EX-MCKEE BID QUESTIONS-ANSWERS

EX-MCKEE

BIDDERS QUESTIONS BIDDERS ANSWERS

The following is in regards to a previous response from the Navy regarding the lag/wait time between inspection availability and approval to seal and stage packages of radioactive waste (Section 7.5.6). The Navy responded as follows “Lag/wait time can vary depending on amount of data and waste to be inspected but standard lag or wait time between inspection availability and approval to seal and stage packaged radioactive waste is approximately 24 hours during a standard work week”. Question, is the referenced 24 hours constitute one calendar day or is the 24 hours three standard work days? If neither of these, please identify what the 24 hours represent. One calendar day
Due to the amount of information to review and number of Volumes to produce, additional time is needed to provide a comprehensive and cost effective proposal; will the Navy extend the due date by 2 months (to 5/22/21)?No, at this time the solicitation will not be extended beyond the solicitation closing date identified in the solicitation.
Given the time which the ship has been docked and the short timeframe from the Pre-Solicitation Notice and the Final Solicitation, what is driver for starting the work so expeditiously in 2021?To meet the Required Delivery Date (RDD), work will commence on the dates identified in the solicitation.
What is the current state of the ship, since it’s been at NNSY since 2016? Are there existing radiological surveys (dose and contamination) of work areas and components which can be provided? The ship has been in a caretaking status since 2016. The hull has had preservation work and fresh new paint job. Yes, surveys and can be provided.
Will NNSY allow for a site visit (virtual or in person) and what would be the security requirements to meet to participate?See Amendment for instructions on Site Visit.
Without a site visit, there are a large number of unknowns about the project requirements on the Ex-McKee and difficult to develop a Firm Fixed Price without adding a lot of contingency and cost to the price. Would the Navy consider reverting back to a CPFF or a hybrid contract (CPFF/FFP)?See Amendment for instructions on Site Visit. No, the Contracting Officer has decided FFP is better suited to support this requirement.
Will NNSY consider holding an Industry Day such that more information can be obtained, questions asked and other potential bidders can be known for potential teaming (prime and/or sub) arrangements? No, it is not the Government's intent to hold Industry Days at this time.
Are there other contractors currently performing work on the ship and does NNSY currently have preferred vendors for the provision of clean waste/industrial waste containers and removal services? No, other contractors are curently performing work on the ship. Provision of clean waste/industrial waste for container and removal sercives are coverd in reference 5.34.
What are the requirements for project personnel to access the ship, work areas, and pier areas to perform inspections, hazard assessment, equipment dismantlement/disassembly, and waste removal/staging tasks?Reference 5.33 provides the requirements to gain access.
Can any of the scope be performed by personnel who don’t hold security clearances or does every proposed individual for management /offsite work as well as onsite work require security clearances to be obtained and verified prior to the proposed start date of September 20, 2021? In addition, what are the requirements for company clearance to perform this work?Yes, all managemnet/offsite and onsite work require security clearances. See DD254
The main Solicitation document has a section 7.11 (Ship Stability) which requires the Contractor to develop a Stability Plan and ensure the ship’s stability. We would consider this to be inherently a Navy function while the ship is in the Navy’s care, custody and control. We propose to coordinate with NNSY, contribute to and work to a NNSY Plan that the parties agree to. Can NNSY change this requirement in the solicitation? No, The contractor will be required to develop a Stability Plan and ensure the ship’s stability.
Due to the broad work identification associated with spaces noted as “Group 2, 3 or 4”, I am requesting permission to access the vessel to identify the items that will require removal as well as access avenues for the removed materials and equipment. I am able to obtain a red badge for NNSY but currently hold a green badge due to the work that was accomplished on the San Francisco, Wyoming, Truman and Bush. Can I get permission to receive a red badge which will allow access for the ship check. I would like to access the vessel from 3-8-2021 to 3-12-2021.See Amendment for instructions on Site Visit.

· I would like to have one of our Naval Architects join me in doing that data review.

· We both have valid CACs and clearances, but we do not have NNSY badges.

