(b) The offeror has both the duty and the discretion to determine which of its prior contracts are most relevant to the requirements described in this solicitation. The offeror may also submit relevant contracts performed by subcontractors that will perform under this contract, but under no circumstances may an offeror submit more than five (5) contracts for review, regardless of whether the contracts were performed by the offeror, subcontractor(s), or any combination thereof. If subcontractor contracts are submitted, the offeror must also clearly indicate the percentage of work that the subcontractor(s) will perform in the course of the contract. Any submission(s) in excess of this stated limit will be excluded by the Government. The Government will choose the excluded contract(s) at random, or in any manner that the Government, in its absolute discretion, deems appropriate, without any consideration for the best interests of the offeror.

Failure to submit the completed narratives and Past Performance Questionnaires shall be considered certification (by signature on the offer/Quote) that the offeror has no past performance for like or similar items for the Government to evaluate. In the case of an offeror without a record of relevant past performance or for whom information on past performance is not available or so sparse that no meaningful past performance rating can be reasonably assigned, the offeror may not be evaluated favorably or unfavorably on past performance. Therefore, the offeror shall be determined to have unknown past performance. In the context of acceptability, “unknown” shall be considered “acceptable.”
The Government reserves the right to obtain information for use in the evaluation of past performance from any or all sources including sources outside of the Government.
4. Price

No other spreadsheet cells shall be modified by the contractor. The CLIN/SLINS shall establish the total estimated contract amount for the entire contract period of performance (Base plus 4 Option Periods), which individual orders will be subsequently written against.
(b) Cost or Pricing Data: The Contracting Officer has determined that certified cost or pricing data is not required for this solicitation. However, information other than cost or pricing data may be requested in order to determine if proposed prices are reasonable and reflect a clear understanding of the solicitation requirements. If, after receipt of proposals, the Contracting Officer determines that there is insufficient information available to determine price reasonableness, the Offeror may be requested to submit other than certified cost or pricing data. Offerors shall submit price proposals in accordance with the instructions provided herein. Incomplete price proposals may result in a removal of the offeror from the competition.
(c) This part should contain certain price information only. The offeror shall provide firm fixed prices for the quantities of services for the performance periods (including options) specified in the Section B. The prices must be in Bahrain Dinars (BHD).
(d) All prices contained in the Pricing Schedule (Section-B) reflect total compensation for the services detailed therein and are fully inclusive of all costs including labor (workers, management, aids, assistants, and operators), overhead, and general and administrative *G&A) expenses, and profit.
(e) All items covered under option years may be ordered and performed during the scheduled performance period of the contract. Offerors are required to provide prices for these items under option years. The
U.S. Government makes no guarantee that the option years will be exercised. It will be the U.S.
Government’s unilateral right to exercise the option years. Once the option is exercised, the Contractor is required to perform the work when ordered during the scheduled period of performance of this contract.
5. Contractor Responsibility

(f) Have the necessary production, construction, and technical equipment and facilities, or the ability to obtain them; and
(g) Be otherwise qualified and eligible to receive an award under applicable laws and regulations.
NOTE: Acceptable evidence of the ability to obtain resources (such as equipment, facilities, and personnel) shall normally be a commitment or explicit arrangement (such as a rental, purchase, or other acquisition agreement) which will be in existence at the time the contract is to be awarded.
The following information is required in order to determine if an offeror is responsible. Any interaction between the Contracting Officer and the offeror(s) prior to award on matters of responsibility are just part of the normal process of determining responsibility and are not considered “discussions”.
In order to aid in determining the extent to which the offeror meets particular terms of the
CONTRACTOR’s RESPONSIBILITY as set forth below, the offeror must submit the following:
- Offeror’s representation that the company is not an inverted domestic company.
- Certificate of registration of the company.
- In the event the offeror is a joint venture, a Memorandum of Association which indicates who has the authority to bind the company must be submitted.

Any information requested from a prospective offeror concerning the solicitation shall be submitted in writing and furnished to the Contracting Officer. These requests will be answered and provided within an amendment to the solicitation.

