PERFORMANCE WORK STATEMENT PEARL HARBOR NAVAL SHIPYARD (PHNSY & IMF)

CONTRACTOR SUPPORT SERVICES FOR PERSONNEL ASSISTANCE SERVICES (PAS)

1.0 BACKGROUND

1.1 This Performance Work Statement (PWS) describes tasks to be performed by awardee in support of PHNSY & IMF to obligate Department of the Navy's (DON) policy to provide PERSONAL ASSISTANCE SERVICES (PAS) to its employees because of their targeted disability, in accordance with 29 Code of Federal Regulations § 1614.203(d)(5).

2.0 OBJECTIVE/SCOPE

2.1 OVERALL OBJECTIVE: The awardee, hereafter referred to as the Contractor shall provide for (1) one base year and (4) four option years, PERSONAL ASSISTANCE SERVICES (PAS) and PERSONAL ASSISTANT (PA) services to assist with performing activities of daily living that an individual would typically perform if he or she did not have a disability. Tasks may include assistance with personal care such as eating and using the restroom, assisting with physical tasks and unclassified cognitive tasks such as facilitation communication access with a reader.

3.0 PERFORMANCE REQUIREMENTS

3.1 The Contractor will perform a variety of personal assistance services (PAS) for the EMPLOYEE WITH DISABILITIES (EWD) whose conditions can vary widely from those requiring daily assistance to those requiring help with on an as-needed basis. The Contractor is subject to work in rotating and intermittent shifts, and may function in a variety of work settings on short notice. This contract does not require access to classified information, however, contractor personnel may require access to Controlled Unclassified Information (CUI), Distribution Statements, Personally Identifiable Information (PII)) and Unclassified Naval Nuclear Propulsion Information (U-NNPI).

3.2 Workplace personal assistance may involve unclassified activities such as:

Taking on/off one’s coat.

Help with toileting and hygiene.

Assistance with meal preparation.

Assistance with feeding or eating.

Retrieving materials out of reach.

Assistance walking and sitting (including transitioning and the use of walkers or wheelchairs).

Providing travel/transportation assistance for an employee with a mobility impairment.

Helping an employee with a cognitive disability in decision-making.

Provide on-site support to EWD in order to help them adjust to the workplace and the routine of getting to and from work.

Safe guidance or reading printed materials to an employee who is visually impaired.

Ensuring a sign language interpreter is present during unclassified meetings for an employee who is deaf.

Note taking during meetings or training.

Required duties are not limited to those listed. Other duties with regards to proper PAS for EWD may be required and will be discussed with the COR “as needed” to ensure the duties do not exceed the level of information authorized by this contract.

3.3 Contractor will be required to perform a variety of unclassified administrative support duties:

Receiving calls or emails to schedule and reschedule appointments.

Complete arrangements for requested personal assistance services or other office support requests.

Respond to routine non-technical requests for information such as status of requests reports.

Suspense dates for matters requiring compliance, and similar information readily available from files.

Arrange for meetings, including reserving the location, notifying participants, and providing copies of handouts.

Assemble requested material and information for scheduled meetings.

Make travel arrangements.

Compose complex, but non-technical, correspondence.

Locate and assemble information for various reports and briefings.

Follow up with applicable contacts to ensure that various commitments made at meetings or through correspondence are met.

Perform other unclassified administrative related duties as assigned.

3.4 The contractor shall provide and is responsible for all labor, management, supervision, coordination, quality control, quality assurance, quality management, safety management, material, equipment, and transportation necessary to perform the requirements. The contractor shall ensure adequate resources are dedicated to comply with the standards, guidelines and procedures as stated to satisfy the requirements in this contract.

3.5 The contractor shall maintain the personnel, organization, and administrative control necessary to ensure that the work delivered meets the specification requirements in section 3.0. The work history of each contractor employee must contain experience directly related to the task and the functions he/she is intended to perform.

3.6 Other primary unclassified duties may arise and will be discussed with the Contracting Officer’s

Representative (COR) on an “as needed” basis.

4.0 TRAVEL

4.1 Contractor may be required when necessary, to accompany the employee in official travel in order to facilitate performance of his/her job. Travel-related duties may include duties as described in this PWS and:

Dressing and grooming.

Preparing meals.

Transferring to and from bed.

Facilitating the logistical needs of the employee(s).

Unclassified reading and note-taking.

Other primary unclassified duties may arise and will be discussed with the COR on an

“as needed” basis.

4.2 Travel shall be in accordance with the Federal Acquisition Regulation (FAR) 31.205-46 and current DoD Joint Travel Regulations (JTR).

