PERFORMANCE WORK STATEMENT

Unlicensed Mariners to Licensed Mariner Training Program

1. BACKGROUND:

1.1. Military Sealift Command requires a comprehensive Unlicensed Mariners to Licensed

Mariner Training Program (AB-to-Mate). The goal of the program is to produce licensed Third Mates qualified for any gross tons upon oceans / Officers-in-Charge of Navigational Watch (OICNW). The curriculum includes a suite of United States Coast Guard (USCG)-approved training, full-mission bridge simulation experiences, instructor-facilitated license exam preparation, tutoring, and assistance with student’s license application and USCG examinations. On-campus lodging and full meal services are to be included in the program and provided by the contractor. Students must be able to walk between classrooms, dining facilities, and their rooms. Task orders are anticipated to include six or more unlicensed civil service mariners (CIVMARs).

2. OBJECTIVE:

2.1. The Contractor shall provide:

2.1.1. A resident student AB-to-Mate program to train, partially-qualify, prepare and assist

CIVMARs in becoming USCG licensed Third Mates (any gross tons upon oceans) /

OICNW)

2.1.2. The Unlicensed Mariners to Licensed Mariner Training Program located at the vendors training facility shall include the courses listed in paragraph 7.

2.1.3. On campus lodging with breakfast, lunch, and dinner shall be provided as part of this program.

3. SCOPE:

3.1. The Contractor shall provide the AB-to-Mate program, lodging and meals described here within.

4. PLACE OF PERFORMANCE:

4.1. The unclassified training program shall be conducted at the Contractor’s facilities, in a campus-like setting, inclusive of classrooms, lodging and dining facilities. USCG license examination may be conducted at the regional exam center.

5. REQUIREMENTS/SPECIFIC TASKS:

5.1. The Contractor shall provide the courses listed in Paragraph 7.

5.2. The Contractor shall provide each CIVMAR student a program survey upon completion of the program. The completed surveys shall be forwarded to the COR within five days after completion of the training program session.

5.3. Students shall be provided course completion certificates as individual courses are completed.

5.4. The Contractor shall provide an invoice along with the names of the students upon completion of the program, and copies of individuals’ course certificates after each class.

The contractor shall notify MSC if any students are unsuccessful in completing a course and shall recommend a remediation plan.

5.5. The Contractor shall notify the COR within five hours after attendance is recorded if any student does not show up for class, are routinely tardy, not taking the program seriously, or otherwise not meeting the school’s standards.

5.6. The Contractor shall not allow any unregistered MSC student into the program. The

COR will provide a list of MSC representatives authorized to enroll students.

5.7. The Contractor shall provide tutoring and remedial instructional assistance so that the student can successfully complete each course and receive certificates of completion.

The Contractor shall provide students that do not initially receive a passing final grade with the following; tutoring, office hours, and the opportunity to retest, so long as it is consistent with USCG standards. In the event the student must retake a class that is contained within this program in order to achieve licensing, the classes are listed under Optional CLIN 0002 (PWS Attachment 1). CLIN 0002 may be exercised at MSCs discretion.

5.8. MSC will work with the contractor to identify program dates, normally sixty (60) days in advance. Firm performance dates and the number of students will be specified in each Task Order. For each task order, the Contractor shall invoice for the total price for all required courses, meals, and lodging per student. If a student is required to retake a course, the individual course will be invoiced separately at the prices specified in the ELINS incorporated into the contract.

5.9. Lodging and Meals. The Contractor shall provide on campus lodging and three full meals a day, including weekends, for the entirety of the residency. These facilities shall be located within close proximity [walking distance] on the campus. See PWS Attachment 3 for AB to Mate Lodging and Meal Training Program Requirements.

5.10. The Contractor shall provide help with filling out the required applications and documentation with the students when submitting the required applications and documentation associated with licensing.

5.11. The Contractor shall assist the students and coordinate with the United States Coast

Guard with scheduling license exams.

