FOR

HAZARDOUS MATERIALS/ HAZARDOUS WASTE/RADIOACTIVE MATERIAL TRANSPORTATION

COMPLIANCE TRAINING

1.1 Background.

1.2 Training is required for Pearl Harbor Naval Shipyard and IMF (PHNSY&IMF) personnel responsible for ensuring shipments of radioactive material and radioactive waste are proper for transportation and disposal. This includes personnel from Code 2380.1 Mixed & Radioactive Waste Operations, Code 2380.4 Radioactive Material Shipping, Code 105.2 (Independent Reviewers), other Code 2300 divisions with engineers who prepare packaging procedures or audit the shipment process, and other organizations, as needed. This function specific training is more detailed and technical than the general awareness / familiarization training provided by Code 900T to the shops.

The required training is as follows:

a. U.S. Department of Transportation (DOT) initial / recurrent training, as required by Title 49 of the Code of Federal Regulations (CFR), specifically 49 CFR 172 Subpart H; and

b. International Air Transport Association (IATA) Dangerous Goods Regulations initial / recurrent training for the transportation of Dangerous Goods by air, as required by IATA Dangerous Goods Regulations paragraph 1.5;

2.1 Objective/Scope.

2.2 Contractor shall provide technical regulatory training to government employees (including employees directly responsible for technical requirements for packaging, classifying, and certifying radioactive material and radioactive waste as proper for transportation and disposal) in an instructor-led classroom environment on the island of Oahu at an appropriate Pearl Harbor Naval Base training facility, or suitable alternate location as determined by PHNSY&IMF. The class size shall be as stated in paragraph 2.3. Training shall be conducted during normal business hours of 0630 - 1500.

2.3 The number of students in each class shall be as communicated by the Technical Point of Contact (TPOC) to the Contractor at least 30 days before the start of each class. Each class shall be within the following minimum and maximum number of students by year.

2.4 Contract cost per student shall include all Contractor expenses related to bringing the training to PHNSY&IMF (e.g., Contractor/Instructor travel, lodging, car rental, shipping of training materials, meals, incidental expenses, etc.). Total cost to PHNSY&IMF for each class shall only be the contract cost per student multiplied by the number of students in the class.

3.1 Performance requirements. The contractor shall provide all management, labor, materials, supplies, and effective instruction, to include:

a. Arranging for delivery, receipt and storage of training materials at a location other than PHNSY&IMF;

b. Presenting the material in a clear and effective manner which encourages class participation;

c. Instructing interactively by posing relevant questions and performing practice problems with students to gage understanding;

d. Organizing material in logical sequence to aid student learning;

e. Listening to students’ questions or concerns and provide appropriate feedback; and

f. Providing certification of completion for each student to the TPOC no later than 10 business days after training completion or after Contractor receives payment for the class, whichever is later.

3.2 The Contractor will teach the following DOT class and IATA class with the accompanying learning objectives. The two classes may be taught consecutively, but are not required to be consecutive. The total number of training days for the two classes shall be a minimum of 7 business days each year for the duration of the contract.

The DOT class and IATA class shall each be a standalone class that thoroughly covers all the required material in each class. Even if a similar topic is covered in the first class (e.g., DOT), the second class (e.g., IATA) shall cover the topic again. Different students will be in each class, but there may be a few students taking both classes. All instruction shall be in a manner that assumes that all students are taking each class for the first time, but challenging enough to engage the experienced students also.

a. Basic Hazardous Material/Hazardous Waste/Radioactive Material DOT Training (minimum 32 hours, over a minimum of 4 days) – Contractor shall provide initial / recurrent regulatory training on all hazards and radioactive material as required by Code of Federal Regulations, Title 49 – Transportation, Part 172 Subpart H.

(i) Each day of class shall be held 0630 – 1500 with the number of students as specified in paragraph

2.3.

(ii) Current official publication of Code of Federal Regulations, Title 49 (containing Subchapter C –

Hazardous Materials Regulations) shall be provided to each student for use during class and shall be each student’s to keep after the class is finished.

(iii) Emphasis in instruction shall be Class 7 radioactive material. Chemical (non-radioactive) hazards will be covered to the extent that students will recognize when hazards other than radioactive material are encountered. Requirements for shipping mixed hazards shall also be covered, including shipments where Class 7 radioactive material is not the primary hazard.

