4. Statutory Authority Permitting Other Than Full and Open Competition: 10 U.S.C.

3204(a)(1) Only one responsible source and no other supplies or services will satisfy agency requirements.

5. Rationale Justifying Use of Cited Authority: This is a follow on contract to one where

Space Saver designed a custom use of its commerical-off-the-shelf Space Saver shelving units. No other shelving units are so incorporated into a design for USNS COMFORT (T-

AH 20).

These shelving units supplied by Space Saver are part of Trans-Alt T-AH 19-21013R.

This is part of the redesign of three spaces on the COMFORT. The drawings for the shelving units are owned by Space Saver and are proprietary drawings to their company.

The part numbers of this requirement are only valid for Space Saver, or an authorized distributor of Space Saver, who will provide the exact part numbers being requested.

MSC requires the exact part numbers for the Space Saver shelving units to support the remodel of three nourishment stations on the USNS COMFORT (T-AH 20).

These exact shelving systems being requested from Space Saver, or an authorized distributor of Space Saver, are being used on both vessels within the T-AH class as part of the standardization initiative to ensure that both T-AH vessels have the exact same configuration and equipment. Both ships will use Space Saver shelving for storage and are phasing out the legacy systems as these systems are obsolete and no longer functioning as required for the T-AH Class.
