About this file
This document is an amendment to a solicitation for a time charter of harbor tugs in Guam. The amendment makes changes to the solicitation language and provides answers to questions from potential offerors. It removes the requirement for an active facility security clearance and amends response times for tug services. Tugs must be fully crewed during normal hours and available within 15 minutes of notification, and fully crewed within one hour of notification for overtime periods. It also clarifies war risk insurance coverage of $500 million is required. Financial statements must demonstrate the ability to remain viable, though alternative documentation from banking institutions may be acceptable. The solicitation from the Department of the Navy's Military Sealift Command is for the time charter of harbor tugs in Guam to support port operations.

QUESTIONS AND ANSWERS
The following are answers to questions received from potential offerors.
1. When a tug is in drydock as part of their regulatory COI compliance or undergoing routine maintenance and/or urgent repairs, is the Contractor required to maintain two tractor time charter tugs?
ANSWER:
Yes. Contractor is required to maintain availability of two tractor tugs. The Contractor can substitute, but the Contractor cannot fail to provide two assets without going off-hire.
2. If the Government provides a crew in the event of emergencies to operate the tugs, what level of training and certification will the government crew have? For the required government training as stipulated in the solicitation, will the contractor be reimbursed for any cost?
ANSWER:
Government tug crews will have the level of training and qualifications IAW NABVASEGUAMINST 3502.1 (EMERGENCY TUG CREW OPERATIONS) and NAVEDTRA 43609. Training is the responsibility of the Owner/Operator, as this is a contract requirement.
3. The current solicitation requires the Contractor to hold a facility clearance of SECRET. In researching other current government time charter solicitations across the US, there is no requirement to hold this same facility clearance. If the contractor meets all other performance, pricing, and technical requirements but does not hold a facility clearance, will the contractor still be eligible?
A Facility Secret Clearance is not required. Please see the amended language in the Amendment above.
4. The required response time for tug service during straight time and overtime periods is 15 minutes. Is it the government’s intention to have the tugs fully crewed 24/7?
ANSWER:
Tugs are required to be fully crewed during normal working hours (straight time) and ready to support within 15 minutes of notification. Tugs are required to be fully crewed during afterhours (overtime periods) within one hour (60 minutes) of notification and ready to transit and support. Please see amended language in the Amendment above.
5. The current solicitation has a WAR risk limit of $500,000,000.00. In discussions with the Insurance market brokers, this limit is highly unusual per industry standard. Other similar time charter contracts currently have an insurance cap limit of $50,000,000.00 and $250,000,000.00. Can the government clarify if this WAR risk limit is accurate?
ANSWER:
The contract requires that “The Time Charterer Protection and Indemnity policy/entry with P&I
War Risk coverage shall provide coverage of $500,000,000.” This is accurate. Although these are small tugs, they come in contact with submarines and other Navy ships.
6. Due to the proprietary nature of company financial statements, are there other acceptable documents that highlight a company’s corporate viability such as a Certificate of Financial Capability from contractor’s banking institution(s) that can be allowed for bid submittal instead?
The RFP states that ‘The Offeror shall provide the most recent audited financial information containing, at a minimum, balance sheets, cash flow statements, income statements, and combined financial statements that illustrate the company’s ability to remain a viable business concern. If an Offeror intends to utilize the financial information or assistance of another entity to meet the corporate viability requirement (loan, income statement from parent company, etc.), that Offeror must provide signed statement(s) proving that entity’s agreement with the arrangement. The Offeror must furnish evidence of adequate financial resources to perform the contract or the ability to obtain such resources. For the purpose of this section, adequate financial resources are an amount equal to the total value of forty-five (45) days of the proposed daily charter hire rate for the vessel (calculated based on the firm period charter hire rate).’
This is a firm requirement. Please be advised that offerors that include in their proposals data that they do not want disclosed to the public for any purpose, or used by the Government except for evaluation purposes, may mark the proposal in accordance with FAR 52.215-1(e). Please also note that FOIA “Exemption 4” protects “privileged or confidential commercial or financial information” from disclosure.