(iv) Instructional time shall be approximately evenly divided between the transportation requirements for chemical (non-radioactive) hazards and radioactive material.

(v) The class will serve as both an initial training for students new to transportation regulations and a recurrent training for requalification of experienced personnel.

(vi) Each student shall be tested to demonstrate understanding of the current 49 CFR Hazardous Materials Regulations. Certification, which documents successful completion of training for each student, shall be provided to the TPOC.

b. IATA: Transport of Dangerous and Radioactive Goods by Air Shipper Certification Training (minimum

24 hours, over a minimum of 3 days) – Contractor shall provide initial / recurrent regulatory training on all hazards and radioactive material as required by IATA Dangerous Goods Regulations paragraph 1.5.

(i) Each day of class shall be held 0630 – 1500 with the number of students as specified in paragraph

2.3.

(ii) Current official publication of the IATA Dangerous Goods Regulations shall be provided to each student for use during class and shall be each student’s to keep after the class is finished.

(iii) Emphasis in instruction shall be Class 7 radioactive material. 3.3 Performance Period

3.3.1 For the first year, Contractor will coordinate the training schedule for 2022 with the TPOC upon contract award. For 2022, training shall be completed no later than April 30, 2022.

3.3.2 For option years after 2022, the training schedule will be coordinated between the Contractor and the TPOC by December 1st of the previous calendar year. For example, the Contractor and TPOC will coordinate the schedule and have the training date set by December 1, 2022 for training in calendar year 2023. To support PHNSY&IMF employee requalification dates, training shall be completed no later than April 30th of each option year after 2022.

3.3.3 In the case of unforeseen calamity or unavoidable circumstances (e.g., global pandemic, etc.), training may be rescheduled to a later date provided the Contractor and TPOC concur on the new date. As much as practicable, rescheduling of training dates shall be avoided.

4.1 Quality assurance.

4.2 Contractor is responsible for implementing all current DOT, IATA, Nuclear Regulatory Commission (NRC), and Environmental Protection Agency (EPA) regulations into all course lesson plans, as applicable.

4.3 Contractor or TPOC shall provide PHNSY&IMF course evaluation surveys to all attendees at the end of each class. The course evaluation survey shall address the quality of the instructional method and course content.

Completed surveys shall be submitted to the TPOC at the end of each class.

6.1.1 All classes will be held on Pearl Harbor Naval Base property, except as allowed in paragraph 6.1.3. TPOC will be responsible for classroom reservation.

6.1.2 The Contractor shall be fully capable of conducting the training without use of any computer equipment, whether owned by PHNSY&IMF or the Contractor. If a facility computer is available for use in the classroom or if the facility allows use of personal computers, the TPOC will inform the Contractor of those options prior to the start of the class; however, the Contractor shall not depend on having access to a computer to conduct the training.

6.1.3 If needed, a suitable alternate classroom location other than Pearl Harbor Naval Base may be used, as determined by PHNSY&IMF.

6.1.4 Classroom will have a white board available for use. The Contractor is prohibited from using any electronic devices (e.g. projector remotes, USB drives) connected to training facility computer unless facility approval is obtained through the TPOC.

7.1 Contractor qualifications.

7.2 Contractor/Instructor must have a thorough knowledge and understanding of the current DOT, IATA, NRC, and EPA regulations. Contractor/Instructor shall especially be fully knowledgeable and experienced in the transportation requirements for radioactive material.

7.3 Contractor/Instructor shall be experienced instructors and subject matter experts in the DOT, IATA, NRC, and EPA regulations taught.

7.3.1 Contractor/Instructor shall have a minimum 5 years of practical shipping experience (e.g., packaging, marking, labeling, and shipping paper preparation) with responsibility for ensuring compliance with transportation regulations. This minimum of 5 years practical experience may be met by direct supervision over personnel performing transportation preparations. A minimum of 10 years of auditing for compliance experience may be used to meet this requirement; however, at least 5 years must be in direct supervision over personnel performing transportation preparations.