52.212-1 INSTRUCTIONS TO OFFERORS--COMMERCIAL ITEMS (OCT 2015)
(a) North American Industry Classification System (NAICS) code and small business size standard. The NAICS code and small business size standard for this acquisition appear in Block 10 of the solicitation cover sheet (SF
1449). However, the small business size standard for a concern which submits an offer in its own name, but which proposes to furnish an item which it did not itself manufacture, is 500 employees.
(b) Submission of offers. Submit signed and dated offers to the office specified in this solicitation at or before the exact time specified in this solicitation. Offers may be submitted on the SF 1449, letterhead stationery, or as otherwise specified in the solicitation. As a minimum, offers must show--
(1) The solicitation number;
(2) The time specified in the solicitation for receipt of offers;
(3) The name, address, and telephone number of the offeror;
(4) A technical description of the items being offered in sufficient detail to evaluate compliance with the requirements in the solicitation. This may include product literature, or other documents, if necessary;
(5) Terms of any express warranty;
(6) Price and any discount terms;
(7) "Remit to" address, if different than mailing address;
(8) A completed copy of the representations and certifications at FAR 52.212-3 (see FAR 52.212-3(b) for those representations and certifications that the offeror shall complete electronically);
(9) Acknowledgment of Solicitation Amendments;
(10) Past performance information, when included as an evaluation factor, to include recent and relevant contracts for the same or similar items and other references (including contract numbers, points of contact with telephone numbers and other relevant information); and
(11) If the offer is not submitted on the SF 1449, include a statement specifying the extent of agreement with all terms, conditions, and provisions included in the solicitation. Offers that fail to furnish required representations or information, or reject the terms and conditions of the solicitation may be excluded from consideration.
(c) Period for acceptance of offers. The offeror agrees to hold the prices in its offer firm for 30 calendar days from the date specified for receipt of offers, unless another time period is specified in an addendum to the solicitation.
(d) Product samples. When required by the solicitation, product samples shall be submitted at or prior to the time specified for receipt of offers. Unless otherwise specified in this solicitation, these samples shall be submitted at no expense to the Government, and returned at the sender's request and expense, unless they are destroyed during preaward testing.
(e) Multiple offers. Offerors are encouraged to submit multiple offers presenting alternative terms and conditions or commercial items for satisfying the requirements of this solicitation. Each offer submitted will be evaluated separately.
(f) Late submissions, modifications, revisions, and withdrawals of offers:
(1) Offerors are responsible for submitting offers, and any modifications, revisions, or withdrawals, so as to reach the Government office designated in the solicitation by the time specified in the solicitation. If no time is specified in the solicitation, the time for receipt is 4:30 p.m., local time, for the designated Government office on the date that offers or revisions are due.
(2)(i) Any offer, modification, revision, or withdrawal of an offer received at the Government office designated in the solicitation after the exact time specified for receipt of offers is “late” and will not be considered unless it is received before award is made, the Contracting Officer determines that accepting the late offer would not unduly delay the acquisition; and--
(A) If it was transmitted through an electronic commerce method authorized by the solicitation, it was received at the initial point of entry to the Government infrastructure not later than 5:00 p.m. one working day prior to the date specified for receipt of offers; or
(B) There is acceptable evidence to establish that it was received at the Government installation designated for receipt of offers and was under the Government's control prior to the time set for receipt of offers; or
(C) If this solicitation is a request for proposals, it was the only proposal received.
(ii) However, a late modification of an otherwise successful offer, that makes its terms more favorable to the
Government, will be considered at any time it is received and may be accepted.
(3) Acceptable evidence to establish the time of receipt at the Government installation includes the time/date stamp of that installation on the offer wrapper, other documentary evidence of receipt maintained by the installation, or oral testimony or statements of Government personnel.
(4) If an emergency or unanticipated event interrupts normal Government processes so that offers cannot be received at the Government office designated for receipt of offers by the exact time specified in the solicitation, and urgent
Government requirements preclude amendment of the solicitation or other notice of an extension of the closing date, the time specified for receipt of offers will be deemed to be extended to the same time of day specified in the solicitation on the first work day on which normal Government processes resume.
(5) Offers may be withdrawn by written notice received at any time before the exact time set for receipt of offers.
Oral offers in response to oral solicitations may be withdrawn orally. If the solicitation authorizes facsimile offers, offers may be withdrawn via facsimile received at any time before the exact time set for receipt of offers, subject to the conditions specified in the solicitation concerning facsimile offers. An offer may be withdrawn in person by an offeror or its authorized representative if, before the exact time set for receipt of offers, the identity of the person requesting withdrawal is established and the person signs a receipt for the offer.
(g) Contract award (not applicable to Invitation for Bids). The Government intends to evaluate offers and award a contract without discussions with offerors. Therefore, the offeror's initial offer should contain the offeror's best terms from a price and technical standpoint. However, the Government reserves the right to conduct discussions if later determined by the Contracting Officer to be necessary. The Government may reject any or all offers if such action is in the public interest; accept other than the lowest offer; and waive informalities and minor irregularities in offers received.
(h) Multiple awards. The Government may accept any item or group of items of an offer, unless the offeror qualifies the offer by specific limitations. Unless otherwise provided in the Schedule, offers may not be submitted for quantities less than those specified. The Government reserves the right to make an award on any item for a quantity less than the quantity offered, at the unit prices offered, unless the offeror specifies otherwise in the offer.

