JUSTIFICATION AND APPROVAL FOR USE OF OTHER THAN FULL AND OPEN COMPETITION

1. Contracting Activity: Department of the Navy, Military Sealift Command (MSC).

2. Description of the Action Being Approved: This is a brand name justification for work to be provided for the Mid-Term Availability (MTA) of the USNS JOHN LENTHALL (T-AO 189) under RFP N3220519R4014. This Justification is covering only the portion of the acquisition which an OEM authorized facility/Manufacturer/Representative is required and the approval level requirements will then only apply to that portion.

3. Description of Supplies/Services: MSC Norfolk requires Original Equipment Manufacturer (OEM) authorized technical field service representatives and OEM parts to accomplish the requirements of Work Items (WIs) 202, 203, 401, 402, 451, 452, 453, 455, 504, 505, 506, 508, 562, 563, 602, 605, 606, and 653 for a fifty (50) day MTA. The estimated dollar value of the Eighteen (18) WIs is $1,253,535.00, which will be funded utilizing FY 19 Operations & Maintenance funds.

4. Statutory Authority Permitting Other Than Full and Open Competition: 10 U.S.C 2304 (c)(1), Only

One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements, as implemented by FAR 6.302-1(a).

5. Rationale Justifying Use of Cited Authority: The use of required OEM authorized field technical service representatives and OEM parts for highly specialized equipment is necessary for mission essential purposes. The required OEM authorized field technical service representatives and OEM parts maintain mission critical ship equipment and systems, the failure of which could have serious consequences for deployed military forces and the crew on the vessel during deployments. Further, the required OEM authorized field technical service representatives and OEM parts are necessary to achieve the highest possible reliability, readiness and effectiveness required by MSC for the T-AO class of vessels. The required OEM authorized field technical service representatives and OEM parts also maintain all OEM warranties, ensures equipment reliability, crew safety and applicable ABS/USCG certifications.

a. WI 202 Main Engine Intercooler

The Main Engine intercoolers are an integral Part of the Main Engine Cooling System and are considered part of the main engines. The coolers are what allows the central fresh water to cool the jacket water which cools the main engines. Without this system being fully functional, the engines are not fully functional. Since these items are part of the main engine these items are classified by the Safety Management System (SMS) number 10.6-002- ALL as propulsion. Fairbanks Morse and MSHS are the United States OEM authorized Representatives who are capable of servicing the main engine intercoolers. In accordance with MSC Managers Internal Control-Quality Management System Procedures Manual N0750-100.00-AQ MSC Ship Critical Safety Item- Parts and Service Support only OEM, OEM Technical Representatives (That possess OEM qualifying Documents) or Non-OEM that have been Qualified by MSC N7 Engineering Design Control Activity (DCA) can work on the ships critical equipment.

b. WI 203 Main Engine Reduction Gear Inspection

The Main Engine Reduction Gear, which is the link between the main engine and propeller shafts is classified by Safety Management System (SMS) number 10.6-002-ALL as Critical Equipment. Cincinnati Gear is the OEM for this equipment and owns all data such as drawings and technical manuals. Cincinnati Gear is the only company that can make engineering changes and provide parts for the vessels main engine reduction gear.

c. WI 401, SVDR Rectification Annual (USCG & ABS) authorized vendors to provide service to their equipment. Vendors are required to provide documentation with a certificate of approved training for the JRC-JCY-1700S unit that is installed. Factory authorized suppliers provide parts and proprietary technical data/drawings only available from the original and crew safety therefore precluding consideration of a product manufactured by another company.

Safety Management Systems (SMS) number 10.6-002-01-AO lists the Navigational Equipment as

The SVDR is a USCG and ABS required system that is integrated into the Radar and ECDIS systems to records ship movements. Service of the SVDR must be accomplished by USCG/ABS Approved and OEM Trained vendors. Proper refurbishment and maintenance of the SVDR is critical to the safe navigation and operations of the USNS JOHN LENTHALL (T-AO 189).

d. WI 402, Magnetic Compass Annual

Company has numerous authorized vendors to provide service to their equipment. Vendors are required to provide documentation with certificate of approved training as a magnetic compass adjuster. Factory authorized suppliers provide parts and proprietary technical data/drawings are only available from the original manufacturer and authorized vendors. This maintains all OEM warranties, ensures equipment reliability, and crew safety therefore precluding consideration of a product manufactured by another company.

e. WI 451, Annual Radar Service (USCG & ABS)

The OEM for the FURUNO. FURUNO has numerous authorized vendors to provide service to their equipment. Vendors are required to provide documentation with a certificate of approved training for the FURUNO Radars that are installed. Factory authorized suppliers provide parts and proprietary technical data/drawings only available from the original manufacturer Authorized Vendors. This maintains all OEM warranties, ensures equipment reliability, and crew safety therefore precluding consideration of a product manufactured by another company. Furuno Representatives have access to privy data such drawings, software, and parts, due to consent changing IMO rules these items are needed to keep the Radars in compliance with Class and regulatory bodies.

SMS number 10.6-002-ALL lists the radar as critical equipment. Loss of RADAR would essentially leave the vessel blinded during any condition that impairs the human visual or over the horizon detection of obstacles / threats. Without the RADAR systems fully operational the ship would be rendered nonoperational. Proper refurbishment and maintenance of the radar ECDIS is critical to the safe operations of the USNS JOHN

LENTHALL (T-AO 189).

f. WI 452, Annual ECDIS Maintenance Annual (USCG & ABS)

The OEM for the ECDIS is TRANSAS. TRANSAS has numerous authorized vendors to provide service to their equipment. The vendor is required to provide documentation with a Certificate of Approved training for the TRANSAS units that are installed. Factory authorized suppliers provide parts and proprietary technical data/drawings only available from the original manufacturer Authorized Vendors. This maintains all OEM warranties, ensures equipment reliability, and crew safety therefore precluding consideration of a product manufactured by another company.