7.3.2 In addition to practical shipping experience, the Contractor/Instructor must also have a minimum of 10 years of experience teaching the following classes to hazardous material compliance professionals:

a. DOT and IATA regulations for the transportation of radioactive material;

b. DOT and IATA regulations for the transportation of hazardous material other than radioactive material

(i.e., chemical hazards); and

c. Mixed waste classes, which navigates the requirements of DOT, NRC, and EPA. Although mixed waste classes are not addressed in this PWS, instruction in mixed waste demonstrates a deeper, more thorough understanding of the regulations regarding the complexity of mixed hazards.

7.3.3 The 10 years of radioactive material, chemical hazards, and mixed waste instruction experience may be concurrent.

7.4 In the submittal package, Contractor shall provide instructor resumes demonstrating experience as instructors and subject matter experts.

7.5 In the submittal package, Contractor shall provide a list of at least ten DOT, IATA, and/or Mixed Waste classes taught within the previous twelve months, starting with the most recent. This information shall be part of the submittal package and shall include the dates and locations of the training, plus a brief description of the class.

8.1 Contractor Personnel

8.2 The Contractor shall furnish experienced and knowledgeable personnel to perform all work specified.

Contractor is required to comply with Public Law 105-270, Section 5(2)(A). This law states that Contractors will not perform inherently governmental functions. Section 5(2)A) of this Public Law defines the term “inherently governmental function” as a “function that is so intimately related to the public interest as to require performance by Federal Government employees.” Per Section 5(2)(B), inherently governmental functions include management of Government programs requiring value judgments, conduct of foreign relations, selection of program priorities, and the direction of intelligence and counter-intelligence operations. Per Section 5(2)(C), inherent government functions DO NOT include, (i) gathering information for or providing advice, opinions, recommendations, or ideas to Federal Government officials; or (ii) any function that is primarily ministerial and internal in nature.”

8.3 Contractor personnel shall not establish an employee-employer relationship with Government personnel under this contract.

8.3.1 Contractors shall not provide personal services.

8.3.2 Contractor personnel will make clear to all individuals they engage with they are Contractor employees and not Government employees. When participating and introducing themselves during official events wherein Government, non-Government, or foreign personnel are present, Contractor personnel will identify themselves as employees of the Contractor.

8.3.3 Contractor personnel cannot manage, supervise, or task Government employees or military personnel while performing under this contract. Contractor personnel may not make any commitment to non-DoD personnel, including a foreign official, which commits the expenditure of U.S. Government resources, unless specifically authorized.

8.4 Contractor personnel must be clearly identified (i.e. company shirt, pin, visible company ID, etc.) in a visible location as to who their employer is.

8.5 Cell phones, any personal electronic devices with a camera feature, cameras of any type and all other electronic recording devices are not allowed within PHNSY&IMF. Training facilities in Pearl Harbor Naval Base, which are outside of PHNSY&IMF, may allow personal electronic devices. TPOC will inform Contractor of the training facility’s personal electronic device policies prior to the class. Contractor is expected to comply with the facility’s policies.

8.6 U.S. Citizenship is required for facility access. If training is to be held within a PHNSY&IMF facility, the Contractor shall submit, no later than three weeks prior to the start of each scheduled training session, a Contractor Visit Request to Pearl Harbor Naval Shipyard & IMF (VR) (PH-SYD IMF 55512/28) form requesting facility access in accordance with Appendix I - SECURITY REQUIREMENTS APPLICABLE FOR PEARL HARBOR NAVAL SHIPYARD & IMF’S CONTRACTED WORK OUTSIDE OF THE CONTROLLED INDUSTRIAL AREA (CIA).

8.7 Normal business hours of operation are 0630-1500, Monday through Friday, excluding Federal Holidays.

8.7.1 If a holiday falls on a Saturday, the holiday is observed on the preceding Friday. If a holiday falls on a Sunday, the holiday is observed on the following Monday.

10.2 The contractor/instructor shall pass a background check to gain access onto the base. The contractor will coordinate with PHNSY&IMF to obtain a gate pass at Building 3455 Pass Office. It is not unusual for the pass process to take an hour or more. Contractor/instructor must be a U.S. Citizen and must pass a security background check. Only those individuals with favorable investigations shall be utilized on this contract. Prior to the start of work, the Contractor shall provide the TPOC (on company letterhead) a request for access and include the following information – full name of all personnel working on this contract; Social Security number; date of birth, place of birth, and citizenship. The contractor shall state that information has been verified and shall have supporting records on file, if required for examination. Contractor’s employees must be a U.S. Citizen and registered with the Defense Biometric Identification System. Documents that are acceptable as proof of U.S Citizenship are listed in Attachment 1 to Appendix I.

