specifications.
2.6. Before any leased/purchased temporary production facility will be accepted by the government an inspection at NNSY will be performed to ensure that the contractor has provided a product that conforms to the agreed upon specifications. If the inspection is not satisfactory, the contractor has 3 business days to correct the discrepancies (at contractor’s cost) or the temporary production facility will not be accepted the government.
2.7. Upon completion of the contract, the contractor will provide all labor, materials, equipment, tools, transportation and supervision necessary to breakdown the HAZMAT containers and remove them from the shipyard.
2.8. Contractors and Non-NNSY Government Agencies (NNGAs) are hereby informed that their employees or representatives present on property under Norfolk Naval Shipyard (NNSY) cognizance must adhere to Federal OSHA requirements for hazardous energy control lAW 29 CFR 1915.89 and must follow Hazardous Energy Control (HEC) procedures as identified in NAVSEA's Occupational Safety, Health, and Environment Corporate Manual (OSHECM) Chapter 250 (latest revision), when performing work under NNSY contract. All HEC work to be performed by Contractors and NNGAs requires that NNSY Technical Points of Contact (TPOCs) and/or Contracting Officer's Representatives (CORs) be notified of the HEC scope of work prior to starting work. Any changes or deviations in the initial scope of HEC work require the NNSY TPOCs and/or CORs be informed of the change/deviation. Appendix 250.8-1 through B-3 of OSHECM Chapter 250 for multiple employer work identifies when Contractors and NNGAs are required to assign their Lockout/Tags-Plus Coordinator (LOTC) to coordinate HEC work with the cognizant NNSY LOTC. HEC locks shall be provided by the contractor or NNGA for their employees use. The HEC locks shall have red bodies with name labels or name tags affixed, identifying who installed the HEC lock(s) and a point of contact telephone number. HEC lock name labels and tags must be made of materials that will hold up to the environment to which they are exposed. HEC tags used for Tags-Plus HEC work shall be provided by the cognizant NNSY LOTC to the contractor or NNGA for their use if machinery, equipment, or systems (MES) cannot be locked out. OSHECM Chapter 250 Tags-Plus procedures will be strictly followed.

2.10. Names and contact information for NNSY LOTCs and/or the Facility Custodian will be provided by NNSY TPOC and/or CORs set forth elsewhere in this award document."
2.11. The contractor shall set the box in the proper location, designated by the technical POC and provide a representative within 24-hours notification of connection to temporary services to activate the automatic fire suppression system.

3.1 Resulting project shall comply with all governing codes and Naval Standards including the most recent Unified Facilities Criteria, International Building Code 2012, ADA and Requirements for Lifting Equipment. Guiding Documents:

4. General Requirements
4.1. Shall have a minimum sump capacity of 850 gallons
4.2. A/C and heat required to maintain unit at 70 degrees at all times, year round
4.3. Shall have a dry chemical fire suppression system which meets all NFPA, and OSHA requirements.
4.4. Shall have a minimum 120/240V, 100A, 3 wire, single phase UL listed load center (NEMA 3R)
4.5. Shall have exterior camlok connection box feeding a 600V, 40A 2-pole circuit breaker enclosed in a NEMA 3R enclosure feeding a 15kva, 440/240V primary:240/120V secondary, single-phase transformer. This transformer to provide power to load center. See enclosure (1) and (2).
4.6. Shall be in compliance with applicable NFPA and NEC requirements
5. Maintenance Requirements
5.1. Equipment replacement/repair for any item, and or, components other than items and or components damaged by negligence.
5.2. Fire suppression system repair and troubleshoot as needed.
5.3. Door repair/replacement as needed based on normal wear.
5.4. Quarterly A/C filter changes and replacements as needed per periodic maintenance plan.
6. HAZMAT Enclosure Requirements
6.1. Provide a decal on each unit with the following information: Contractor company name, contract number and a unique number. The unique number must be different on each unit. The decal shall have the following: minimum of 8.5” x 11” in size, white in color with black writing. The decal is to be located on one of the doors of the unit. If the half of the unit does not have a door, an 11/3” x 4” at minimum label shall be placed on the electrical panel on the inside of the unit.
6.2. Hurricane proof to 110 MPH winds also must be water resistant.
6.3. All doors are to swing outward. Cipher locks are not required for the HAZMAT containers;
however, the doors must be capable of being locked. Multiple sets of keys shall be provided to the Shipyard POC and key replacements must be provided upon request from the customer.
6.4. Energy efficient heat pump in each HAZMAT enclosure, in all cases, the unit must be able to maintain 70 degrees Fahrenheit in summer or winter. The unit shall be energy star rated.
6.5. Provide (1) one fire extinguisher at each door (dry chemical NIIN: 4210-01-467-3616)
6.6. There shall be no windows in the units.
6.7. Floor covering shall be a steel grate allowing the flow of hazardous material directly into the sump. The steel grating shall be designed to withstand the exposure to hazardous material.
6.8. Identification on the box shall clearly identify the enclosure as a hazardous material storage area and entry into the enclosure includes the risk of direct exposure to hazardous material.
7. Electrical Requirements
7.1. One row of surface mount fluorescent twin tube strip type interior light fixtures with energy efficient electronic ballast and 32 watt fluorescent bulbs. Mount in center of enclosure. Light fixtures shall be blast proof.
7.2. All Wire must be THHN or THWN, 75 degrees Celsius (min), size as indicated. Do not substitute wiring type/temperature rating unless the ampacity of wire and conduit fill requirements are evaluated to ensure NEC compliance.
7.3. Electrical Metallic Tubing (EMT) is specified on drawings. The NEC requires EMT to be supported within 3 ft of each box or conduit body and supported every 10 ft (min).
7.4. Liquid Tight Flexible Metal Conduit (LFMC) may be used on the exterior instead of EMT. The NEC requires LFMC to be supported within 1 ft of each box or conduit body and supported every