5.12. The Contractor shall provide transportation to/from the exam site.

6. CONTRACTOR PROVIDED EQUIPMENT, SUPPLIES AND SERVICES:

6.1. The Contractor shall provide all facilities, books, navigation tools, simulators, instructor classroom supplies, and services necessary for the students to complete this program.

7. REQUIRED TRAINING COURSES/CURRICULUM:

7.1. The program course content shall meet or exceed USCG requirements listed below.

7.1.1. Advanced Fire Fighting

7.1.20. License Preparation Course. The License preparation course shall consist of instructor lead classroom training and practice testing sessions. The instructor lead classroom training and practice testing sessions shall reinforce the USCG material and test questions that will be covered on the USCG exams.

7.1.21. Study Habits. The contractor shall provide academic success training at the beginning of the program. The study habits training shall discuss topics such as:

organization strategies, strengthening focus, managing a schedule, setting and pursuing goals, planning ahead, creating regular study habits, and stress and time management when taking USCG exams.

7.1.22. The Contractor shall assist the students with the submitting the required applications and documentation associated with licensing.

7.1.23. The Contractor shall assist and coordinate with scheduling license exams.

7.1.24. The Contractor shall provide transportation to/from the exam site, if required.

9. AUTHORIZED CHANGES BY THE CONTRACTING OFFICER (KO)

9.1. The KO is the only person authorized to approve changes in any of the requirements of this contract and notwithstanding provisions contained elsewhere in this contract, said authority remains solely the KO. In the event the Contractor accepts any change by the direction of any person other than the KO, the change will be considered to have been made without authorization. Therefore, no adjustments will be made in the contract price to cover any increase incurred as a result thereof. Any MSC Warranted KO within his/her warrant can act in the administration of this contract.

10. ORGANIZATIONAL CONFLICTS OF INTEREST

10.1. The Contractor shall notify the KO immediately if it is aware of any actual or potential Organizational Conflict of Interests (OCI) as defined in FAR Subpart 9.5. The Contractor shall promptly submit a plan to the KO to avoid or mitigate any such OCI.

The Contractor’s mitigation plan will be determined to be acceptable solely at the discretion of the KO and in the event the KO unilaterally determines that any such OCI cannot be satisfactorily avoided or mitigated, the KO may affect other remedies as he or she deems necessary, including prohibiting the Contractor from participation in subsequent contracted requirements which may be affected by the OCI.

11. KICKOFF MEETING

11.1. A kickoff meeting will be held within fifteen (15) business days after contract award.

11.2. The Contractor, the COR, and the KO shall arrange a mutually agreeable time and place to meet in person or virtually via a teleconference or phone conference to discuss the work requirements and details.

Attachment 3 AB to Mate Lodging and Meal Training Program Requirements

1. Room Assignments. CIVMARS shall not be required to share a room or suite.

2. Sanitary Facilities. Each room will have sanitary facilities (toilet, sink and shower) inside the room. CIVMARS will not be required to share sanitary facilities.

3. Safety and Health:

(a) The lodging facility will have a receptionist available 24 hours per day.

(b) All rooms must have operating smoke detectors. Exit signs will be clearly lit and installed on each floor. If possible, the facility will have an installed sprinkler system and fire extinguishers on each floor. A fire evacuation plan shall be posted in each guest room.

(c) Each room must have an adequate ventilation system, with functioning air conditioning and heating systems.

(d) All piping and wiring will be enclosed and in good working order.

(e) Dead bolt door locks on doors and adequate locks on the windows. Sliding doors, if available, will be adequately locked and will have shades or blinds that are in good working order.

(f) The room will be free from mold, mildew and foul odors.

(g) The lodging facility will be free of pest infestation including but not limited to vermin, ants, flies, mosquitoes, bedbugs and cockroaches.

(h) Bathroom fixtures will be free of mold and mildew.

(i) Windows will be free from excessive dirt and cracks.

(j) All electrical outlets, cords, lights and switches operate and are free from defect.

(k) Lighting fixtures will be in good working order and in adequate number for good general and task lighting.

