JUSTIFICATION AND APPROVAL

FOR USE OF OTHER THAN FULL AND OPEN COMPETITION

1. Contracting Activity.

Norfolk Naval Shipyard (NNSY), Portsmouth VA, Contracts Department, Submarine and Availability Support Branch (C451).

2. Description of the Action Being Approved.

Award of a firm-fixed-price contract to Northrop Grumman Systems Corporation, on a sole source basis, for the maintenance, repair, and overhaul of the No. 1 and No. 2 ship service turbine generators (SSTG) on the at Norfolk Naval Shipyard.

3. Description of Supplies/Services.

NNSY requires the maintenance, repair, and overhaul of SSTG No. 1 and No. 2 aboard the . The services to be provided, all in accordance with OEM proprietary drawings and specifications, will address maintenance to various SSTG components, to include disassembly, inspection and repair; tuning and balancing; as well as removal of existing components and installation of new OEM components. With respect to the installation of new OEM components, the maintenance services will include replacement of the No.1 and No.2 SSTG Inboard and Outboard Thrust Stator as well as the contingent replacement of the No.1 and No.2 SSTG Catcher Bearings. OEM materials and specialized tooling are required to execute the maintenance and repairs as well as new OEM components for installation; these materials and components, which require a minimum 637 day lead time for production and delivery, are to be provided by the OEM under this contracting effort.

The anticipated period of performance and total estimated dollar value of the proposed contracting effort under this acquisition is summarized below:

The Contracting Officer has coordinated with the necessary stakeholders to ensure sufficient and appropriate funding are programmed into the budgetary process for FY23. Funding for the contracting action was received February 23, 2023. The Contracting Officer intends to award the contract in FY23.

4. Statutory Authority Permitting Other Than Full and Open Competition.

5. Rationale Justifying Use of Cited Statutory Authority.

Northrop Grumman Systems Corporation (Northrop Grumman) is the OEM and maintains proprietary tooling and equipment and proprietary drawings required to execute the SSTG maintenance, repair, and overhaul. Also, the components to be replaced are proprietary to the OEM and are designed for form, fit, and function with the existing systems installed on the submarine. Currently the OEM is the only known vendor that can complete the repair and satisfy the appropriate procedures.

Therefore, as noted above the acquisition strategy to accomplish the award of the required by FAR 6.302-1.

6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable.

A Sources Sought Notice was posted on the SAM.gov website on 28 February 2023 and closed on 10 March 2023 in order to identify any other capable sources to accomplish the required services and provide the necessary parts. However, no other potential sources expressed an interest in this requirement. Further, in an effort to identify other potential offerors, NNSY conducted a review of the market place. Following the review of available online contract reporting websites (FPDS-NG, SAM.gov, Electronic Data Access), no additional contractors were identified with the capability to execute the required scope of work.

Further, historical contract actions executed by other Shipyards were reviewed. The OEM, Northrop Grumman, has provided virtually identical services for SSTG repair under Portsmouth Naval Shipyard (PNSY) sole source contracts N3904017C0012 for the

For the reasons set forth in paragraphs 5 and 6, NNSY has no plans at this time to compete future contracts for the types of supplies/services covered by this procurement.

If another potential source emerges, NNSY will assess whether competition for future requirements is feasible.
