JUSTIFICATION FOR AN EXCEPTION TO FAIR OPPORTUNITY
1. Identify the agency and contracting activity.
This justification is executed by Military Sealift Command (MSC) Ship Support Unit (SSU), Guam.
2. Nature/description of the action/contract type.
The Government intends to negotiate a Delivery Order with The GBS Group (GBS) for the USS ZEUS Alarm Panel (CASREP 19-038), OCC Stern Thruster Back Up (CASREP 19-037), and NAVIPILOT Repair Requirements under the Electrical Services Indefinite Delivery Indefinite Quantity (IDIQ) Contract N32205-18-D-4704.
3. Description of supplies/services.
GBS will provide an engineer to interface with ship’s force to troubleshoot the USNS ZEUS input data modules within the flooding alarm panel and stern thruster back-up excitation contactor coils systems. In addition, GBS will provide an engineer to interface with S/F to troubleshoot the USNS ZEUS NAVIPILOT 4000 system. Services are to be completed during a 6 - 8 day port visit in Guam to be completed no later than 16 September 2019. The total estimated value of this requirement is $57,750.00.
4. Identification of the exception to fair opportunity.
In accordance with FAR 16.505(b)(2)(i)(a) and (b), the GBS Group is the Original Equipment Manufacturer (OEM) for CASREPs 19-037 and 038 entailing the input date modules (3 count) and Stern thruster back up excitation contactor coils system and the NAVIPILOT 4000 steering system. GBS has all the specific licenses needed for troubleshooting, removing old gear, and installing new gear/equipment.
Also, they have the background knowledge to perform troubleshooting expeditiously. They will be able to interface with the USS ZEUS’ system to clear CASREPs 19-037 and 038 and they have the detailed design knowledge to be able to perform the troubleshooting on the NAVIPILOT 4000 steering console without the need to take time to familiarize themselves with the hardware and software. As the OEM for these systems, they will have the detailed design knowledge to be able to perform the troubleshooting on the console with the short amount of days available, and to know where and how to make necessary changes to the software quickly. The short timing of the ship’s availability coming shortly before a mission means that GBS is the only company that can practicably complete this service in the timeframe allotted. The USS ZEUS is currently in Guam for a port visit and will be departing on/around 16 September 2019. In order to meet operational commitments, work identified in Section 3 must be accomplished prior to the vessel’s departure.
5. Determination by the ordering activity Contracting Officer that the anticipated cost to the Government will be fair and reasonable.
The Contracting Officer anticipates that the proposed price will be fair and reasonable by comparing with prices established in the base contract. If required, the Contracting Officer will also utilize other price analysis techniques under FAR 15.404-1(b)(2). The Contracting Officer will not proceed with award of the Delivery Order unless the proposed price is determined fair and reasonable.
6. Any other facts supporting the justification.
All supporting facts are provided in Section 4.
7. Statement of actions to remove or overcome barriers to exception to fair opportunity.
The Government does not anticipate further exceptions to fair opportunity. The contracting activity will ensure fair opportunity is provided for all subsequent requirements that fall within the scope of the Electrical Services IDIQ contracts.