7.5. The NEC requires the following color code:

7.8. Ground (Equipment grounding conductor) = green
7.9. Exterior wiring to include a camlok connection box feeding a 600 Volt, 40 amp, 2 pole circuit breaker enclosed in a NEMA 3R circuit breaker enclosure. This is to feed a 15 kva, 480/240 volt primary, 240/120 volt secondary single phase transformer (see enclosure (2)). See enclosure (4) for a list of exterior equipment. Equivalent material may be substituted.
7.10. Contractor may use a fusible disconnect switch, NEMA 3R with current limiting fuses rated the same size as the circuit breaker in the enclosure (2) ( PC-4 and PC-5).
7.11. Receptacles: 120 volt, 20 Amp Quad type receptacle wired on a #12 AWG (min of two Quad
Receptacles per circuit). Provide (1) ea 120 volt, 15 amp duplex GFCI test type receptacle wired on a dedicated circuit mounted on the exterior in a weatherproof box beside the HVAC unit.
7.12. A typical transformer wiring diagram is shown in enclosure (3) in the drawing, use the manufacturers wiring schematic to connect transformer (schematic usually located on front panel of transformer). Transformer size may be adjusted depending on load demand of HAZMAT enclosure.
7.13. Input connections of the HAZMAT container electrical system shall be per NEC requirements and using camlok receptacles (see enclosure (1)).
7.14. Transformer frame shall be bonded to unit frame using appropriate size bonding jumper from NEC table 250.122, per NEC.
7.15. Wiring of units electrical system shall comply NFPA 70 (National Electric Code) where applicable.
8. Relocation
8.1. In the case that Norfolk Naval Shipyard needs to relocate the unit the following must be provided:
8.1.1. Units shall be stiffened as required to eliminate swaying of the upper units.
8.1.2. Units are to be outfitted with suitable attachments for overhead AND forklift lifting.
8.1.2.1 For multiple point lifts, each lifting attachment shall be capable of supporting one half the gross weight of the equipment with a design factor of five to one based on ultimate strength. For single point lifts, the lifting attachment shall be capable of supporting the gross weight of the equipment with a design factor of five to one based on ultimate strength.
8.1.2.2. For multiple point lifts, each lifting attachment shall accept a standard anchor shackle (Federal Specification RR-C-271D, type IVA) which is capable of supporting one half the gross weight of the equipment. For single point lifts, the lifting attachment shall accept a standard anchor shackle (Federal Specification RR-C-271D, type IVA) which is capable of supporting the gross weight of the equipment.
8.1.2.3. Design of the lifting attachments shall be such that the attachments and shackles are not side loaded more than 10° out of the plane of the attachment unless specified by the manufacturer. Lifting attachments shall be located such that the lifting slings do not contact the equipment, or alternatively a spreader beam certified to NAVFAC P-307 shall be provided. Whenever practical, the lifting attachments shall be located above the center of gravity, and such that the lifting slings do not contact the equipment housings.
8.1.2.4. Each lifting attachment shall be conspicuously marked in a contrasting color “lift here”.
Letters shall have a minimum height of 1”. Where multiple lifting attachment points and/or tiedown points exist (i.e., forklifts and aerial platforms), each lifting attachment shall be conspicuously marked or identified.
8.1.2.5. Forklift channels shall be 5”x10” inside dimension the full width of the unit and enclosed on all four sides.