10.3 Contractor personnel must meet the requirements for unescorted entry, “WHITE” badge, to PHNSY&IMF areas. If class is held in a building other than PHNSY&IMF Building 2, access will be required accordingly.

Escorted access to CNIAs and NWAs must be coordinated with the cognizant Department Security Coordinator to ensure that the area is sanitized and the escort is properly briefed/knowledgeable of the area.

APPENDIX I

SECURITY REQUIREMENTS APPLICABLE FOR PEARL HARBOR NAVAL SHIPYARD & IMF’S

CONTRACTED WORK OUTSIDE OF THE CONTROLLED INDUSTRIAL AREA (CIA)

(REVISED MAR 2015)

1. The provisions of these security requirements are applicable to all Shipyard & IMF areas outside of the Controlled Industrial Areas (CIAs), excluding Dry Dock 4. Security for Dry Dock 4 is addressed in separate documents.

2. Performance of all work under this contract is restricted to U.S. citizens and U.S. nationals only. U.S.

citizen employees of a foreign owned, controlled, and/or influenced (FOCI) company are considered foreign nationals and special authorization would be required for escorted access to PHNSY & IMF spaces.

3. Security requirements are applicable to the prime contractor as well as to all subcontractors and suppliers thereunder.

4. The period of proposed contract work to be performed in particular areas of the Shipyard & IMF is subject to further approval of the Shipyard & IMF Commander depending on the sensitivity of Shipyard & IMF industrial operations in the affected areas.

5. For frequent access to Shipyard & IMF spaces, Security Access Control Badges are required. Three weeks prior to entry into the Shipyard & IMF spaces outside of the CIA, officials from the contractor, subcontractors, and suppliers shall complete all applicable items on the Part 1 of the Contractor Visit Request to Pearl Harbor Naval Shipyard & IMF (VR) (PH-SYD IMF 55512/28) form and submit it to the Government Contracting Agency (GCA) or designated Contracting Officer’s Representative (COR) for completion of Part 2. The GCA/COR will then forward the VR to the Shipyard & IMF Sponsor for completion of Part 3 no later than two weeks prior to the visit.

The Shipyard & IMF Sponsor will submit the VR to the Shipyard & IMF Pass and Identification Office (Pass and ID) no later than one week prior to entry into the Shipyard. The VR must include country of citizenship. Entry into Shipyard & IMF spaces for US citizen personnel from companies without FOCI (see paragraph 2) may be authorized by the Security Officer (Code 1120).

a. For access to the Shipyard & IMF Local Area Network (LAN) verification of U.S. citizenship, need-to-know and at least a Green badge are required.

b. The initial submittal of VR forms need not be all-inclusive. It may be expanded to meet essential requirements of the contractor. Each individual added to the list, however shall be subject to the same pre-entry screening requirements as outlined above.

c. Under no circumstances shall personnel sign, hand carry, mail or email their own VR. The VR should be sent by encrypted email, mailed through the US Postal Service, or delivered by the GCA/COR or Shipyard & IMF Sponsor.

d. Ensure that all contractor employees provide a valid photo identification card and proof of U.S.

citizenship to the Pass and ID Office prior to being issued a Shipyard & IMF badge, see page 6 for a list of acceptable documents.

e. Ensure any derogatory of questionable information concerning contractor employees possessing a DOD security clearance or a Shipyard & IMF badge is immediately reported to the Security Office (Code 1125) so that access eligibility can be evaluated.

f. Ensure that contractor employees attend a 30-minute orientation on the safety, security, and radiological protection aspects of industrial operations within the Shipyard & IMF.

