QUESTIONS & ANSWERS
provide clarification to vendor questions RELATING to Solicitation N40442-11-R-6004 MSFSC CSU-East Civilian Mariner Lodging Requirement
08 November 2011
Preamble: The following answers provided by the Government are in response to specific questions posed by industry during the set time between the Solicitation issue date (October 13, 2011) and the cutoff date (November 01, 2011) for accepting offeror’s questions.
Note: Government responses are provided in red font below.
1. My question is in regards to the small business clause, my hotel falls under the Navy Exchange Service Command. Can you please advise if we are eligible?
a. If your firm meets the requirement of being a small business under the designated NAICS Code, 721110 Hotels (except Casino Hotels) and Motels with the size standard being $7.0 million, then your firm is eligible. Business size status is derived from a vendor’s Online Representations and Certifications Application (ORCA) registration. Reference FAR 52.212-3 OFFEROR REPRESENTATIONS AND CERTIFICATIONS--COMMERCIAL ITEMS (MAY 2011) ALTERNATE I (APR 2011) page 15 of 41 of the solicitation for more information on business size.
2. Is there a difference in a small business and a small business concern? I know we are a small business but Pages 17-41 getting very confusing when knowing what to check off and what not. Any additional help would be great.
a. Reference 52.212-3 OFFEROR REPRESENTATIONS AND CERTIFICATIONS--COMMERCIAL ITEMS (MAY 2011) ALTERNATE I (APR 2011) (page 15 of 41). "Small business concern" means a concern, including its affiliates that is independently owned and operated, not dominant in the field of operation in which it is bidding on Government contracts, and qualified as a small business under the criteria in 13 CFR Part 121 and size standards in this solicitation. Please also see, “An offeror shall complete only paragraph (b) of this provision if the offeror has completed the annual representations and certifications electronically at http://orca.bpn.gov. If an offeror has not completed the annual representations and certifications electronically at the ORCA website, the offeror shall complete only paragraphs (b) through (i) of this provision.” A company is considered a small business under the assigned NAICS code if it is listed as such on its Online Representations and Certifications Application (ORCA) registration. Please notice on page 14 of 41 the following information with regards to a company's ORCA Registration: An offeror's representations and certifications, i.e. reps and certs, shall be included in the price proposal. Offerors are encouraged to register their representations and certifications online at https://orca.bpn.gov/login.aspx and provide confirmation in the price proposal of the registration, as opposed to providing a hard copy of the reps and certs.
3. There is also some question of whether this is considered a "Supply" or "Service" contract solicitation.
a. The lodging services for this requirement are considered a “Service” under Product Service Code (PSC): V231-Transportation, Travel and Relocation Services, Lodging – Hotel/Motel.
4. Would corporate housing be acceptable for this requirement?
a. Reference para. I (A) of the Description of Services-Lodging/Facilities (page 4 of 41), “The primary lodging facility must meet or exceed the three Diamond hotel rating from the American Automobile Association (AAA). In addition to the primary facility, the contractor must have a minimum of two (2) overflow hotels that meet or exceed the AAA three Diamond hotel rating.” If AAA does not provide ratings for corporate apartments, then the facility does not meet the requirement. Per Volume 1: Technical Proposal, Subfactor I: General Requirements of Primary and Overflow Hotels, the proposal must include “a current copy of your AAA 3 Diamond hotel rating certification for the primary and overflow facilities.”
5. Will my proposal be acceptable if our hotel is on the side of the tunnel and it is separated from the base by a tunnel?
a. As long as the facility meets the requirements outlined in para. I (A) of the Description of Services-Scope of Work (page 3 of 41), including “Such facilities shall be located within a twenty-five (25) mile radius of CIVMAR Support Unit-East (CSU-E), Bldg SP-312, 518 A Street, Naval Station, Norfolk VA 23511-2419, using www.google.com, AND excludes any hotel separated from the base by a tunnel,” the proposal will be considered technically acceptable. Per Volume 1: Technical Proposal, Subfactor I: General Requirements of Primary and Overflow Hotels, the proposal must include “statement that each hotel facility will not be separated from the base by a tunnel.”
6. Can a minimum requirement be changed? Specifically, reference para. I (A) of the Description of Services-Lodging/Facilities (page 4 of 41), “The lodging facility must be within 1/8 mile distance of a public transportation designated stop.” Can it be changed to the following: “Increase the mile distance to 1.6 miles from a designated public transportation stop or, include transportation services to the nearest designated public transportation stop.”
a. In reference to para. I (A) of the Description of Services-Lodging/Facilities (page 4 of 41), the requirement states, “The lodging facility must be within 1/8 mile distance of a public transportation designated stop.” This minimum requirement cannot be changed. The Civilian Mariners need this requirement to have the ability to travel to other areas in the city for food, entertainment, shopping, etc.
