The Government�s minimum needs have been verified by the certifying technical and requirements personnel.

4. Statutory Authority Permitting Other Than Full and Open Competition

10 U.S.C. 2304(c)(1), Only One Responsible Source and no other type of property or services will satisfy the needs of the agency.

5. Rationale Justifying Use of Cited Statutory Authority

Curtiss-Wright EMD is the Original Equipment Manufacturer (OEM) for the Rotational Deployment Mechanism (RDM). The drawings provided by the OEM are proprietary and marked, �Limited Rights and the EMD have not authorized the use of those drawings by any third party.� Curtiss-Wright EMD has proprietary ownership of drawings that are required for the RDM refurbishment and no other contractor is capable of providing the refurbishment services to the RDM to meet the government�s requirement.

6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable

A search of mandatory sources and the Interagency Contract Directory yielded no relevant results.

As noted in paragraph 5, Curtiss-Wright is the only identified source that is capable of fulfilling the requirements because they are the Original Equipment Manufacturer (OEM) that holds limited rights to proprietary drawings in conjunction with the RDM.

A Sources Sought was posted on 12/22/2021 with a close date of 01/05/2021 at 3:00 p.m. HST. The Sources Sought posting was used to verify if there were any sources capable of fulfilling this requirement. No responses were received in conjunction to the Sources Sought posting.

7. Determination of Fair and Reasonable Costs

The Contracting Officer has determined that the anticipated cost to the Government for the supplies/services covered by the J&A will be fair and reasonable. The Contracting Officer

will use contract N32253-20-C-0005 as historical reference for the price reasonableness determination.

8. Actions to Remove Barriers to Competition

Actions to remove future competition should be reviewed at the time the vessels are built. For example, whether component(s) being installed shipboard will remain property to the OEM. For this reason and the reasons set forth in Paragraph 5, PHNSY & IMIF has no plans at this time to compete future contract for the types of supply/services covered by this document. If another potential source emerge, PHNSY & IMF will assess whether competition for future requirements is feasible.