4.3 The Contractor’s work shall be governed by the completeness and quality of the work performed as stated in this PWS.

5.0 CONTRACTOR QUALIFICATION/REQUIREMENTS

5.1 Contractor will be required to have knowledge/experience in:

Knowledge of personal care functions and procedures to provide timely, safe and appropriate personal assistance services for a wide variety of workplace situations

Knowledge of the duties, policies, commitments and priorities of the supervisor to review requests for personal assistance services and determine which requests should be brought to the attention of the supervisor and which should be sent directly to other appropriate personnel for action.

Knowledge of the organizational functions and procedures of the work unit to perform such duties as refer phone calls and visitors and provide general, non-technical information.

Knowledge of the office procedures, filing system and various unclassified references and handbooks commonly used by the staff in order to search for and properly dispose of unclassified materials.

Knowledge of the duties of the staff and the programs of the office to perform non-routine assignments such as locating and summarizing information from unclassified files and documents. This requires recognizing which information is or is not relevant to the problem at hand. The Supervisor shall review summarized documents to ensure that the level has not been raised to classified based on compilation Classification by compilation will be referred to a cognizant PHNSY & IMF Authorized Derivative Classifier and then the NNPI Control Officer (Code 1121) in accordance with NAVSHIPYD&IMFPEARLINST 5510.78 (series).

Knowledge of one or more types of software (word processing, spreadsheets, databases, etc.) to accomplish tasks.

Skill in using Microsoft Office Suite.

Skill in written and oral communication to elicit organizational and individual needs to effectively provide personal assistance services.

Skill in applying supported employment practices by assisting individuals with disabilities to accurately carry out job duties.

Skill in compiling and evaluating data from various sources to provide the appropriate personal assistance services and provide reports or briefings on the services provided.

5.2 Physical Requirements:

Must be able to physically perform the basic life operational functions of talking, hearing, standing, reaching, pushing, pulling, lifting and repetitive motions.

Must be able to perform medium work and exert up to 50 pounds of force occasionally, and/or 20 pounds of force constantly to move objects.

Must possess the visual acuity to determine the accuracy, neatness and thoroughness of work assigned, and to complete records and reports.

5.3 Special Requirements:

When applicable the PA shall have the necessary licensing and certifications to perform such skilled personal care needs such as catheter care, bowel programs, tube replacement, etc.

Possession of a valid driver's license.

5.4 The Contractor and its representatives shall be trained in and comply with all Federal, State, Territorial and local environmental laws and regulations. In the event that the work is found non-compliant to all stated environmental laws and regulations, the contractor shall indemnify the U.S.

government from any liability.

5.5 Contractor shall comply with Appendix I and Appendix II.

5.6 Contractor is required to comply with Public Law 105-270, Section 5 (2) (A). This law states that contractors will not perform inherently governmental functions. Section 5(2)(A) of this Public Law defines the term “inherently governmental function” as “a function that is so intimately related to the public interest as to require performance by Federal Government employees.” Per Section 5(2) (B), inherently governmental functions include management of Government programs requiring value judgments, conduct of foreign relations, selection of program priorities, and the direction of intelligence and counter-intelligence operations. Per Section 5(2) (C), inherent governmental functions DO NOT include, (i) gathering information for or providing advice, opinions, recommendations, or ideas to Federal Government officials or (ii) any function that is primarily ministerial and internal in nature.”

The Contractor shall have experience with Department of Defense (DoD) directives, regulations, policies and procedures.

6.0 Security Requirements: This contract does not require a DoD Facility Clearance or contractor personnel to have DoD personnel clearances and security access however, contractor personnel shall recognize that PHNSY & IMF deals with sensitive information and other proprietary information, which are valuable, special and unique assets. Contractor personnel shall not divulge, disclose or communicate in any manner, any information to a third party without prior written consent. Access is required to CUI and U-NNPI in performance of this contract to support EWD employees who require access to such information. CUI and U-NNPI will be protected in accordance with DoDI 5200.48 and OPNAVINST N9210.3 (respectively). This contract does not allow contractor personnel to remove CUI, U-NNPI or any controlled PHNSY & IMF information from PHNSY & IMF spaces. Contractor personnel shall be eligible for access to work areas located in the CIA and must obtain Green Shipyard Access Control Badges. Contractor personnel shall protect PHNSY & IMF information and abide by the security requirements of SECNAVINST 5510.36B. Contractor personnel will also comply with the security requirements in Appendix 3 and Appendix 4. A violation of this paragraph shall be a material violation of this agreement.

