52.212-2- EVALUATION—COMMERCIAL PRODUCTS AND COMMERCIAL SERVICES (NOV 2021)
(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:
The contract will be awarded based on a Best Value determination, with an emphasis on speed of service and adherence to schedule. Quotes will be evaluated based on the following criteria:
Technical Acceptability: Must meet all specifications and provide documentation demonstrating capabilities to provide 24ea Enerpac P/N RSM100.
Adherence to Schedule and Mobilization: The Government seeks the soonest possible mobilization and execution of the services. Vendors should provide their best and fastest schedule for completion of the work. Award may be made to the vendor who can provide the soonest execution.
Price: Price will be considered as part of the overall best value, but the award may not be based solely on the lowest price. In the event there are multiple vendors with satisfactory technical acceptability, identical mobilization time, and satisfactory past performance, price will be made to the lowest priced quote.
Past Performance: The Government will review the vendor’s past performance using CPARS/FAPIIS to assess their ability to meet contractual requirements based on previous contracts. Satisfactory past performance will be rated as SAT. Unsatisfactory past performance will be rated as UNSAT. Unknown past performance will be rated as SAT.
Vendors are required to submit a quote that will be evaluated in accordance with the specifications provided in the solicitation and FAR 52.212-1, Instructions to Offerors. Failure to include pricing for all line items shall result in rejection of the quote for all line items.
(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).
(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
(End of provision)
The Portsmouth Naval Shipyard intends to award this contract as a single award.