NOTE: The briefing, which is in the form of a video presentation, will be given at the Pass and ID Office in groups of 10, prior to the issuance of Shipyard & IMF badges. Special arrangements for larger groups can be scheduled upon request.

g. Ensure that all employees wear and display the Shipyard & IMF badge in the chest area at all times while entering, remaining in, and exiting Shipyard & IMF spaces.

h. Ensure that each badge is used only by the specific individual named on the badge.

i. Maintain strict accountability over identification badges and passes issued by the Pass and ID Office. Report immediately, to the Pass and ID Office, any badges/passes that are missing or lost and the circumstances. Return badges/passes to the GCA immediately upon termination of any employee, upon expiration, upon completion of contract, or when no longer required. The GCA will ensure that all badges/passes are returned and forwarded to the Shipyard & IMF Pass and ID Office (Code 1125.2).

j. The Pass and ID Office is located in Building 207 at Safeguard Street and Russell Avenue

6. Restrict hours of work to 0630 – 1500 hours Monday through Friday only. When operational needs require the contractor to schedule work before 0630 and/or after 1500 (Monday through Friday) or on weekends and holidays, provide written notification at least two weeks in advance to GCA who will obtain approval from the respective Shipyard & IMF departments, offices, and shops. Such notifications will include specific dates, hours of work, location of work, type of work to be performed, contract number and project title. The GCA will provide a copy of the notification to the Security Officer (Code 1124) along with written notification that work, as scheduled, has been approved by the respective department, office or shop concerned. Vehicle and pedestrian entry at Dry Dock #4 is on Cushing Street.

7. Restrict employees/representatives to the work site and control travel directly to and from the work site.

8. All vehicles are required to conform to JBPHH and Shipyard & IMF traffic regulations. The speed limit is as posted or marked.

9. Parking is not permitted on any piers on any dry dock/waterfront areas. Contractors shall not park on or block the marked fire lanes at any time. Vehicles may stop on the piers of dry dock/waterfront areas for 15 minutes for loading or unloading. An exception may be made for vehicles which are part of the equipment needed to do the required work and are attached or connected to the pier or ship, i.e., a truck which uses a mounted generator, a vehicle with built-in equipment, etc. A written request for pier parking authorization with justification will be sent to the Shipyard & IMF Security Officer (Code 1120) via the GCA at least two weeks prior to the date parking space is required. The following information is required:

a. The license number of the vehicle(s)

b. The type and size of the vehicle(s) (pickup truck, crane, forklift, etc.)

c. Parking location

d. Purpose and duration

10. Parking for privately-owned vehicles is available:

a. In the “A” and “D” parking lots on Paul Hamilton Avenue, located between South Avenue and Safeguard Street.

b. In the “C” parking lot on Lake Erie Street and Central Avenue.

11. All vehicles are subject to search while entering, remaining in, or leaving the Shipyard & IMF and/or JBPHH areas. A Property Pass (OP-7) issued and signed by the GCA must cover all government material being transported out of the CIA by contractors. Material found without a Property Pass will be confiscated and a police offense report issued.

12. Entry into shop/office/ship spaces covered by this contract will be subject to prior approval of the respective Shop Superintendent/Office Head/Ship’s Commanding Officer. Contractors will coordinate action with the GCA for obtaining entry approval.

13. The Shipyard & IMF Security Officer will provide guard services on a reimbursable basis for contractors requiring guard services. The contractor must notify and obtain approval from the Shipyard & IMF Security Office via the GCA at least 48 hours prior to the time guard services will be required. Notification in writing shall include the purpose and number of hours guard services will be required.

14. Contractor personnel will not be permitted to enter Shipyard & IMF buildings, spaces, and are as not covered by this contract except on prior approval of the Shipyard & IMF department/office/shop having jurisdiction of the areas. Contractors will coordinate action with the GCA to obtain such entry approval.

15. Access to unclassified and classified U.S. Navy shipbuilding, conversion, or repair technology and related technical information manuals, documents, drawings, plans, specifications, etc., by the contractor shall be restricted to an official need-to-know basis. This type of information shall be handled, controlled, and safeguarded to prevent oral, visual, and documentary disclosure to uncleared personnel, the public, to foreign sources, and to all personnel not having an official need-to-know. It shall be returned to the Pearl Harbor Naval Shipyard & IMF upon completion of contracted work, except when the GCA grants specific retention authorization.

16. Photography and photographic equipment are prohibited in the Pearl Harbor Naval Shipyard & IMF, to include personal cellular phones with camera features. When operationally required, a written request containing specific justification and details will be submitted to the Security Office (Code 1125) via the GCA for consideration. If a Shipyard & IMF photographer is unable to take the photographs, authorization will only to be granted to the contractor if he has a Shipyard & IMF Sponsor and is under continuous escort of a designated Shipyard & IMF employee. The designated escort shall be briefed by Code 1125. The escort will take the film or photographic media in his or her custody. The Sponsoring Shipyard Code/Office will mark and control the photographs as “For Official Use Only” and route the photographs in accordance with local regulations for review and approval of a Distribution Statement (prior to release from Shipyard & IMF).

