About this file

This is a Justification and Approval (J&A) document for a non-competitive procurement by the Department of the Navy, Military Sealift Command (MSC), Norfolk, VA.

MSC seeks to procure software customization and sustainment services for a proprietary Human Resources (HR) business system. The contracting activity is the Ship Support and Services Division (N102). The services include project management, software customization, software release planning, design and development, testing, documentation, professional training services, requirements traceability, and quality assurance. MSC requires these services to deploy and operate the proprietary software in both Ashore and Afloat Production environments, with implementation of over 800 unique user requirements for Limited Rate in Production (LRIP) and Full Fielding across 61 vessels scheduled to begin in FY26 Q3. The estimated contract cost is redacted, and the contract includes a 6-month option period under FAR Clause 52.217-8.

The J&A justifies use of FAR 6.302-1 (only one responsible source) because the selected vendor is the sole source with access to the proprietary source code required for customization and sustainment. MSC conducted market research evaluating five COTS and GOTS products, and the selected solution scored highest, supporting 80% of current requirements and 91% with planned enhancements. The vendor has been on-site for the past three years and is the only entity authorized and certified to modify the software to meet Department of Defense and MSC operational standards. The J&A was approved by the Competition Advocate based on statutory authority under 10 U.S.C. 3204(a)(1).

4. Statutory Authority Permitting Other Than Full and Open Competition.

10 U.S.C. 3204(a)(1), Only one responsible source and no other supplies or services will satisfy agency requirements, as implemented by FAR6.103-1(c)(2).

5. Rationale Justifying Use of Cited Statutory Authority. This J&A uses FAR 6.302-1, Only one responsible source and no other supplies or services will satisfy agency requirements. The use of FAR Subpart 6.302-1 is appropriate for use when:

When the supplies or services required by the agency are available from only one responsible source, or, for DoD, NASA, and the Coast Guard, from only one or a limited number of responsible sources, and no other type of supplies or services will satisfy agency requirements, full and open competition need not be provided for.

MSC has been working since 2023 to create a customized MyMSC HR business system. Previously, N1 evaluated five separate Commercial Off-the-Shelf (COTS) and Government Off-the-Shelf (GOTS) products against MSC requirements in an Analysis of Alternatives. The evaluation clearly identified as the best-matched solution. significantly outscored all other alternatives, providing support for 80% of MSCs evaluation criteria in its current state and 91% with future enhancements planned.

has currently been deployed ashore and is scheduled for afloat deployment late-2026.

As the is the only source with access to the proprietary source code for that commercial product. MSC does not have access to the source code needed to provide the required customization and sustainment services. Nor does MSC have any legal right to modify that source code. Delivery of software code updates via major releases and increments is critical for the full realization of MSCs HR business requirements, both Ashore and Afloat, as well as software updates that will ensure the software remains viable and secure.