In accordance with current Department of Defense and Homeland Security requirements, performance of all work under this contract is restricted to U.S. citizens and U.S. nationals only.

Should contractor personnel receive or suspect they have learned of classified information or controlled information beyond their need to know, the Contractor shall immediately report suspicions to the COR.

6.1 Photography is strictly prohibited within PHNSY & IMF: Data phones, phones with a camera feature and cameras of any type are not allowed within PHNSY & IMF, see Appendix 3.

6.2 Common Access Card (CAC); Contractor will be required to obtain a CAC for this contract:

Background vetting will be required for all contractor personnel and must meet at a minimum, one of the following criteria:

The completion of an FBI fingerprint checks with favorable results.

A valid National Agency Check with Inquiries (NACI) A DoD determined NACI equivalent investigation.

The above information must be submitted in Defense Information Security System

(DISS) prior to issuance of a CAC. Contractor personnel are required to maintain strict accountability of all Government issued badge(s) and immediately report any badges that are missing or lost and the circumstances to the COR. All government provided badges/cards are to be returned to the COR immediately upon termination, expiration, completion of work, or when no longer required.

7.0 RESPONSIBILITIES

7.1 The Contractor shall furnish sufficient qualified personnel to perform all work specified within this contract at all times.

The contractor shall maintain the personnel, organization, and administrative control necessary to ensure that the work delivered meets the specification requirements in section

3.0. The work history of each contractor employee must contain experience directly related to the task and the functions he/she is intended to perform.

The frequency of informational meetings will be scheduled as determine necessary by the COR or government representative.

7.3 Each contractor employee shall clearly identify themselves as contractor employees by means of company shirt, pin, or other visible company identification means in a manner that is visible at all times.

7.4 The Contractor performing services shall be required to comply with all Pearl Harbor Naval

Shipyard & IMF rules, regulations, and training that is applicable to conduct, safety, security, and procedures governing site entry and exit.

7.5 If applicable, ensure that the on-site PAS representative is in compliance with the following safety guidelines:

Safety glasses with side shields shall be worn when personnel are conducting eye hazardous operations and when in an eye hazardous area.

Hardhats, safety glasses and safety shoes shall be worn at all times from the outer crane rail and/or entry into the fenced area and while on board ship in accordance with PHNS & IMF PPE policy.

Shall ensure its employees understand the fire safety requirements and actions to be taken when fire or an emergency occurs during work onboard the ship. Contractor shall ensure that all personnel are briefed on the Shipyard Fire Safety Plan and muster locations.

Eating, smoking or drinking is prohibited except for designated areas identified by the ship.

8.0 HOURS OF OPERATION:

8.1 Working Hours: Regular working hours shall consist of an 8-hour period, 40 hours a week, between 6:30 AM - 3:00 PM, 2nd shift 2:30 PM - 11:00 PM, or 3rd shift 10:30 PM - 7:00 AM Monday through Friday, excluding Federal holidays.

FEDERAL HOLIDAYS:

All federal holidays shall be observed.

If the federal holiday falls on a Saturday, the holiday is observed on the preceding Friday. If the federal holiday falls on a Sunday, the holiday is observed on the following Monday.

Performance of this contract will be on first shift.

All shift change requests have to be authorized and approved by the COR/KO.

Work will not be performed during the Holiday Curtailment period.

52.204-24 REPRESENTATION REGARDING CERTAIN TELECOMMUNICATIONS AND VIDEO

SURVEILLANCE SERVICES OR EQUIPMENT (NOV 2021)

The Offeror shall not complete the representation at paragraph (d)(1) of this provision if the Offeror has represented that it "does not provide covered telecommunications equipment or services as a part of its offered products or services to the Government in the performance of any contract, subcontract, or other contractual instrument" in paragraph (c)(1) in the provision at 52.204-26, Covered Telecommunications Equipment or Services-- Representation, or in paragraph (v)(2)(i) of the provision at 52.212-3, Offeror Representations and Certifications- Commercial Products and Commercial Services. The Offeror shall not complete the representation in paragraph (d)(2) of this provision if the Offeror has represented that it "does not use covered telecommunications equipment or services, or any equipment, system, or service that uses covered telecommunications equipment or services" in paragraph (c)(2) of the provision at 52.204-26, or in paragraph (v)(2)(ii) of the provision at 52.212-3.

(a) Definitions. As used in this provision-

Backhaul, covered telecommunications equipment or services, critical technology, interconnection arrangements, reasonable inquiry, roaming, and substantial or essential component have the meanings provided in the clause 52.204-25, Prohibition on Contracting for Certain Telecommunications and Video Surveillance Services or Equipment.