17. Ensure that yellow plastic material is not used for warning signs, covering material, etc.

18. Be responsible for control and security of all contractor-owned equipment and material at the work site. Report immediately, all missing/lost/stolen property to the Joint Base Pearl Harbor Hickam Security Detachment (phone 474-6751) as each case occurs.

19. Portable Electronic Devices (PEDs). PEDs include pagers, mobile/cellular telephones (with/without cameras), personal digital assistants/job performance aids, laptop/notebook/ handheld computers, digital imagery (still/video) devices, analog/digital sound recorders (e.g. I-PODs), video game devices, USB devices, and devices of similar capability, functionality, or design.

Privately-Owned PED devices such as those listed above are prohibited on Shipyard premises. Privately-Owned PEDs without camera devices are prohibited on Shipyard premises unless approved in writing by the local Information Assurance Authority (IAA) or Information Assurance Manager (IAM). Violations may result in the confiscation and sanitization of the PEDs. The only approved method of sanitizing most PEDs is physical destruction.

a. All users utilizing PEDs in the Shipyard & IMF workspaces, whether privately-owned (includes contractor-owned) or government-owned, are required to comply with NAVSHIPYD&IMFPEARLINST 5239.1(series), Activity Information Systems Security Plan (AISSP)

b. For privately-owned PEDs without camera devices approved for use in Shipyard & IMF spaces, the user shall follow:

(1) The PEDs will not handle, process, or store any U.S. Government information unless otherwise authorized by the IAM.

(2) The PEDs will not be connected to any Shipyard & IMF network, U.S. Government-Owned computers, or associated peripherals.

(3) The PEDs will operate in only approved locations. These PEDs are not allowed in spaces processing and/or handling classified information.

(4) Users shall comply with software copyright laws and agreements.

(5) Violations of the above may result in the confiscation of the PED.

(6) The U.S. Government will not be liable for the privately-owned PED hardware/software while on the Shipyard & IMF premises.

c. For U.S. Government-Owned PEDs approved for use in Shipyard & IMF spaces and issued for official government travel, the user shall follow:

(1) Government-Owned PEDs that are synchronized with desktop computers on Shipyard & IMF Local Area Network (LAN) shall follow the security measures in Enclosure (2) of NAVSHIPYD&IMFPEARLINST 5239.1(series).

(2) Use of Government-Owned PED equipment while on travel and performing official government business is allowed.

(3) Government-Owned PEDs shall not be checked as baggage, stored in airport or bus station lockers, or left with desk clerks at motels. PEDs with NNPI data shall not be left unattended in the motel room. If a PED with no NNPI data is left unattended in the motel room, it must be locked in a personally owned container (i.e., luggage, brief case, etc.).

(4) Government-Owned PEDs shall not be taken out of the United States without an authorization letter from the IAM.

(5) Government-Owned PEDs will not be used to store passwords; safe and door combinations; personal identification numbers (PINs); as well as classified information.

(6) Government-Owned PEDs shall not be used for classified information processing unless specifically authorized in writing by the local IAA.

(7) Where feasible, Government-Owned PEDs shall employ up-to-date signature files that are used to profile and identify viruses, worms, and malicious code. As proven anti-virus clients for PEDs become available, these clients shall be deployed to the greatest possible extent in all PEDs that connect to the Shipyard & IMF LAN.

20. Ensure that no material is stacked within ten (10) feet of the CIA or Dry Dock #4 perimeter. Remove from the work site, or secure, ladders or other such equipment, which could be used to climb the CIA or Dry Dock #4 perimeter fence. Ensure that no vehicles are parked within ten (10) feet of the CIA or Dry Dock #4 perimeter.

21. Provide written notification to the Commander, Pearl Harbor Naval Shipyard & IMF (Code 1120) via the GCA, two (2) weeks prior to actual start of work to allow for notification of the appropriate Shipyard & IMF departments, offices, and shops of the impact resulting from the contract work. Such notifications will include specific details such as work schedules (including actual start date for Shipyard & IMF entry), and impact statements concerning tasks to be done, e.g. specific parking spaces to be vacated, inclusive dates involved, traffic rerouting, changes to traffic and parking patterns, traffic/parking controls to be instituted by the Contractor, barricades to be erected by the contractor, etc., along with sketches of the particular areas involved.