8.2. The equipment shall be marked in a prominent location with the gross weight. Sand hopper tubs, or other containers that may contain material shall be marked with the empty and full weight (or alternatively the empty weight and working load limit). Marking shall be in upper case letters of contrasting colors, with a minimum height of 1”. Marking shall include the units (i.e. “pounds”, “long tons”. Etc.).
8.3. The equipment shall be provided with a lifting sketch/rigging diagram that meets the requirements of Section (11).
8.3.1. The lifting sketch shall detail any specific requirements and/or configurations that must be met prior to lifting (i.e., “engage swing lock,” “tilt mast back fully,” “rotate lifting basket over side,” “utilize 10’ minimum length slings,” and “spreader beam required”).
8.3.2. The lifting sketch shall include the location of the equipment center of gravity (full fuel, hydraulic tanks, etc.), equipment model/manufacturer, and gross weight.
8.3.3. A copy of the lifting sketch shall be provided with the equipment and copies shall be forwarded to the government points of contacts and Code 714 (396-3345/3346).
8.4. If specialized handling gear, other than shackles, standard slings, or chain hoists, is required (i.e., spreader beams and special lift rigs), the contractor shall provide it unless NNSY previously agrees to furnish this gear.
8.5. Permanently affixed isometric rigging diagram shall be placed near the gross weight label and shall include:
8.5.1. Show one (1) unit
8.5.2. Show center of gravity location.
8.5.3. List manufacturer and gross weight.
8.5.4. Locate diagram near one of the “gross weight” markings.
8.5.5. Indicate minimum standard anchor shackle size and minimum sling length.
8.6. Provide 3 paper copies of the isometric rigging diagram.
9. Lifting Sketch Requirements
9.1. The HAZMAT container must be capable of being moved by forklift AND crane.
9.2. Lifting sketches, as a minimum, shall identify the following:
9.2.1. The weight of the load.
9.2.2. The location of the center of gravity
9.2.3. The minimum capacity/length of slings
9.2.4. The minimum capacity of other standard rigging gear
9.2.5. The attachment (lifting) points for the load
9.2.5.1. The attachment points for multiple leg lifts shall be sized such that each attachment point can support half the load’s weight at the anticipated lift angle.
9.2.5.2. The attachment point for single leg lifts shall be sized such that the attachment point can support the entire load’s weight.
9.2.6. Limitations on allowable orientations for any parts making up the lifting assembly
9.2.7. For single leg vertical lifts using twisted rope (wire or synthetic), two parallel ropes each capable of supporting the entire load alone shall be required unless a method is used to prevent unraveling the rope.
9.2.8. A minimum D/d ratio of one shall be required where wire rope slings pass over any object, or in the eyes of wire rope slings. A minimum D/d ratio of two shall be required where synthetic rope slings pass over any object, or in the eyes of synthetic rope slings.
9.2.8.1. "D" represents the diameter of the object the sling passes over.
9.2.8.2. "d" represents the diameter of the sling.
9.2.8.3. Table 14-3 of NAVFAC P-307 lists efficiency factors at various D/d ratios.
9.2.9. Components in each handling assembly shall be sized based on the worst case distribution of loads. Note: When making a two-, three-, or four-point lift, the handling gear shall be sized so that two legs can support the load without exceeding the safe working load (SWL) at the lift angle expected, unless an equalizing method is used
9.2.10. When nonstandard gear is required (i.e., round stock lifting bars) written instructions shall be provided that ensure:
9.2.10.1. The proper material is being used.
9.2.10.2. The item is certified.
9.2.10.3. Any special requirements or dimensions are followed to ensure that engineering assumptions are met (i.e., eccentricity of the bearing points).