(b) Prohibition.

(1) Section 889(a)(1)(A) of the John S. McCain National Defense Authorization Act for Fiscal Year 2019 (Pub. L.

115-232) prohibits the head of an executive agency on or after August 13, 2019, from procuring or obtaining, or extending or renewing a contract to procure or obtain, any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system. Nothing in the prohibition shall be construed to--

(i) Prohibit the head of an executive agency from procuring with an entity to provide a service that connects to the facilities of a third-party, such as backhaul, roaming, or interconnection arrangements; or

(ii) Cover telecommunications equipment that cannot route or redirect user data traffic or cannot permit visibility into any user data or packets that such equipment transmits or otherwise handles.

(2) Section 889(a)(1)(B) of the John S. McCain National Defense Authorization Act for Fiscal Year 2019 (Pub. L.

115-232) prohibits the head of an executive agency on or after August 13, 2020, from entering into a contract or extending or renewing a contract with an entity that uses any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system. This prohibition applies to the use of covered telecommunications equipment or services, regardless of whether that use is in performance of work under a Federal contract. Nothing in the prohibition shall be construed to--

(i) Prohibit the head of an executive agency from procuring with an entity to provide a service that connects to the facilities of a third-party, such as backhaul, roaming, or interconnection arrangements; or

(ii) Cover telecommunications equipment that cannot route or redirect user data traffic or cannot permit visibility into any user data or packets that such equipment transmits or otherwise handles.

(c) Procedures. The Offeror shall review the list of excluded parties in the System for Award Management (SAM) (https://www.sam.gov) for entities excluded from receiving federal awards for "covered telecommunications equipment or services."

(d) Representations. The Offeror represents that--

(A) The entity that produced the covered telecommunications equipment (include entity name, unique entity identifier, CAGE code, and whether the entity was the original equipment manufacturer (OEM) or a distributor, if known);

(B) A description of all covered telecommunications equipment offered (include brand; model number, such as OEM number, manufacturer part number, or wholesaler number; and item description, as applicable); and

(C) Explanation of the proposed use of covered telecommunications equipment and any factors relevant to determining if such use would be permissible under the prohibition in paragraph (b)(1) of this provision.

(ii) For covered services--

(A) If the service is related to item maintenance: A description of all covered telecommunications services offered (include on the item being maintained: Brand; model number, such as OEM number, manufacturer part number, or wholesaler number; and item description, as applicable); or

(B) If not associated with maintenance, the Product Service Code (PSC) of the service being provided; and explanation of the proposed use of covered telecommunications services and any factors relevant to determining if such use would be permissible under the prohibition in paragraph (b)(1) of this provision.

(2) Disclosure for the representation in paragraph (d)(2) of this provision. If the Offeror has responded "does" in the representation in paragraph (d)(2) of this provision, the Offeror shall provide the following information as part of the offer:

(a) Definitions. As used in this provision, “covered telecommunications equipment or services” and "reasonable inquiry" have the meaning provided in the clause 52.204-25, Prohibition on Contracting for Certain Telecommunications and Video Surveillance Services or Equipment.

(b) Procedures. The Offeror shall review the list of excluded parties in the System for Award Management (SAM) (https://www.sam.gov) for entities excluded from receiving federal awards for “covered telecommunications equipment or services”.

(c) Representations.

(1) The Offeror represents that it [ ___ ] does, [ ___ ] does not provide covered telecommunications equipment or services as a part of its offered products or services to the Government in the performance of any contract, subcontract, or other contractual instrument.

ADDENDUM TO FAR 52.212-1

To evaluate technical acceptability, past performance, and price fair and reasonable, all offerors are required to submit the following:

All firms or individuals responding must be registered with the System for Award Management (SAM) (https://www.sam.gov) by the award date. The solicitation document and incorporated provisions and clauses will be those in effect through Federal Acquisition Circular (FAC) 2022-05, DFARS 02/28/2022, and NMCARS 18-21.

Fill out the unit price and total amount on the solicitation document (Standard Form 1449) for the base year CLINs 0001 and 0002 and the four (4) option years for CLINs 1001, 1002, 2001, 2002, 3001, 3002, 4001, and 4002.

o Please note: For cost-reimbursable travel CLINs 0002, 1002, 2002, 3002, and 4002, please input $5,000 for the unit price and amount.

A price quote including a breakdown of proposed number of FTEs, labor categories, and labor rates.

Please note that 40 hours per week of service is expected.

A statement regarding technical approach on completing the work in accordance with the Performance Work Statement (PWS).

o Please also address how 40 hours per week of support will be ensured for the following:

Submit resumes demonstrating proven ability to provide a qualified PAS.