7. Will it be Monday through Friday of every week?
a. This requirement is for lodging services seven days a week, i.e. Sunday through Saturday. The CSU-E office is closed on weekends and all Federal holidays so the civilian mariners will also stay at the hotel on weekend and during Federal holidays. During most holidays, there is no decline in hotel numbers, except for the Christmas holiday, where numbers can decline substantially. However, historical data indicates there will be an increase in the room count in January with returning CivMar s. Facilities will observe the largest number of check-ins on Sundays, and the largest number of check outs on Fridays as CSU-E Pool numbers are higher at the beginning of the week and lower at the end of the week.
8. Can we use more than one hotel for lodging at a single time?
a. Reference para. I (A) of the Description of Services-Lodging/Facilities (page 4 of 41), “the contractor/ primary facility must provide lodging to the majority (greater than 50%) of the mariners at all times. The overflow facilities will only be used when the primary lodging facility exceeds its capacity. Overflow hotel properties may change throughout the life of the contract.” The contractor may use more than one hotel for lodging at a single time as long as the primary facility has met the above stated condition. The contractor will need to have a sufficient number of hotel rooms available to meet the requirement for 120-200 average rooms per night. During New Hire orientation week, the contractor will room the New Hires at the same facility and not split the New Hires up between the primary and the overflow facilities. The New Hire rooms will be reserved in advance by MSFSC.
9. Can you provide an estimate of reservations by day of the week for each month?
a. Reference para. I (A) of the Description of Services-Lodging/Facilities (page 4 of 41), “The quantities of single rooms actually occupied for lodging on any one day may vary depending upon the fluctuating number of CIVMARS awaiting assignment or attending training,” and, “Based on previous history, the room nights will vary with an estimated average of 120 rooms per night, to as many as 200 rooms per night. Reservations will be made in advance of arrival of the hotel guests by the MSFSC CSU-E designated POC.”
10. How solid is the 120-200 range for the number of rooms required?
a. Historically, our hotel numbers have been cyclic, so it is somewhat predictable as to when the numbers will decrease and increase. The average number of rooms required on a nightly basis is between 120 and 200. Reference para. I (A) of the Description of Services-Lodging/Facilities (page 4 of 41).
11. How many rooms will be needed on a weekly basis?
a. The number of rooms needed on a weekly basis will vary. The contractor will need to have a sufficient number of hotel rooms available to meet the requirement for 120-200 average rooms per night. Reference para. I (A) of the Description of Services-Lodging/Facilities (page 4 of 41).
12. Does this mean that if there are 200 rooms needed, we must provide all 200 rooms as it does not exceed our capacity of 307 rooms? (See statement below)
Reference para. I(A) of the Description of Services-Lodging/Facilities (page 4 of 41), “The Contractor shall provide hotel rooms when called for by the Contracting Officer or his/her designated representatives. The Contractor shall ensure a sufficient number of single rooms are available at all times to meet the Government’s needs. Based on previous history, the room nights will vary with an estimated average of 120 rooms per night, to as many as 200 rooms per night. Reservations will be made in advance of arrival of the hotel guests by the MSFSC CSU-E designated POC.
a. At least 50% of all CivMars residing under the contract must be lodged at the primary facility at all times. For example, if we require 200 rooms on the night of "XYZ" date, the primary facility would provide at least 101 rooms and their authorized overflow properties CAN provide the other 99 rooms. It is at the discretion of the primary facility how many rooms they provide daily, so long as it is 50% or more of the total rooms per day.
13. Will all the CivMars be eating at one time together or will they be dining at separate times? Will they be eating in the hotel every day?
a. Reference para. I(A) of the Description of Services-Lodging/Facilities Dining (page 4 of 41), “The Contractor shall provide dining facilities for breakfast, lunch and dinner or there must be dining facilities within one half of a mile from the primary and each of the overflow hotels, including quick service restaurants and/or full service restaurants. Food Services located within the hotel facility (eating and drinking establishments and vending machines operated in conjunction with a hotel) shall be operated in compliance with Federal, State and Local Regulations.” CivMars normally will not be at the hotel during the lunch hours, from Monday through Friday. CivMars typically depart the hotel at 6 a.m. each weekday morning, and return to the hotel at approximately 3:30 p.m. each afternoon. On the weekends, the CivMars are free to come and go as they please. The CivMars receive a subsistence payment of $38/day which is lower than the Virginia Beach/Chesapeake Meal Per Diem rate stipulated by GSA of $51/day. The Norfolk Meal Per Diem Rate stipulated by GSA is $56/day.