The DUNS +4 is the DUNS number plus a 4-character suffix that may be assigned at the discretion of the offeror to establish additional SAM records for identifying alternative Electronic Funds Transfer (EFT) accounts
(see FAR Subpart 32.11) for the same concern. If the offeror does not have a DUNS number, it should contact Dun and Bradstreet directly to obtain one. An offeror within the United States may contact Dun and Bradstreet by calling

(6) Reasonable responses to relevant questions posed by the debriefed offeror as to whether source-selection procedures set forth in the solicitation, applicable regulations, and other applicable authorities were followed by the agency.
52.212-2 EVALUATION--COMMERCIAL ITEMS (OCT 2014)
(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:
Technical Acceptability, Past Performance, and Price.
Technical Acceptability and Past Performance will be evaluated on an Acceptable/Unacceptable basis. Only those proposals receiving an acceptable rating on both Technical and Past Performance will be eligible for award.
Price: The Government will award the contract to the lowest priced offeror determined to be acceptable.
1. Technical Acceptability Technical capability will be determined by evaluating the offeror’s conformance to the solicitation using an
“Acceptable” or “Unacceptable” methodology.
https://www.acquisition.gov/
The Government will evaluate the Offeror’s Technical Acceptability based on the information in the Offeror’s written proposal submitted in accordance with “ADDENDUM TO FAR 52.212-1 INSTRUCTIONS TO
OFFERORS--COMMERCIAL ITEMS (OCT 2015)” of the solicitation.
In order to be considered Acceptable, Offerors must address each of the evaluation factors in sufficient detail so that the Government can reasonably determine that the Offeror possesses the requisite ability to perform the contract. An offeror shall be rated “Technically Acceptable” if it meets ALL technical criteria as follows:
a. Inspection of Facilities: Offeror shall possess either a DD Form 1811 (Pre-Award Survey of Contractor’s
Carrier’s Facilities and Equipment) approved after 1 January 2016, or a DD Form 1811 approved before 1
January 2016 and a DD Form 1812 (Warehouse Inspection Report) dated on or after 1 January 2016.
b. Cargo Insurance: The contractor shall submit a certification of cargo insurance IAW PWS Part I, paragraph 12.
The Government shall evaluate whether the offeror has taken any exception to the requirement. Offer/Quote that takes exception to any term of the solicitation will not be considered for award.
The technical evaluation will be performed on an individual basis and an “Acceptable” or “Unacceptable” rating will be assigned to each of above factors. For a technical proposal to be “Acceptable”, the above factors shall be
“Acceptable”. All offerors will be rated on technical acceptability using the ratings and descriptions found in the table below.
Table A-1. Technical Acceptable/Unacceptable Ratings
Technical Acceptable/Unacceptable Ratings
Rating Description
Acceptable Proposal clearly meets the minimum requirements of the solicitation.
Unacceptable Proposal does not clearly meet the minimum requirements of the solicitation.
Although this evaluation, as with the entire evaluation, involves the use of the Government’s subjective judgment, offers that simply reiterate the requirements and state that they possess the capability to perform will be considered
Unacceptable.
2. Past Performance Past Performance is a measure of the degree to which an offeror satisfied its customers in the past by performing its contractual obligations on recent and relevant contracts for direct procurement method (DPM) personal property shipment services.
“Recent” means contracts completed within 3 years (not later than 01 June 2013) or currently active as long as a minimum of one (1) year of performance has been completed as of the issuing date of this solicitation.
“Relevant” means information on previously performed contracts or on-going contracts (including those contracts where the offeror acted as subcontractor) that are similar to the statement of work/item description in the solicitation performed for Federal, State or local Government and for commercial firms.