22. Any exceptions to these security requirements must be coordinated with the Security Office (Code 1120).

52.204-24 REPRESENTATION REGARDING CERTAIN TELECOMMUNICATIONS AND VIDEO

SURVEILLANCE SERVICES OR EQUIPMENT (OCT 2020)

The Offeror shall not complete the representation at paragraph (d)(1) of this provision if the Offeror has represented that it "does not provide covered telecommunications equipment or services as a part of its offered products or services to the Government in the performance of any contract, subcontract, or other contractual instrument" in paragraph (c)(1) in the provision at 52.204-26, Covered Telecommunications Equipment or Services-- Representation, or in paragraph (v)(2)(i) of the provision at 52.212-3, Offeror Representations and Certifications- Commercial Items. The Offeror shall not complete the representation in paragraph (d)(2) of this provision if the Offeror has represented that it "does not use covered telecommunications equipment or services, or any equipment, system, or service that uses covered telecommunications equipment or services" in paragraph (c)(2) of the provision at 52.204-26, or in paragraph (v)(2)(ii) of the provision at 52.212-3.

(a) Definitions. As used in this provision-

Backhaul, covered telecommunications equipment or services, critical technology, interconnection arrangements, reasonable inquiry, roaming, and substantial or essential component have the meanings provided in the clause 52.204-25, Prohibition on Contracting for Certain Telecommunications and Video Surveillance Services or Equipment.

(b) Prohibition.

(1) Section 889(a)(1)(A) of the John S. McCain National Defense Authorization Act for Fiscal Year 2019 (Pub. L.

115-232) prohibits the head of an executive agency on or after August 13, 2019, from procuring or obtaining, or extending or renewing a contract to procure or obtain, any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system. Nothing in the prohibition shall be construed to--

(i) Prohibit the head of an executive agency from procuring with an entity to provide a service that connects to the facilities of a third-party, such as backhaul, roaming, or interconnection arrangements; or

(ii) Cover telecommunications equipment that cannot route or redirect user data traffic or cannot permit visibility into any user data or packets that such equipment transmits or otherwise handles.

(2) Section 889(a)(1)(B) of the John S. McCain National Defense Authorization Act for Fiscal Year 2019 (Pub. L.

115-232) prohibits the head of an executive agency on or after August 13, 2020, from entering into a contract or extending or renewing a contract with an entity that uses any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system. This prohibition applies to the use of covered telecommunications equipment or services, regardless of whether that use is in performance of work under a Federal contract. Nothing in the prohibition shall be construed to--

(i) Prohibit the head of an executive agency from procuring with an entity to provide a service that connects to the facilities of a third-party, such as backhaul, roaming, or interconnection arrangements; or

(ii) Cover telecommunications equipment that cannot route or redirect user data traffic or cannot permit visibility into any user data or packets that such equipment transmits or otherwise handles.

(c) Procedures. The Offeror shall review the list of excluded parties in the System for Award Management (SAM) (https://www.sam.gov) for entities excluded from receiving federal awards for "covered telecommunications equipment or services."

(d) Representations. The Offeror represents that--

(1) It [] will, [] will not provide covered telecommunications equipment or services to the Government in the performance of any contract, subcontract or other contractual instrument resulting from this solicitation. The Offeror shall provide the additional disclosure information required at paragraph (e)(1) of this section if the Offeror responds "will" in paragraph (d)(1) of this section; and

(2) After conducting a reasonable inquiry, for purposes of this representation, the Offeror represents that--

(i) For covered equipment--

(A) The entity that produced the covered telecommunications equipment (include entity name, unique entity identifier, CAGE code, and whether the entity was the original equipment manufacturer (OEM) or a distributor, if known);

(B) A description of all covered telecommunications equipment offered (include brand; model number, such as OEM number, manufacturer part number, or wholesaler number; and item description, as applicable); and

(C) Explanation of the proposed use of covered telecommunications equipment and any factors relevant to determining if such use would be permissible under the prohibition in paragraph (b)(1) of this…
