About this file

This document is Amendment 0003 to Solicitation N4008025R9500 for a Multiple Award Construction Contract (MACC) for large-scale U.S. military projects in Washington D.C., Maryland, and Virginia. Key changes include extending the proposal due date to 29 April 2025 at 1400 local time, revising proposal submission instructions, and modifying several contract sections related to construction duration, liquidated damages, and project labor agreement requirements.

The amendment addresses multiple contractor inquiries, providing clarifications on proposal submission, construction experience evaluation, critical path scheduling, and contractor qualifications. Notable updates include removing Project Labor Agreement clauses, confirming liquidated damages of $13,262.43 per calendar day for the base project and options, and extending the proposal preparation timeline to allow contractors sufficient time to review complex project documentation. The solicitation remains a full and open competition for design-build and design-bid-build construction projects with potential small business set-aside opportunities.

Due to the recent Class Deviation memorandum from Defense Pricing, Contracting and Acquisition Policy regarding waiver of Project Labor Agreement (PLA) Requirements, please confirm all PLA requirements will be removed from the MACC and future task order solicitations.

See Amendment 0002 removing PLA clause.

Factor 2 (i)(1) Construction Experience

The definition of recency for the contractors experience is as follows:

"Recency: Projects submitted for Construction Experience shall have been completed within the previous 10 years of the date

Bid per RFP.

of RFP Issuance. Projects submitted with completion dates on or after the RFP Issuance date will be considered Not Relevant, regardless of if the Government enters discussions."

Suggest including ....completed or have achieved Substantial Completion within the previous 10 years of the date of the RFP Issuance.

12 14 00 21 00 - Instructions

Factor 2 (ii) Basis of Evaluation

The second bullet under the Basis of Evaluation section states : "Projects demonstrating Offeror’s and/or proposed design firms(s) ability to perform multiple (minimum of three) projects simultaneously."

Due to each project used to demonstrate experience being limited to a project performed under a single task order or stand-a-lone contract, this evaluation criteria will be difficult for the offeror to describe and the Government to evaluate.

Please clarify how the offerors are to demonstrate this criteria. Alternatively, consider moving the requirement to be included in a new paragraph within Factor 1 or 6 requesting the offering team (contractor and DOR) to describe their experience with and/or approach to executing multiple projects and/or task orders simultaneously.

Bid per RFP.

13 Amend

Amendment 01 clarified the PPI due date of no more than 3 weeks after solicitation effective date.

Please consider adjusting the PPI due date to 1 week after the site walk to allow time for any questions that arise during the walk.

See amendment 0003.

14 I'm assuming there will be an amendment forthcoming that will extend the bid date past April 15th seeing as how we just received the drawings and the site visit is still pending?

See amendment 0003.

For Section II. Point of Contact (POC) Data - Who is the Navy POC? Please provide the Navy’s POC Contact information

See Revised Base Access form.

16 Base Access Form

17 Base Access Form

For section VI. We can fill out the Contractor visitor data, but we do not have any information regarding the working location. Please let me know what we should put for this section.

See revised Base Access Form.

18 The RFP is specific that the PPI cutoff is 21 days from the issuance date of the RFP which was revised in Amd 1 to be 3/13. However, since we just received the documents today will the PPI be extended to at least 21 days from today?

See amendment 0003.

19 When filling out the attached security access form who do you want us to list as the USG POC?

Please also provide that USG POC contact information so we can fill it out on the security access form.

See revised Base Access Form.

(i) Solicitation Submittal Requirements

Please confirm that provided tabs (ii) (Executed SF1442, Completed Price Proposal Form for the Seed Project, and SAM Registration) should be separated in numerical order.

See Amendment 0003.

21 Drawings were provided to Offerors a week after the solicitation was opened, leaving only 3 weeks to bid the project. Due to the complexity of this project and the time required to

See amendment 0003.

establish a proper scope of work for subcontractors to propose on, please consider extending the proposal due date by 2 weeks. This will also allow adequate time for offerors to incorporate and respond to any changes resulting from Government RFI responses.

