4. Statutory Authority Permitting Other Than Full and Open Competition

The proposed procurement is to be made pursuant to statutory authority under 10 U.S .C. 2304(c)(l) as implemented by FAR 6.302-1 - Only One Responsible Source and No Other Supply or Service Will Satisfy Agency Requirements.

5. Rationale Justifying Use of Cited Statutory Authority Use of FAR 6.302-1 is appropriate when supplies/services required by the agency are available fiom only one responsible source, and no other type of supplies or services will satisfy agency requirements.

BIA is an important logistics airport for the Department of the Navy in the Kingdom of Bahrain. BIA is the only airport facility geographically positioned to support the fleet operations in and around the 5th Fleet headquarters area of responsibility (AOR).

Hence, BIA is the only facility capable of meeting the U.S. Government requirement for ATGHS in Bahrain. Ministry of Transpqrtation (MOT) is the host country government agency that is responsible and controls the management and operation of the BIA. Based on the market research as detailed below, Bahrain Airport Services (BAS) is the sole cargo and ground handling contractor authorized by the MOT to operate at BIA and no other contractor currently holds the required licenses/certifications to operate the A TGHS services as required by the government.

IAW DFARS 206.302-1, the Contracting Officer posted a Request for Information (RFI) via Sources Sought Notice (SSN) on Federal Business Opportunities (FedBizOpps) and EURONECO on 21 February 2019 for a period of 30 days; in addition, the SSN was also disseminated via email to 12 contractors who expressed interest during the market research.

The SSN asserted that "submissions received by the contracting office in response to this Sources Sought Notice may lead to determine whether the procurement shall be conducted as a full and open competition, restricted competition, or via a sole source in accordance with Federal Acquisition Regulation (fARJ 6.302." The SSN stipulated submissions to include a capability statement which shall consist of the following:

1) A brief explanation of the contractor's experience and/or operational capabilities in performing ATGHS at the Bahrain International Airport in the Kingdom of Bahrain; AND

2) A copy of:

(i) any and all active licenses and certifications issued from the host nation government authorities responsible for issuing licenses and certifications to perform ATGHS at the Bahrain International Airport;

OR
