About this file

This is a Justification and Approval (J&A) document for a non-competitive contract award to provide security services onboard the Sea-Based X-Band Radar platform (SBX-1). The Department of the Navy's Military Sealift Command (MSC), Special Mission Program N105C/PM2, is awarding a one-year firm fixed-price contract to the incumbent contractor, Global Security Management Agency, Inc. (GSMA), to continue critical security services previously performed under contracts N3220517C3102 and N3220523C4141. The contractor will provide the same personnel to deliver 24/7/365 security services and maintain communication with escort and security patrol craft and applicable port security personnel to demonstrate capabilities and preparedness to the DoN and other reviewing agencies. The total estimated contract value is redacted but rounded to the nearest $1 million per NMCARS Annex 1, with funding from FY26 Operations and Maintenance.

The contracting activity is invoking FAR 6.302-2 for Unusual and Compelling Urgency under 10 U.S.C. 3204(a)(2), justifying the non-competitive award based on the critical nature of uninterrupted security services and the impossibility of conducting a timely full and open competition. The J&A acknowledges that while other firms may be capable of providing these services, the administrative lead time required for competition would create an unacceptable and dangerous gap in vital security services upon conclusion of the predecessor contract. The document commits to future competition for the follow-on requirement, which is designated as a small business set-aside under the SBA's 8(a) Business Development Program. The approved J&A will be posted within 30 days after award, and the Contracting Officer will determine that proposed rates are fair and reasonable at the time of award.

4. Statntorv Authority Permitting Other Than Full and Open Competition.

This justification is prepared under the authority of 10 U.S.C. 3204(a)(2), as implemented by FAR 6.302- 2(a)(2), Unusual and Compelling Urgency.

5. Rationale Justifving Use of Cited Statutory Authority.

In accordance with FAR 6.302-2, Unusual and Compelling Urgency, the agency may use other than competitive procedures to limit the number of sources from which it solicits bids or proposals when: (1) an unusual and compelling urgency precludes full and open competition, and (2) delay in award of a contract would result in serious injmy, financial or other, to the Government. Here, a non-competitive contract to GSMA is the only way to avoid unacceptable delays and ensure protection of vital national security capabilities.

This contract is necessruy for the continuation of c1itical security se1vices previously rendered under contract N3220523C4141. An unusual and com ellin° need for this contract exists due to the conclusion sor contract,

- The award o a non-competlt1ve contract to GSMA 1s essentia to prevent a cnt1ca gap in m1ss10n-essent1al se1vices.

e rum o e Government's mission an wou require SBX-1 to com mission to relieve the o • • • • • • required to conduct a full and open competition would create an unacceptable and dangerous gap in these vital security services.

The command acknowledges that other fnms may be capable of providing these se1vices under normal acquisition timelines. However, a lapse in se1vice would occur without sufficient time to develop, compete, evaluate, and awru·d a competitive contract . Such a gap in se1vice would severely dismpt critical mission activities that rely on unintenupted availability and specialized se1vices onboru·d the SBX-1 vessel. Any such delays could result in serious injmy to the Government.

6. Description of Efforts Made to Solicit Offers from as Manv Offerors as Practicable.

The unusual and compelling urgency of this requirement has prevented the ability to post the proposed contract action to the Government point of entiy per FAR 5.202(a)(2) - Exceptions. However, in accordance with FAR 6.305, the approved J&A will be posted within the required 30 days after the award.

7. Determination of Fair and Reasonable Cost.

Before award of the action, the Contracting Officer will determine the rates to be fair and reasonable at the time of award.

8. Actions to Remove Barriers to Future Competition.