22 5 In order to adjust the Offerors proposals to accurately reflect the PPI responses from the Government, please give offerors at least 10 working days after all PPI’s have been responded to.

See amendment 0003.

23 Please confirm that a small business within a Mentor Protégé JV with a large business does not need to show any past experience projects in order for the JV's project experience to be evaluated as acceptable.

Confirmed. However, Bid per RFP, Factor 2, "Joint Ventures: Offerors who fail to submit experience for all JV member partners may be considered less favorably."

24 If the Offeror is a Mentor Protégé JV, please confirm that the JV may be evaluated as acceptable by only providing projects that were completed by the mentor/large business.

Confirmed. However, Bid per RFP, Factor 2, "Joint Ventures: Offerors who fail to submit experience for all JV member partners may be considered less favorably."

25 22 Factor 6 - Technical Solution

(i) Solicitation Submittal Requirements

On page 22 of the RFP, under Factor 6 - Technical Solution, it requests that a Critical Path Schedule be provided in the proposal.

Please confirm that the Critical Path Schedule can be in P6 format on 11 x 17 pages and does not count toward the page limit for Factor 6.

Confirmed.

26 (a) Please confirm whether specific task orders within the program will be designated as Small Business Set-Asides or will all contracted Offerors be allowed to bid all task orders that are released in the program?

(b) Will Small Business entities be permitted to bid

Bid per RFP, "At the Government’s discretion, Construction projects with smaller magnitudes may be solicited with preference to the small business reserve pool under this IDIQ, if applicable." Please also reference FAR 52.219-32.

on all task orders within the program therefore possibly receiving a 10% pricing evaluation advantage over Large Businesses?

27 24 5.3 The RFP/Amendment 1 notes PPI's are due 21 days after the solicitation effective date which was set in Amendment 1 as 3/13/25, making PPI's due 4/3/25.

The Documents for the seed project were not provided until Amendment 2 on 3/20/25 and the site visit is not schedule until early April. We respectfully ask that the the PPI cutoff be extended until 2 weeks after the site visit to allow offerors to submit potential questions from the site visit.

See amendment 0003.

28 95 01 00 00 The Liquidated Damages for the SEED Project P691 are listed as $173,364.89/calendar day.

This appears excessive when comparing the budget and NAVFAC's Naval Facilities Acquistion Standards Liquidated Damages table. Please confirm these are correct.

See amendment 0003.

29 64 00 72 00 00 72 00 General Conditions includes FAR 52.222-33 and 52.222-34 Alt II regarding Project Labor Agreement clauses incorporated by reference.

Please confirm if a Project Labor Agreement is required on the SEED or any future Task Order?

See amendment 0003.

30 The SEED project P691 drawings and specifications were provided by DoDSAFE and are marked as CUI. It does not appear there is a Construction Security Plan. Please confirm if there are any additional requirements required in order to disseminate this information to potential subcontractors?

Confirmed, there is no CSP nor additional security requirements beyond standard CUI protocol

31 Please confirm there is not Construction Security Plan for this project.

Confirmed, there is no CSP nor additional security requirements beyond standard CUI protocol

32 The SEED project P691 drawings and specifications are listed as CUI Category CUI/SP-CTI with Limited Dissemination Control FEDCON. Further, DFARS 252.204-7012, 7019, 7020 are included in the RFP.

This will require contractors to vet all subcontractors, track CUI NDA's and receive approval prior to being able to disseminate the information to them. As a result, offerors will need at least an additional 2 weeks to allow for potential vendors and small businesses to gain access and beginning reviewing of the RFP. Please extend the PPI cutoff and RFP bid due date 2 weeks.

See Amendment 0003.

33 Amend

SF1442 Box 13 Given the complexity of this project, please consider a 3 week extension to the Bid Due Date from April 15 to May 6, 2025