14. Will all the CivMars be required to stay in the same hotel or can they be split up between two hotels?
a. Reference para. I(A) of the Description of Services-Lodging/Facilities (page 4 of 41), “The contractor/ primary facility must provide lodging to the majority (greater than 50%) of the mariners at all times. The overflow facilities will only be used when the primary lodging facility exceeds its capacity. Overflow hotel properties may change throughout the life of the contract as long as the properties meet all the requirements of the contract and are validated and approved in writing by the Contracting Officer Representative (COR) and Contracting Officer prior to any changes.” The CivMars can be split up between two hotels (primary and overflow) if needed; however, in accordance para. I (A) of the Description of Services-Lodging/Facilities (page 4 of 41), “Mariners may not be moved from one facility to another at the sole discretion of the contractor. Any contractor requested moves must be submitted in advance, with adequate justification, to the MSFSC CSU-E Director for approval.”
15. If the number of overflow properties proposed exceeds the minimum number of two (2), will this be an advantage?
a. Reference para. I(A) of the Description of Services-Lodging/Facilities (page 4 of 41), “In addition to the primary facility, the contractor must have a minimum of two (2) overflow hotels that meet or exceed the AAA three Diamond hotel rating. The overflow hotels may be at different locations.” There will be no advantage gained from proposing more than two overflow properties from this requirement. The solicitation states that the contractor must provide the name and address of the primary facility and at least two overflow facilities.
16. If our proposal contains 4-5 overflow properties and the technical portion is limited to 30 pages can we use the front and back of the page to put the certificates on so all documents are provided for each property?
a. The page number limit for the Technical Proposal has increased to 50 pages. Reference 52.212-1 (ADDENDUM) ADDITIONAL INSTRUCTIONS TO OFFERORS--COMMERCIAL ITEMS, General Instructions, Volume I: Technical Proposal (page 11 of 41). The Technical Proposal shall not exceed 50 text pages and must demonstrate an understanding of the ability to meet all of the requirements covered in the statement of work.
17. If I cannot use the back of a page could it potentially count against us if we only submit the required 2 overflows and documents and not all 4 and another bid comes in with more than 2 overflows?
a. Please see the answer to question 16 with regards to the increase in the page limit for the technical proposal.
18. If you exceed more than 30 pages will you be penalized?
a. Please see the answer to question 16 with regards to the increase in the page limit for the technical proposal.
19. Page 4 of the requirements states the average of 120 mariners to as many as 200. So is the 51% plus required based on the 120 or the 200?
a. Reference para. I(A) of the Description of Services-Lodging/Facilities (page 4 of 41), “The Contractor shall ensure a sufficient number of single rooms are available at all times to meet the Government’s needs. Based on previous history, the room nights will vary with an estimated average of 120 rooms per night, to as many as 200 rooms per night” and, “the contractor/ primary facility must provide lodging to the majority (greater than 50%) of the mariners at all times. The overflow facilities will only be used when the primary lodging facility exceeds its capacity. Overflow hotel properties may change throughout the life of the contract.” At least 50% of all CivMar s residing under the contract must be lodged at the primary facility at all times.
20. Pre-committed business Levels that may affect the minimum requirement: I did not see that those dates or information was being requested is that correct? Or is that requested from the MSFSC POC upon award of the contract?
a. The following shall be added to the description of services, “Offeror shall include a list of known blackout dates during the period of performance of the contract, i.e base and option periods, in which all or a portion of the Civmars residing in the hotel will need to be relocated due to pre-committed business. The offeror shall provide a statement if no blackout dates will be used. The contractor is still responsible for providing all lodging at overflow property or properties during blackout dates. No additional blackout dates shall be added after award of contract.” Please also see the additional requirements under Volume I: Technical Proposal-SUBFACTOR I: GENERAL REQUIREMENTS OF PRIMARY AND OVERFLOW HOTELS:
· Provide a list of hotel blackout dates during the period of performance, i.e. base and option period, or provide statement that no hotel blackout dates will be used during the period of performance.
· Provide a statement that no additional blackout dates shall be added after contract award.
· Provide a statement that lodging services will still be provided at an overflow property or properties during blackout dates.
21. If the dates have to be submitted in advance with the proposal what section would they follow since it was not technically asked for in writing in the RFP?
a. Please see the answer to question 20 with regards to hotel blackout dates.