· Please advise if the CACs are sufficient for us to get into to NNSY for the data review, or if we need some other type of access or badge. If we need additional badging, please provide whatever forms and contacts are involved.See Amendment for instructions on Site Visit.
Final RFP Page 120 of 127 and Draft RFP Page 118 of 124 : Section M, 1.0 General of the Draft RFP stated, “The Government contemplates award of a cost-plus-fixed-fee task (CPFF) contract.” The Final RFP states, “The Government contemplates award of a firm-fixed-price (FFP) contract.” Under FAR 16.202-2, how did the Government reach a determination this acquisition was suitable for a firm-fixed-price contract (e.g., adequate price competition; reasonable price comparisons with prior purchases of the same or similar supplies or services made on a competitive basis or supported by valid certified cost or pricing data; available cost or pricing information permits realistic estimates of the probable costs of performance; performance uncertainties can be identified and reasonable estimates.)?The Contracting Officer has decided FFP is better suited to support this requirement.
The solicitation does not contain nor provide reasonably definite functional or detailed specifications for a contractor to prepare its fixed-price offering. To the best of our knowledge, this type of work has not previously been performed by a contractor at one of the Public Shipyards. The market research conducted in 2020 did not indicate the Government contemplated the selection of a firm-fixed-price, nor did it request respondence to provide input on the contract type most appropriate for this work.
We believe that this contract type may greatly limit competition and the number of offers received. We respectfully request that the Government reconsider the contract type and return to a CPFF contract. The Contracting Officer has decided FFP is better suited to support this requirement.
Please provide a 60 calendar day extension after the release of requested technical documents (e.g., drawings). It requires this time to develop and provide the Government with a firm-fixed-price proposal. No, at this time the solicitation will not be extended beyond the solicitation closing date identified in the solicitation.
If the Government changes the contract type back to cost-plus fixed-fee, please extend the due date by 30 calendar days after answering all questions and providing the requested technical documentation. At this time, the Government does not plan to revert back to cost plus fixed fee.
Provide an additional 7 days for Contractors to submit clarifying questions in response to answers and the requested technical documentation. The Contracting Officer does not plan to provide an additional 7 days for clarifying questions.

Will these radiological release activities be performed under the contractor’s radioactive material license? No a radioactive materials license issued by an Agreement State is not an acceptable alternative. Radiological release activities will be performed under Norfolk Naval Shipyards radioactive material
I note that the DRFP requires that the Offeror have an NRC license.Couldn't answer as this is not a question.
We currently hold 2 licenses for the production of Nuclear Fuel for the U.S Navy both in VA and TN. However these licenses do not authorize us to do work other than at those specific sites and for the stated purpose.Couldn't answer as this is not a question.
It was my belief that NAVSEA and/or NR held the authorization for the possession of nuclear material and that the Offeror would essentially work under that authority while performing the D&D. For other solicitations (such as the SSSB) NAVSEA has requested that the Offeror work to NRC standards and even possibly under NRC oversight but that an NRC license was not necessary.Couldn't answer as this is not a question.
Can you please confirm the requirements for an NRC license and if so what type of license and the timing of having to have such license (i.e. by proposal submittal or start of work).Contractor must have an NRC license that allows the contractor to perform similar work to that of this SOW. This license must be current and active prior to proposal and remain active thruoughout the duration of the contract. (need to update to SSP section L step 4.4.1) Additionally the contractor must have possessed an NRC license to perform similar work and have performed similar work to this PWS over the past 3 years prior to the due date of proposals.
Can the Offeror submit documentation of Nuclear Regulatory Commission License as an appendix? If so, is this exempt from the page limit for Factor I?License Number is appropriate.
Is the Cross-Reference Table the same thing as the Proposal Adequacy Checklist? If not, what volume should the Offeror submit the Proposal Adequacy Checklist in? Does it count towards the page count of the volume?Add checklist to Cost/Price Proposal. No, does not include Page Count.

Will the Gov't please define all applicable engineering criteria to be applied for shipping openings and lifting (margins of safety/safety factors, types of lifting gear permitted, etc.) and procedural requirements? In accordance with EPD, "The only restriction we would have if we did the job would be that lifting fixture (padeyes) should be designed to a factor of Safety of 6 to 1 on ultimate strength and then of course you have your pick point rules – 4 point pick – all padeyes to be designed so that any 2 padeyes have sufficient capacity to hold the entire load, 3 point pick rule – all padeyes must be designed such that 2 padeyes must be of sufficient capacity to carrythe entire load."
Will the Gov't please provide the ship's General Arrangement so bidder can confirm exact location of the RLWT in the ship?Conractor has to register with National Industrial Security System.