(l) Lodging facility rooms shall include daily cleaning, changing of linen, and replenishment of toiletries.

(m) The lodging facility will have functional washers and dryers available for use by

CIVMARS

(n) The facility shall not be under construction or major renovation during the performance period.

(o) Elevators will be available to all floors.

4. Internet, Television and Radio

(a) Each room will have television and telephone. Local calls will be free.

(b) Internet access shall be available in the lodging facility.

5. Room Furnishings. At a minimum, each room will contain a double bed with a high quality mattress, bedside lighting, and adequately illuminated work space/desk with a desk chair, an upholstered lounge chair and bedside table, a dresser and a mirror in the bathroom. The room will also have a refrigerator, ice container and glasses. There will also be a working microwave in each room. If the rooms do not contain a working microwave, the lodging facility will provide a central location with multiple microwaves for use.

6. Dining.

(a) The lodging facility shall have a full service restaurant serving three meals daily.

52.204-24 REPRESENTATION REGARDING CERTAIN TELECOMMUNICATIONS AND VIDEO

SURVEILLANCE SERVICES OR EQUIPMENT (NOV 2021)

The Offeror shall not complete the representation at paragraph (d)(1) of this provision if the Offeror has represented that it "does not provide covered telecommunications equipment or services as a part of its offered products or services to the Government in the performance of any contract, subcontract, or other contractual instrument" in paragraph (c)(1) in the provision at 52.204-26, Covered Telecommunications Equipment or Services-- Representation, or in paragraph (v)(2)(i) of the provision at 52.212-3, Offeror Representations and Certifications- Commercial Products and Commercial Services. The Offeror shall not complete the representation in paragraph (d)(2) of this provision if the Offeror has represented that it "does not use covered telecommunications equipment or services, or any equipment, system, or service that uses covered telecommunications equipment or services" in paragraph (c)(2) of the provision at 52.204-26, or in paragraph (v)(2)(ii) of the provision at 52.212-3.

(a) Definitions. As used in this provision-

Backhaul, covered telecommunications equipment or services, critical technology, interconnection arrangements, reasonable inquiry, roaming, and substantial or essential component have the meanings provided in the clause 52.204-25, Prohibition on Contracting for Certain Telecommunications and Video Surveillance Services or Equipment.

(b) Prohibition.

(1) Section 889(a)(1)(A) of the John S. McCain National Defense Authorization Act for Fiscal Year 2019 (Pub. L.

115-232) prohibits the head of an executive agency on or after August 13, 2019, from procuring or obtaining, or extending or renewing a contract to procure or obtain, any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system. Nothing in the prohibition shall be construed to--

(i) Prohibit the head of an executive agency from procuring with an entity to provide a service that connects to the facilities of a third-party, such as backhaul, roaming, or interconnection arrangements; or

(ii) Cover telecommunications equipment that cannot route or redirect user data traffic or cannot permit visibility into any user data or packets that such equipment transmits or otherwise handles.

(2) Section 889(a)(1)(B) of the John S. McCain National Defense Authorization Act for Fiscal Year 2019 (Pub. L.

115-232) prohibits the head of an executive agency on or after August 13, 2020, from entering into a contract or extending or renewing a contract with an entity that uses any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system. This prohibition applies to the use of covered telecommunications equipment or services, regardless of whether that use is in performance of work under a Federal contract. Nothing in the prohibition shall be construed to--

(i) Prohibit the head of an executive agency from procuring with an entity to provide a service that connects to the facilities of a third-party, such as backhaul, roaming, or interconnection arrangements; or

(ii) Cover telecommunications equipment that cannot route or redirect user data traffic or cannot permit visibility into any user data or packets that such equipment transmits or otherwise handles.

(c) Procedures. The Offeror shall review the list of excluded parties in the System for Award Management (SAM) (https://www.sam.gov) for entities excluded from receiving federal awards for "covered telecommunications equipment or services."