Past Performance o Submit a list with a minimum of two (2) relevant, recent (within the last 3 years) contracts that are currently in process or have been completed by the offeror. These contracts shall be the same or similar in scope, complexity and magnitude to the current requirement. Government contracts are preferred, but commercial references are also acceptable. The following information shall be included for each contract:

An OPSEC Plan (Attachment 6) will be required from the awardee (only) at time of award. Contractors shall not include the OPSEC Plan with their proposal submission. Rather, once the intended awardee is known, the Government will notify the intended awardee with instructions on completing the OPSEC Plan and submitting it through DoD SAFE. The OPSEC Plan will be considered CUI once filled in. Therefore, it shall not be submitted through email.

52.212-2 EVALUATION--COMMERCIAL PRODUCTS AND COMMERCIAL SERVICES (NOV 2021)

(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:

(i) technical capability of the item offered to meet the Government requirement; (ii) price; (iii) past performance

Technical and past performance, when combined, is considered more important than price.

Offerors without a record of recent and/or relevant past or present performance history, for whom information on past or present performance is not available, or so sparse that no confidence assessment rating can be reasonably assigned, shall receive the rating, "Unknown Confidence," meaning the rating is treated neither favorably nor unfavorably.

(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).

(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

ADDENDUM TO FAR 52.212-2

EVALUATION

a. Basis for Contract Award

The Government will select the best offer, which conforms to the solicitation requirements, is deemed responsible IAW FAR 9.1, and provides the best value to the Government. The evaluation decision will be based on an integrated assessment of the quote against all evaluation factors in the solicitation. The evaluation may result in an award to a higher technically rated, higher priced quote, where the decision is consistent with the evaluation factors, and the Government reasonably determines that the technical approach of the higher priced quote outweighs the price difference. The evaluation factors are as follows:

The technical approach will be rated IAW the following technical ratings.

Factor 2 – Price The overall price will not be rated or scored and will be evaluated for price reasonableness.

Factor 3 – Past Performance Evaluation

Offerors will also be evaluated on past performance. Past Performance evaluation consists of review of two recent contracts (within the last 3 years). Past performance will be evaluated to determine the relevancy (like or similar in scope, complexity and magnitude) of current or past performance and rate the degree of confidence for the Offeror to successfully perform the current requirement. Relevancy will be used as a stronger predictor of future success, thus has more influence on the past performance confidence than past performance of lesser relevance. The performance confidence ratings will be based on recent and relevant past performance to determine the Government’s expectation of successful performance.

The Government reserves the right to consider recent and relevant (like or similar in scope, complexity and magnitude to the requirements of this solicitation) past performance information from sources including Federal, State and local Government agencies, better business bureaus, published media and electronic databases including, but not limited to, Federal Awardee Performance and Integrity Information System (FAPIIS) and Contractor Performance Assessment Reporting System (CPARS).

Offerors without a record of recent and/or relevant past or present performance history, for whom information on past or present performance is not available, or so sparse that no confidence assessment rating can be reasonably assigned, shall receive the rating, "Unknown Confidence," meaning the rating is treated neither favorably nor unfavorably.

Solicitation Requirements, Terms and Conditions Contractors are required to meet all solicitation requirements, such as terms and conditions, representations and certifications, and technical requirements, in addition to those identified as factors. Failure to comply with the terms and conditions of the solicitation may result in the contractor being ineligible for award. Contractors must clearly identify any exception to the solicitation terms and conditions and must provide complete supporting rationale. The Government reserves the right to determine any such exceptions unacceptable.

52.212-3 OFFEROR REPRESENTATIONS AND CERTIFICATIONS--COMMERCIAL PRODUCTS AND

COMMERCIAL SERVICES (NOV 2021)

The Offeror shall complete only paragraph (b) of this provision if the Offeror has completed the annual representations and certification electronically in the System for Award Management (SAM) accessed through https://www.sam.gov. If the Offeror has not completed the annual representations and certifications electronically, the Offeror shall complete only paragraphs (c) through (v) of this provision.

(a) Definitions. As used in this provision --

“Covered telecommunications equipment or services” has the meaning provided in the clause 52.204-25, Prohibition on Contracting for Certain Telecommunications and Video Surveillance Services or Equipment.

“Economically disadvantaged women-owned small business (EDWOSB) Concern” means a small business concern that is at least 51 percent directly and unconditionally owned by, and the management and daily business operations of which are controlled by, one or more women who are citizens of the United States and who are economically disadvantaged in accordance with 13 CFR part 127.
