About this file

This is a Justification and Approval (J&A) document from Pearl Harbor Naval Shipyard & Intermediate Maintenance Facility (PHNSY & IMF) justifying a sole source contract award to Northrop Grumman Marine Systems for maintenance, repair, and overhaul of Ship's Service Turbine Generator (SSTG) No. 1 and No. 2 aboard a Virginia Class submarine.

The J&A cites 10 U.S.C. 3204(a)(1) as authority for other than full and open competition, with an estimated value of $7,778,832.44 using FY-25 OM&N funds. Northrop Grumman is deemed the only capable source due to their proprietary processes, specialized tooling, OEM drawings, and proprietary software required for the work. Market research through three sources sought notices (N32253-24-R-0011, N32253-24-R-0009, and N32253-24-C-0002) posted between April 2023 and June 2024 yielded only one interested party, a British company that did not submit capability statements or register in SAM.gov. The J&A is approved by the Competition Advocate and includes certifications from technical, requirements, legal, and contracting personnel.

JUSTIFICATION AND APPROVAL

1. Contracting Activity.

The Naval Sea Systems Command, Pearl Harbor Naval Shipyard & Intermediate Maintenance Facility (PHNSY & IMF) Contracts Division, Code 400.

2. Description of the Action Being Approved.

Award a sole source contract for the maintenance, repair, and overhaul (SSTG) No. 1 and No. 2 to the Original Equipment Manufacturer (OEM), Northrop Grumman Marine Systems (NG), in support of a Virginia Class submarine.

3. Description of Supplies/Services.

a. The supply to be acquired is to provide maintenance, repair, and overhaul of the SSTG No.1 and No.2 aboard a Virginia-Class submarine.

b. Government IGE: $7,778,832.44

c. FY-25, OM&N

d. Period of performance: or until work is completed

4. Statutory Authority Permitting Other Than Full and Open Competition.

10 U.S.C. 3204(a)(1), Only one responsible source and no other supplies or services will satisfy agency requirements.

5. Rationale Justifying Use of Cited Statutory Authority.

Northrop Grumman has developed proprietary processes and possess specialized tooling, OEM proprietary drawings, and proprietary software to support the disassembly, inspection, and repair of turbine high pressure (THP) bearing assembly, THP Radial Rotor, Thrust Rotor, and inboard and outboard Thrust Stator Assemblies of the #1 & #2 Ship Service Turbine Generator (SSTG) aboard Virginia Class submarines. Northrop does not disclose their proprietary processes or specialized tooling with any other party including the Government.

However, the proprietary processes and specialized tooling Northrop Grumman possesses is necessary to complete the maintenance, repair, and overhaul with satisfactory results as verified by PHNSY Engineering & Planning Department (EPD). Therefore, Northrop Grumman, the OEM, is the only vendor that can satisfy the

Results of prior and current market research utilizing sources sought synopses are displayed on the table above demonstrating that only one interested party responded on previous solicitation N32253-24-R-0009 (contract is pending award). The interested party emailed the Contract Specialist (CS) asking for clarification on how to submit a capabilities statement on 12 March 2024. The CS responded to the email stating that capabilities statements may be submitted through email to the Points of Contacts (POC) listed in the SAM.gov posting on 12 March 2024. However, the interested party did not submit any capabilities statements to the POCs listed in the SAM.gov posting by the close date of the sources sought synopsis. The CS further looked into the interested party and found that it was a foreign based (Great Britain) company and was not registered in SAM.gov. In addition, a follow up email to the interested party was sent after the close of sources sought posting, but no response was received.

As this requirement is nearly identical to the previous historical requirements, the one interested party did not provide a capabilities statement on the prior solicitation, there were no interested parties on this current requirement, and prior market research is still relevant, the Government concludes that there is only one responsible source that can perform this requirement.

7. Determination of Fair and Reasonable Cost.

The Contracting Officer will ensure the anticipated cost to the Government for the supplies/service for this requirement covered by this J& will be based on price and cost analyses in accordance with FAR 15.404-1 Proposal Analysis techniques.

Similar quantities of this requirement have been purchased routinely from this vendor in the past, and pricing information was received on those past procurements. The information from historical contracts provide sufficient data to support a fair and reasonable determination for this procurement.

8. Actions to Remove Barriers to Future Competition.

For the reasons set forth above, PHNSY & IMF C410 has no plans at this time to compete future contracts for the types of supplies/services covered by this document. If another potential source emerges, PHNSY & IMF C400 will assess whether competition for future requirements is feasible.