Past performance will be rated on an “Acceptable” or “Unacceptable” basis using the ratings in Table A-2.
Table A-2. Past Performance Evaluation Ratings
Rating Description
Acceptable Based on the offeror’s performance record, the
Government has a reasonable expectation that the offeror will successfully perform the required effort, or the offeror’s performance record is unknown.
Unacceptable Based on the offeror’s performance record, the
Government has no reasonable expectation that the offeror will be able to successfully perform the required effort.
Note: In the case of an offeror without a record of relevant past performance or for whom information on past performance is not available or so sparse that no meaningful past performance rating can be reasonably assigned, the offeror may not be evaluated favorably or unfavorably on past performance (see FAR 13.5).
Therefore, the offeror shall be determined to have unknown past performance. In the context of acceptability/unacceptability, “unknown” shall be considered “acceptable.”
For contracts found to be recent and relevant, the Government will then review and evaluate the result of the
Past performance questionnaires submitted with the proposal.
The Government will make a reasonable effort to collect and evaluate past performance information from the point(s) of contact identified by the offeror or, at the discretion of the contracting officer, other points of contact. The offeror acknowledges that the Government is not responsible if the point of contact provided by the offeror fails to respond to the Government’s past performance inquiry. Offerors are also advised that the
Government reserves the right to obtain information for use in the evaluation of past performance from any sources including the Past Performance Information Retrieval System (PPIRS), and the Federal Awardee
Performance and Integrity Information System (FAPIIS), or sources outside of the Government.
The Government reserves the right to determine the relevancy of such information and to verify statements and representations made in an Offeror’s proposal.
3. Price
The Government will award to the lowest price among the offerors whose non-price factors have been evaluated as acceptable.
The Government will evaluate offers for award purposes by adding the total price for all options, to the total price for the basic requirement, to arrive at the Total Estimated Contract Amount. Price will not be assigned an adjectival rating but will be evaluated for completeness and reasonableness.
a. Completeness: All price information/data required in the RFP has been submitted. For all items in the schedule, the unit price will be multiplied by the quantity for each line item for the base and all option years. All CLINs/SLINs/ELINs as stated in the solicitation shall be priced. Failure to submit a price for any CLIN/SLIN/ELIN may result in the proposal being considered unacceptable and may not be eligible for award.
b. Reasonableness: The offeror's price proposal will be evaluated to ensure that the total proposed price is reasonable. Reasonableness may also be determined by comparison with the Government estimated and/or other offers received.
(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).
(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
52.212-3 OFFEROR REPRESENTATIONS AND CERTIFICATIONS--COMMERCIAL ITEMS (OCT 2016)
The Offeror shall complete only paragraph (b) of this provision if the Offeror has completed the annual representations and certification electronically via the System for Award Management (SAM) Web site located at https://www.sam.gov/portal. If the Offeror has not completed the annual representations and certifications electronically, the Offeror shall complete only paragraphs (c) through (s) of this provision.
(a) Definitions. As used in this provision --
“Civil judgment” means--
(1) In paragraph (h) of this provision: A judgment or finding of a civil offense by any court of competent jurisdiction.