22. Assuming our hotel submits a list of blackout dates, does this mean that excluding the blackout dates, we must hold all CivMar personnel at one hotel?
a. Reference para. I (A) of the Description of Services-Lodging/Facilities (page 4 of 41), “Mariners may not be moved from one facility to another at the sole discretion of the contractor. Any contractor requested moves must be submitted in advance, with adequate justification, to the MSFSC CSU-E Director for approval,” and, “During New Hire orientation week, the contractor will room the New Hires at the same facility and not split the New Hires up between the primary and the overflow facilities. The New Hire rooms will be reserved in advance by MSFSC.” Once a CivMar is assigned a room, they will not be moved to a different room or location.
23. When is the first day of the Period of Performance?
a. The anticipated start date is 18 January 2012. The period of performance for the proposed contract is a base period of one-year, commencing on 18 January 2012, plus four one-year option periods unilaterally exercisable by the Government.

Volume II: Past Performance Proposal The Past Performance factor will be evaluated by the PCO and the Past Performance Evaluation Board (PPEB) as a factor for award and used to evaluate offerors’ ability to perform the contract successfully. There are two aspects to the past performance evaluation. The first is to evaluate whether the offeror’s past performance as a prime or subcontractor on a Government/Commercial contract is relevant and recent to the effort to be acquired.
Relevant is a measure of the extent of similarity between the service/support effort, complexity, dollar value, contract type, and subcontract/teaming or other comparable attributes of past performance examples and the source solicitation requirements; and a measure of the likelihood that the past performance is an indicator of future performance. The Government reserves the right to determine the relevancy of such information and to verify statements and representations made in an offeror’s proposal.
Recent is defined as contract completion within the last three (3) years.
The second aspect is to determine how well the contractor performed on the contracts considered relevant and recent, and will be rated on an “Acceptable” or “Unacceptable” basis.
The Government may review past performance information provided by the offeror, as solicited; and/or past performance information obtained from any other sources available to the Government to include, but not limited to, Past Performance Information Retrieval System (PPIRS), Federal Awardee Performance and Integrity Information System (FAPIIS), or other databases; and/or interviews with Program Managers, Contracting Officers, and Fee-Determining Officials; the Defense Contract Management Agency, and any other officials which may have information on the contracts submitted for evaluation.
To determine how well the contractor performed on the contracts considered relevant and recent, the following Past Performance subfactors shall be evaluated either via PPIRS or by contacting the POC provided by the offeror in the past performance proposals (Subfactors are of equal importance):
SUBFACTOR I:
Quality of product or service
SUBFACTOR II:
Timeliness or Scheduling of Services
SUBFACTOR III:
Subcontractor Management
SUBFACTOR IV:
Recommendation (Willingness to recommend the selection of this offeror again) Offerors shall submit the following minimum information in their past performance proposal for their three (3) most recently awarded Government and/or commercial contracts for the same or similar services:
Contract Number:
Government Agency/Organization Serviced:
Services Provided under Contract:
Contract start date:
Final contract price:
Performed as Prime: ___ Subcontractor:___ Volume III: Price
The PCO will evaluate price. The offeror’s proposed price will be evaluated on the basis of price reasonableness in accordance with FAR Subpart 15.404-1(b).
Price proposals will be due on the closing date of the RFP. Offerors are required to complete the SF 1449 and schedule of services. A separate unit price and extended price must be submitted for each contract line item number (CLIN) including the base period and all option periods. An offeror’s representations and certifications, i.e. reps and certs, shall be included in the price proposal. Offerors are encouraged to register their representations and certifications online at https://orca.bpn.gov/login.aspx and provide confirmation in the price proposal of the registration, as opposed to providing a hard copy of the reps and certs.
The Contractor shall provide a fully burdened single room rate for each CLIN, including, but not limited to, direct costs, indirect costs, profit and applicable taxes. However, generally the U.S. Government is tax exempt. The total price for one unit of lodging shall not exceed the maximum per diem locality rate specified in the Joint Travel Regulations. The overflow hotels’ rate must not exceed that provided by the primary facility.
Upon contract award, the Government shall provide the successful offeror an endorsed Government tax exemption certificate.
A. EVALUATION—COMMERCIAL ITEMS
Award will be made to that responsible, technically acceptable offeror with acceptable past performance whose proposal, conforming to the solicitation, has offered the lowest total evaluated price and is deemed to be responsible. The Government reserves the right to make an award based upon initial offers.
B. EVALUATED PRICE
The total evaluated proposal price will consist of CLINs 0001, 1001, 2001, 3001, and 4001. Contract award will be made for CLIN 0001 with the Government having the unilateral right to exercise the remaining CLINs in accordance with FAR 52.217-9.
C. FAR 52.217-5 EVALUATION OF OPTIONS
Except when it is determined in accordance with FAR 17.206(b) not to be in the Government's best interest, the Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. Evaluation of options will not obligate the Government to exercise the option(s).
