PERFORMANCE WORK STATEMENT

1. Background

The Department of the Navy (DON) prohibits discrimination in Employment because of race, color, religion, sex, national origin, age, sexual orientation, disability, or reprisal. DON policy is to process promptly and impartially discrimination complaints in accordance with timeframes established in 29 CFR 1614. As part of the process, DON is required to investigate complaints within 180 days of the formal filing of complaints. Military Sealift Command (“MSC”) is in full support of the DON policy prohibiting discrimination in the workplace and seeks to meet its obligation to timely process discrimination complaints within specified timeframes.

2. Objective

Conduct impartial, thorough and timely investigation of a formal EEO complaint of discrimination in accordance with 29 CFR 1614, and Equal Employment Opportunity Commission (EEOC) Management Directive 110 (EEO Management Directive for 29 CFR 1614, November 9, 1999). Additionally, an optional second investigation will be available to MSC at its own option.

3. Period of Performance

55-Day Investigation Period: 1 May 2025 – 25 June 2025 Final Report of Investigation (ROI) Due: 25 June 2025

4. Scope

The required contractor support involves the investigation of formal EEO complaints of discrimination cases filed against Military Sealift Command or supported activities and the DON. Primary tasking involves analyzing large volumes of data and compiling the information into a comprehensive fact-based written format to allow Government decision makers the ability to read and understand the matter being alleged and examine the evidence associated with the claim to make a decision on the merits of the case.

5. Definitions

Case: A formal EEO complaint accepted by MSC for investigation that alleges discrimination against an employee(s) thereof.

Amendment: Any additional discriminatory conduct alleged against MSC via amendment to the Complaint and accepted by MSC for investigation.

Additional Issue: A point of fact or law disputed between parties in litigation that is added to a complaint.

Consolidated Cases: To unite or unify a number of complaints into one action. Two or more complaints of discrimination from the same complainant may be consolidated by the agency or Commission for joint processing after appropriate notification to the parties.

Continuing Violation Case: In law in general, this term means existing for an indefinite period, or intended to cover or apply to successive similar obligations or occurrences; not terminated by a single act or fact, such that the statute of limitations continues to run.

Case File: the collection of documents relating to an EEO complaint, including (but not limited

to) the acceptance letter, counsellor’s report, other pre-complaint documentation, a pre-election form, and notice of right to file.

Government Furnished Items and Information (“GFI”): the case file and any other documentation or information provided by the Government to the investigator.

6.1.1 The contract shall include up to 1 Consolidated Case with up to 3 Amendments associated with the Consolidated Case.

6.2 The Contractor shall conduct official reviews and gathering all the evidence necessary to render an impartial investigation and discover and record facts in order to help the Government decide as to whether or not a violation of EEO law or regulation occurred and to determine what remedial action, if any, is appropriate. “Discover and record facts” includes (but is not limited to) interviewing witnesses and documenting the results of interviews.

6.3 The Contractor shall examine alleged violations of equal employment opportunity policy or practice being challenged in the complaint and the alleged basis for discrimination, (e.g., race, color, national origin, sex, religion, age (40 or older), disability (mental or physical) or reprisal).

6.4 The Contractor shall examine and analyze large volumes of data consisting of various forms of evidence (i.e., personnel documents, employee data, witness testimony) related to the issue(s) in the complaint. The Contractor shall maintain and protect sensitive/confidential/Privacy Act data in accordance with established Privacy Act policy/regulations.

6.5.1 The final ROI shall be tabbed and all pages numbered (bates stamped in the bottom right hand corner), one-sided pages. The ROI shall be delivered to MSC in Adobe PDF formatted electronic document. In addition to the ROI being produced and transferred via DoD SAFE as specified in Section 9 of this PWS, the Contractor shall upload findings to DoD SAFE as specified in Section 9 of this PWS as well.