9.2.12. A load indicating device (LID) and a pre-determined stopping point will be in the rigging configuration; applicable to engineering estimated weights and loads not covered by a technical work document (TWD), unless otherwise approved by C-714.
10. DBIDS
10.1. Any new contractor, vendor or supplier requesting base access AFTER 31 MAY 2017 will be required to obtain a DBIDS credential. NCACS credentials will no longer be issued.
10.2. Only DBIDS credentials will be issued to ALL contractors, vendors and suppliers seeking base access AFTER 14 August 2017.
10.3. Defense Biometric Identification System (DBIDS) increases installation security and communications by receiving frequent database updates on changes to personnel/credential status, law enforcement warrants, lost/stolen cards, and force protection conditions. The system provides a continuous vetting anytime the DBIDS card is scanned at an installation entry point.
If you currently have a Navy Commercial Access Control System (NCACS) card, The following is required to get a DBIDS credential:
10.4. Present your NCACS Card and completed copy of the SECNAV FORM 5512/1 to the base Visitor Control Center representative.
10.5. The VCC will pull up your information in the computer, ensuring all information is current and correct.
10.6. Once your information is validated, a temporary DBIDS credential is provided.
10.7. Your temporary credential will have an expiration date, prior to which you will need to obtain your permanet DBIDS credential (~90 days)
10.8. For each additional U.S Navy installation to which you need access, the first time you visit you only need to bring your DBIDS credential and statement of purpose for base access when arriving at the Visitor Control Center.
10.9. The representative will enter base access authorization and then you may proceed to work.
If you do NOT have an NCACS Card, the following is required to obtain a DBIDS credential:
10.10. Present a letter or official document from my government sponsoring organization that provides the purpose for your access.
10.11. Present valid identification, such as a passport of Real ID Act – compliant state driver’s license.
10.12. Present a completed copy of the SECNAV 5512/1 form to obtain your background check.
10.13. Upon completion of the background check, the Visitor Control Center representative will complete the DBIDS enrollment process, which includes your photo, finger prints, base restrictions, and several other assessments: after all this is done, you will be provided with your new DBIDS credential.
10.14. You may now proceed to work.

Participation in the DBIDS is not mandatory, and if the Contractor chooses to not participate, the Contractor’s personnel will have to obtain daily passes, be subject to daily mandatory vehicle inspection, and will have limited access to the installation. The Government will not be responsible for any cost or lost time associated with obtaining daily passes or added vehicle inspections incurred by non-participants in the DBIDS.
11. ENTERPIRSE-WIDE CONTRACTOR MANPOWER REPORTING APPICATION (ECMRA)
11.1. The contractor shall report contractor labor hours (including subcontractor labor hours) required for performance of services provided under this contract for the Rental of One (1) 1,050 CFM Oil Free Electric Powered Air Compressor with Air Dryer via a secure data collection site.
Contracted services excluded from reporting are based on Product Service Codes (PSCs). The excluded PSCs are:
11.1.1. W, Lease/Rental of Equipment;
11.1.2. X, Lease/Rental of Facilities:
11.1.3. Y, Construction of Structures and Facilities;
11.1.4. D, Automatic Data Processing and Telecommunication, IT and Telecom- Telecommunications Transmission (D304) and Internet (D322) ONLY:
11.1.5. S, Utilities ONLY;
11.1.6. V, Freight and Shipping ONLY.
11.2. The contractor is required to completely fill all required data fields using the following web address: https://www.ecmra.mil
11.3. Reporting inputs will be for the labor executed during the period of performance during each Government fiscal year (FY), which runs October 1 through September 30. While inputs may be reported any time during the FY, all data shall be reported no later than October 31 of each calendar year. 12. PREPERATION FOR DEIVERY/REMOVAL OF RENTAL UNITS
12.1. The HAZMAT Container must be preserved and packaged per the manufacturer’s commercial practice. Packing shall be in a manner that will insure acceptance by a common carrier and safe delivery at the destination. The shipping container and method of packing must comply with the Uniform Freight Classification Rules or other carrier regulation as applicable to the mode of transportation.
12.2. A parts list and a technical/instructional manual shall be provided to the technical POC, TBD upon award. All Rental Equipment received by NNSY must be supplied with proper interface connectors to allow hook-up by NNSY Shop 99. There may be specific equipment that will require NNSY Shop 99 evaluation to determine proper cabling and connectors.
12.3. Unless otherwise notified by NAVSEA Service Contracting Branch, Norfolk Naval Shipyard, Code 400, the rental/lease unit(s) shall be picked-up (removed) by Contractor on the morning after expiration of the established contract period of performance. In the event that this date occurs on a Saturday, Sunday, or a recognized Federal Holiday, the Contractor may make the appropriate arrangements to pick-up the equipment on the first working day following the expiration of the contract at no additional cost to the Government.
If any difficulty is experienced in picking-up (removing) unit(s), the Contractor MUST immediately request the Contracting Officer’s direction by contacting William Webb, Code 432, via telephone (757) 396-3108 AND providing notification of same via email to William.a.webb2@navy.mil AND Alicia.n.thomas@navy.mil .
A Contractor’s failure to follow the above instructions regarding pick-up/removal of rental units may relieve the Government of any liability for further charges for the equipment.

(d) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph
(d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, as defined in FAR 2.101, on the date of award of this contract, and does not contain the clause at 52.215-2, Audit and
Records--Negotiation.
(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor's directly pertinent records involving transactions related to this contract.
(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR Subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.
(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.