(d) Representations. The Offeror represents that--

(1) It [ ___ ] will, [ ___ ] will not provide covered telecommunications equipment or services to the Government in the performance of any contract, subcontract or other contractual instrument resulting from this solicitation. The Offeror shall provide the additional disclosure information required at paragraph (e)(1) of this section if the Offeror responds "will" in paragraph (d)(1) of this section; and

(2) After conducting a reasonable inquiry, for purposes of this representation, the Offeror represents that--

It [ ___ ] does, [ ___ ] does not use covered telecommunications equipment or services, or use any equipment, system, or service that uses covered telecommunications equipment or services. The Offeror shall provide the additional disclosure information required at paragraph (e)(2) of this section if the Offeror responds "does" in paragraph (d)(2) of this section.

(e) Disclosures.

(1) Disclosure for the representation in paragraph (d)(1) of this provision. If the Offeror has responded "will" in the representation in paragraph (d)(1) of this provision, the Offeror shall provide the following information as part of the offer:

(i) For covered equipment--

(A) The entity that produced the covered telecommunications equipment (include entity name, unique entity identifier, CAGE code, and whether the entity was the original equipment manufacturer (OEM) or a distributor, if known);

(B) A description of all covered telecommunications equipment offered (include brand; model number, such as OEM number, manufacturer part number, or wholesaler number; and item description, as applicable); and

(C) Explanation of the proposed use of covered telecommunications equipment and any factors relevant to determining if such use would be permissible under the prohibition in paragraph (b)(1) of this provision.

(ii) For covered services--

(A) If the service is related to item maintenance: A description of all covered telecommunications services offered (include on the item being maintained: Brand; model number, such as OEM number, manufacturer part number, or wholesaler number; and item description, as applicable); or

(B) If not associated with maintenance, the Product Service Code (PSC) of the service being provided; and explanation of the proposed use of covered telecommunications services and any factors relevant to determining if such use would be permissible under the prohibition in paragraph (b)(1) of this provision.

(2) Disclosure for the representation in paragraph (d)(2) of this provision. If the Offeror has responded "does" in the representation in paragraph (d)(2) of this provision, the Offeror shall provide the following information as part of the offer:

(i) For covered equipment--

52.212-1 (ADDENDUM) ADDITIONAL INSTRUCTIONS TO OFFERORS--COMMERCIAL ITEMS

Any inconsistency between FAR Provision 52.212-1 and the Addendum to FAR 52.212-1 shall be solved by giving precedence to the Addendum to FAR 52.212-1.

REQUIREMENTS FOR SUBMISSION OF PROPOSALS

Proposal Submittal and Inquiries.

1) Submit proposals by the closing date and time identified on www.SAM.gov and on SF 1449 block 8 of this solicitation number.

2) Proposals shall be emailed to Mr. Jim Ellis at james.p.ellis54.civ@us.navy.mil and Ms.

Jordan Castellat at jordan.r.castellat.civ@us.navy.mil.

3) Other submission methods will not be accepted. Offerors are responsible for ensuring that the Government receives the complete proposal by the due date and time for proposal submission. No zip files shall be accepted. For assistance access and training, offerors may contact their Contractor Account Administrator or Vendor Customer Support.

4) The proposal must demonstrate an understanding of, and ability to meet, all of the requirements set forth in the Performance Work Statement (PWS) herein. Throughout the proposal, the Offeror shall provide sufficient detail to substantiate the validity of all statements. The Offeror shall demonstrate that the proposal is in compliance with the requirements, terms, and conditions of the solicitation.

Comprehensive responses to the requirements of this solicitation are required to enable the Government to evaluate the Offeror’s understanding of and capability to accomplish the requirements of the PWS. The proposal must clearly demonstrate the Offeror’s ability to meet the requirements of the solicitation and successfully accomplish and manage all requirements of the solicitation. General statements that the Offeror can or will comply with the requirements, that standard procedures will be used, that well known techniques will be used, or paraphrasing the solicitation’s requirements in whole or in part, will NOT constitute compliance. Failure to conform to any of the requirements of the solicitation may form the basis for rejection of the proposal. Clarity, completeness, and conciseness are essential and the overall quality of the proposal will be evaluated in the context of being representative of the Offeror’s services. An Offeror’s proposal is presumed to represent the best efforts to respond to the solicitation.

Only the proposal submitted in response to this solicitation will be evaluated. Offerors should make certain that their proposal is complete with regard to the information provided. The electronic copies shall be in either Microsoft Word or Portable Document Format (PDF) other than the Pricing Volume which should remain in excel format. Each volume should have its own File, separate from the other volumes. Volumes I and II shall not contain any pricing data. The pages are to be typewritten, no less than 1 1/2-line spacing, and no smaller than 12-point type. Zip files will not be accepted.

Each volume of the proposal shall be clearly marked as to the volume number, the solicitation number, and the Contractor’s name. Pages shall be numbered consecutively within each volume showing volume and page. For example, page 19 of Volume I would be numbered I-19 and page 10 of Volume II would be numbered II-10.

Offerors are advised that the Government may verify any information provided in the proposal. Offerors are cautioned that they are responsible to ensure that material that they desire to have evaluated for a particular section is contained in that specific section.

Proposals shall not contain classified material. Any portion of a proposal, which the Offeror considers business sensitive, should be clearly marked as such in accordance with FAR 52.215-1.

VOLUME I: SOLICITATION DOCUMENTS

The Offeror’s Solicitation Documents volume must include the following:

1. A cover letter that includes:

• The Solicitation number, the name, address, and telephone numbers of the Offeror;

• A statement specifying the extent of agreement with all terms, conditions, and provisions included in the solicitation and agreement to furnish any or all services upon which prices are offered;

• The names, titles, telephone numbers, and e-mail address of persons authorized to negotiate on the Offeror's behalf with the Government in connection with this solicitation;

• The names, titles, telephone numbers, and e-mail address of persons authorized to sign the award on the Offeror's behalf;

• “Remit to” address, if different than mailing address;

• Company/Division’s Unique Entity ID; and Commercial and Government Entity (CAGE)

Code.

2. Completed Representations and Certification as required by the RFP (FAR Clause 52.212-3). Please certify the information in FAR 52.204-24, FAR 52.209-7, FAR 52.212-3 Alt I, 52.222-48, 52.229-11, and 252.204-7017.

3. Signed copies of the RFP and all RFP amendments (if applicable);

4. With respect to FAR 52.212-1(c), unless offeror inserts a shorter period by submission of an offer, offeror agrees that its offer, including any timely revisions thereto, shall remain valid until the Government makes award under this solicitation. The foregoing does not preclude an offeror from withdrawing its offer prior to award.

5. Exceptions: If applicable, the Offeror shall clearly detail any exceptions taken and the rationale for the exceptions taken to the RFP or its amendments. Please note that exceptions taken to the RFP may render the Offeror’s quote unacceptable to the Government.

6. Financial Responsibility: The Offeror must have and confirm that they have the financial capability to conduct the requirements outlined in the PWS. Accordingly, the Offeror shall furnish information necessary for the Contracting Officer to determine the financial responsibility of the Offeror.

7. Proposal Security Classification and Distribution: The classification of this proposal shall be

UNCLASSIFIED. The originals and all copies of the signed solicitation documents and Volumes I through III shall be sent via email.

8. Restriction on Disclosure and Use of Data: Offerors who include data in their proposal they do not want disclosed to the public, or to be used by the Government for evaluation purposes only, shall mark such data in accordance with FAR 52.215-1. Such data shall be specifically identified by page(s), paragraph(s), sentence(s), and must not be generalized.

9. Small Business Subcontracting Plan, Commercial Plan or Waiver: Large businesses shall submit a plan. Failure to submit and negotiate a subcontracting plan acceptable to the Contracting Officer will make the Offeror ineligible for award of a contract. All personnel and subcontracting personnel needs to be qualified at all times when it comes the requirements set forth in the PWS.

VOLUME II: TECHNICAL

Factor 1: Technical Offerors shall structure the technical information of their proposals in the same format set forth below.

Further, to facilitate the evaluation process, Offerors shall submit their proposals in an organized manner that indicates the sections as set forth below.

The Offeror’s technical proposal shall conform fully to the minimum technical requirements of the solicitation and address each of the following technical subfactors with no pricing information:

Subfactor 1: The Offeror shall provide copies of the United States Coast Guard Certifications, containing the vendor’s name as the certified entity, for each of the following required USCG Authorized Mariner training courses.

- Coast Guard Certification authorizing the offeror to instruct Advanced Fire Fighting training course IAW section 7.1.1 of the PWS

- Coast Guard Certification authorizing the offeror to instruct Automatic Radar Plotting Aids (ARPA) training course IAW section 7.1.2 of the PWS

- Coast Guard Certification authorizing the offeror to instruct Basic Shiphandling training course IAW section 7.1.3 of the PWS

- Coast Guard Certification authorizing the offeror to instruct Bridge Resource Management training course IAW section 7.1.4 of the PWS

- Coast Guard Certification authorizing the offeror to instruct Cargo Handling & Stowage training course IAW section 7.1.5 of the PWS

- Coast Guard Certification authorizing the offeror to instruct Celestial Navigation- Operational Level training course IAW section 7.1.6 of the PWS

- Coast Guard Certification authorizing the offeror to instruct Electronic Chart Display And Information System (ECDIS) training course IAW section 7.1.7 of the PWS

- Coast Guard Certification authorizing the offeror to instruct Electronic Navigation Systems training course IAW section 7.1.8 of the PWS

- Coast Guard Certification authorizing the offeror to instruct Emergency Procedures IAW section 7.1.9 of the PWS

- Coast Guard Certification authorizing the offeror to instruct Global Maritime Distress & Safety System (GMDSS) IAW section 7.1.10 of the PWS

- Coast Guard Certification authorizing the offeror to instruct Leadership and Teamworking Skills training course IAW section 7.1.11 of the PWS

- Coast Guard Certification authorizing the offeror to instruct Medical First-Aid Provider training course IAW section 7.1.12 of the PWS

- Coast Guard Certification authorizing the offeror to instruct Meteorology- Operational Level training course IAW section 7.1.13 of the PWS

- Coast Guard Certification authorizing the offeror to instruct Radar Observer training course IAW section 7.1.14 of the PWS

- Coast Guard Certification authorizing the offeror to instruct Search & Rescue- Operational Level training course IAW section 7.1.15 of the PWS

- Coast Guard Certification authorizing the offeror to instruct Ship Construction & Basic Stability training course IAW section 7.1.16 of the PWS

- Coast Guard Certification authorizing the offeror to instruct Terrestrial Navigation training course IAW section 7.1.17 of the PWS

- Coast Guard Certification authorizing the offeror to instruct Visual Communications training course IAW section 7.1.18 of the PWS

- Coast Guard Certification authorizing the offeror to instruct Watchkeeping (Including Colregs) training course IAW section 7.1.19 of the PWS

Subfactor 2: Vendor confirms that the lodging and meal services provided are IAW section 5.9 of the PWS and meet the union standards outlined in Attachment 3 of the PWS.

Offerors are advised that the technical evaluation will be based on the information provided in the technical volume. The Government will not make assumptions regarding the information contained therein; only information contained in the proposals will be evaluated. Therefore, offerors must conclusively demonstrate in their proposals how the Government’s stated requirements are met.

VOLUME III: PRICING

Factor 2: Price The Offeror’s price proposal shall consist of a completed copy of the Course Pricing Table of this solicitation (Attachment 1 of the Solicitation).

The Government may not accept electronic files that have been re-formatted.

The Government may not accept additional pricing sheets, electronic or paper, which display pricing data in different formats. Unit prices should be rounded to the whole dollar for each CLIN listed.
