About this file
This document is a Justification and Approval (J&A) form for a sole source acquisition by the Naval Medical Research Command (NMRC) in Silver Spring, MD. NMRC is seeking to purchase the Notocord-HEM software from Instem, a sole source provider, to enable communication with TSE Stellar Telemetry receiver implants. The software allows acquisition, analysis, and display of biosignals, supports data export and reporting, and is designed for use in GLP environments.
The acquisition is being pursued under the statutory exception of 10 U.S.C. 2304(c)(1) for sole source procurement, with an anticipated contract value under $150,000. NMRC currently owns a TSE-System Stellar Telemetry receiver but cannot operate it without this specific software license. The Contracting Officer has determined the anticipated cost will be fair and reasonable, and market research was conducted via internet, email, and phone, identifying Biopac Ackgnowledge and Notocord-hem as the only comparable software solutions. If another potential source emerges in the future, NMRC will assess the feasibility of competition.

Text2: The data was obtained from the Internet, by email, and by phone. Through research conducted on the Internet, two softwares were identified that interface with the TSE Stellar Telemetry receiver. The softwares identified softwares are Biopac Acqknowledge and Notocord-hem. Both of these softwares allow for recording from >16 TSE implants; however, only Notocord-hem offers support for use in GLP environments. This allows for electronic record keeping during data collection and post-process auditing.
Text3: The Contracting Officer shall determine th anticipated cost to the Government of the software covered by this Justification and Approval will be fair and reasonable by conducting a price analysis before an award is mage. In addition, the Government anticipated that the negotiated contract price will reflect a discount from the commercial price list and will be determined fair and reasonable.
Text4: NAMRU Dayton requests this purchase be solely sourced to Instem. The software is developed, manufactured and supplied directly by Instem without distributors in the United States (Instem Sole Source Justification Letter attached).
Text5: NAMRU Dayton currently owns a TSE-System Stellar Telemetery receiver; however, the receiver is inoperable as we do not have a software license that allows interfacing between a computer and the receiver. Failure to acquire a software license will result in the telemetry system remaining inoperable.
Text1: Supplies:
