3.5.4.1 Definitions: The following definitions apply to 3.5.4 through 3.5.4.9:

(1) ) Personal Flotation Device (PFD). A piece of equipment designed to assist a wearer to keep afloat in water.

The wearer may be either conscious or unconscious.

(2) ) Automatic Inflation (PFDs). Uses a water-soluble capsule attached to the inflation unit; its mechanism pierces the

CO2 cylinder and releases the gas when submerged. Units with automatic inflation mechanisms may also be manually inflated by using the ripcord.

(3) ) Manual Inflation (PFDs). Releases the CO2 gas from the cylinder via the ripcord, or by an oral tube in the event that a backup method is required.

(4) ) Transiting: Walking between the brow and the hatch without stopping for ANY reason.

(5) ) Working includes, but is not limited to, working, carrying equipment, transporting material, and stopping to talk with other employees.

3.5.4.2 Requirements Before Utilizing Personal Flotation Devices

(PFDs): Required Federal Approval. All PFDs (life preservers, life jackets, or work vests) must be United States Coast Guard

(USCG) approved pursuant to 46 CFR part 160 and marked for use as a work vest, for commercial use, or for use on vessels. No PFD identified for RECREATIONAL use only can be used by shipyard personnel.

3.5.4.3 Training Requirements: All personnel utilizing PFDs

must be trained per the manufacturer’s user manual.

3.5.4.4 PFD Inspections/Maintenance. All inspection and

maintenance requirements provided by the PFD manufacturer shall be complied with on a continuing basis.

3.5.4.5 General Requirements of Use. PFDs will be worn:

(1) When working near water’s edge where the possibility of falling into the water exists.

(2) When employees are working near the unguarded edges of decks of vessels afloat.

(3) In open vessels or when directed by the person in charge of any vessel.

(4) By all personnel working on floats, small boats, rafts, or camels.

(5) When working outboard of lifelines, bulwarks, or on the open decks of barges.

(6) When working at elevated positions (above 5 feet) over water where guardrails cannot be installed.

(7) When working from an aerial work platform over water.

Violations may result in administrative, NOTE: When working from an aerial work platform over water, the lanyard that is attached to the full body harness must be unhooked from the basket and remain unhooked while out over the water. When booming back in from over the water, the lanyard shall be reattached to the appropriate attachment point in the basket once over solid ground.

3.5.4.6 Use of PFDs at Piers, Dry Docks, and Submarine Topside

Areas When Waterborne. The requirements of 3.5.4.7 or 3.5.4.8 shall apply depending on work location.

3.5.4.7 PFD Requirements Within NNSY:

(1) ) PIERS: Whether transiting or working, if guardrails are not in place at water’s edge (it is very rare that guardrails will ever be in place along most of a pier), or the pier does not have any type of wall in place running along it that is at least

39 inches in height (measured from surface on which the employee is standing at any time), PFDs must be donned when inside of the most inner crane rail closest to the pier’s edge during any work or transiting situation.

(2) ) DRYDOCKS: If guardrails or a retaining wall of at least 39 inches in height (measured from surface on which the employee is standing at any time) are in place around the dock, PFDs are not required, whether transiting or working. All personnel must stay on the pier and not go onto the retaining wall itself for any reason. When guardrails have been removed from around a dry dock and the dock is filled with water, PFDs must be used whether transiting or working if inside the most inner crane rail closest to the dock edge. If water has been removed from the dock and guardrails are not in place, fall protection would be required.

(3) ) TOPSIDE OF SUBMARINES: The following requirements apply to wearing of PFDs topside on submarines that are waterborne to include in dry dock:

(a) When transiting between the brow and any hatch, PFDs ARE NOT required topside if there are Ship's Force lifelines, or, topside guardrail system is installed around the main deck, including a third rail installed approximately 10 inches above the deck surface for Submarines in drydock.

(b) When working topside, PFDs are not required only if there is a topside guardrail system installed, including a third rail installed approximately 10 inches above the deck surface if

Submarine is in drydock. It is not acceptable to work topside with only Ship’s Force lifelines in place.

3.5.4.8 PFD Requirements Off Yard (i.e., Naval Base Norfolk, BAE, Kings Bay, etc.): If a signed MOA is in place between NNSY and the locale where work is taking place, the requirements/prohibitions of the MOA will be followed. If the existing MOA is not in place, or the existing MOA does not address the subject of PFD usage, NNSY personnel shall comply with the following:

(1) ) PIERS. Whether transiting or working, if guardrails are not in place at water’s edge (it is very rare that guardrails

39 inches in height (measured from surface on which the employee is standing at any time), PFDs must be donned when there is a danger of falling into the water. It is recommended that personnel wear PFDs if transiting or working inside of six feet from water’s edge. However, it will be incumbent upon supervision and management to evaluate when/where PFDs will be required when working off yard, establish written policy of expectations, and to enforce those rules. The following is offered as guidance that is intended to assist the management/supervision in making these decisions. The Code 106 PPE Program Manager can also be consulted if there are questions.

3.5.4.9 Interpretative Guidance if Working for NNSY Off-Yard.

While there is a physical boundary when inside the shipyard

(inner crane rails) that once you go past towards the water, you must wear a PFDS, there is no such physical boundary if working off yard. Management and supervisors are responsible to evaluate each job to determine whether or not a PFD will be required. Do

NOT just take a quick look and state that “they cannot fall into the water”. Evaluations must include the following considerations as an absolute minimum:

(1) ) Defining the Hazard of Drowning. The intent of existing regulatory guidance is that employees wear PFDs when they work in areas where the danger of drowning exists, such as on, over, or alongside the water. Typically, it is surmised that employees will NOT be exposed to the danger of drowning when employees are working behind standard height and strength guardrails, when employees are working inside operating cabs or stations that eliminate the possibility of accidentally falling into the water, and/or when employees are wearing an approved safety belt with a lifeline attached that prevents the possibility of accidentally falling into the water.” However, there are situations where a danger of drowning may not exist.

The emphasis must be on closely evaluating working conditions and employee activities to determine…