Safety Management Systems (SMS) number 10.6-002-01-AO lists the Navigational Equipment as critical equipment. The ECDIS is an intricate component within the Bridge Navigation equipment. Failure of the ECDIS will severely and identify other vessels operating in/around the vessel. Proper refurbishment and maintenance of the ECDIS is critical to the safe navigation and operations of the USNS JOHN LENTHALL

(T-AO 196).

g. WI 453, NAVIGAT X Gyro Systems Preventative Maintenance

The OEM for the NAVIGAT X Gyro equipment is Sperry Marine. A Sperry qualified rep for servicing, parts and repairs is required to certify and ensure proper operation and bearing (heading accuracy). This is the primary electronic means available for determining where ships are heading, and supplies this information to various equipment on the bridge and must be certified accurate and available for the vessel during navigation for safe passage. This is a Coast Guard requirement. Proper refurbishment and maintenance of the Gyro Compass is critical to the safe operation of the USNS JOHN LENTHALL (T-AO 189). Factory authorized suppliers provide parts and proprietary technical data/drawings only available from the original manufacturer as required by USCG and ABS regulations. This maintains all OEM warranties, ensures equipment reliability, and crew safety;

therefore, precluding consideration of a product manufactured by another company.

Safety Management Systems (SMS) number 10.6-002-01-AO lists the Navigational Equipment as critical and is required by ABS and USCG. Service of the GYRO must be accomplished by USCG/ABS Approved and OEM trained vendors. Proper refurbishment and maintenance of the GYRO is critical to the safe navigation and operations of the USNS JOHN LENTHALL (T-AO 189).

h. WI 455, Annual Radio Communication Equipment Recertification (USCG & ABS)

The OEM for the m (GMDSS) is Sailor, Thrane and Thrane Model SS Series 500 GMDSS Console. The GMDSS console is made up of many pieces of individual equipment that work independently but provide input into the GMDSS Console. These pieces of equipment are manufactured by Thrane & Thrane, FURUNO, SAAB, and ACR. The GMDSS Console and the many components have numerous authorized vendors to provide service to their equipment. Vendors are required to provide documentation with a certificate of approved training for the Thrane & Thrane GMDSS Console unit that is installed and supporting equipment. Factory authorized suppliers provide parts and proprietary technical data/drawings only available from the original manufacturer authorized vendors. This maintains all OEM warranties, ensures equipment reliability, and crew safety therefore precluding consideration of a product manufactured by another company. The Authorized Representative shall gain the approval of the regulatory body American Bureau of Shipping (ABS).

Safety Management Systems (SMS) number 10.6-002-01-AO lists the Navigational Equipment as critical equipment, and the Global Marine Distress and Safety System (GMDSS) is required by ABS and USCG. This equipment provides several means of communication and distress signaling including Search And Rescue Transponders (SARTs) and Emergency Position Indicating Radio Beacon (EPIRB). Service of the GMDSS must be accomplished by USCG/ABS Approved and OEM Trained vendors. Proper refurbishment and maintenance of the GMDSS is critical to the safe navigation and operations of the USNS JOHN LENTHALL (T- AO 189).

i. WI 504, Auxiliary Boilers Inspection & Repair parts to their equipment. Factory parts and proprietary technical data/drawings only available from the original manufacturer. This maintains all OEM warranties, ensures equipment reliability, and crew safety therefore precluding consideration of a product manufactured by another company.

SMS number 10.6-002-01-AO lists the boilers System as critical equipment. Failure of the boilers will severely impact the safe operation of the ship. Proper refurbishment and maintenance of the boilers is critical to the safe operations of the USNS JOHN LENTHALL (T-AO 189).

j. WI 505 Incinerator Inspection & Repair authorized vendors to provide parts to their equipment. Factory parts and proprietary technical data/drawings only available from the original manufacturer. This maintains all OEM warranties, ensures equipment reliability, and crew safety therefore precluding consideration of a product manufactured by another company.

SMS number 10.6-002-01-AO lists the incinerator as critical equipment. Failure of the incinerator will severely impact the safe operation of the ship. Proper refurbishment and maintenance of the incinerator is critical to the safe operations of the USNS JOHN LENTHALL (T-AO 189).

k. WI 506, VAF Cargo Oil Content Monitor Installation (USCG & ABS)

-V. VAF Instruments has numerous authorized vendors to provide service to their equipment. Vendors are required to provide documentation with a certificate of approved training for the MK6, OILCON Ballast Monitor that is installed. Factory authorized suppliers provide parts and thorized vendors. This maintains all OEM warranties and ensures equipment reliability and crew safety, therefore precluding consideration of a product manufactured by another company.

SMS number 10.6-002 01-AO lists the Oil Content Monitor as critical equipment. Failure of the Oil Content the ability to comply with current environmental regulations as required by USCG and ABS, will expose the crew to the possibility of an oil discharge. Proper refurbishment and maintenance of the Oil Content Monitor are critical to the safe operation of the USNS JOHN LENTHALL (T-AO 189).

l.. WI 508, Engine Room Oily Content Monitor Calibration (USCG & ABS)

The OEM for the OWS onboard the USNS JOHN LENTHALL (T-AO 189) is GEA Westfalia, Inc.

GEA Westfalia is the only known OEM authorized supplier of approved repair parts and service for their equipment. Factory authorized suppliers provide parts and technical data/drawings from the OEM as required by USCG and ABS regulations. This maintains all OEM warranties and ensures equipment reliability and crew safety, therefore precluding consideration of a product manufactured by another company.

SMS number 10.6-002 01-AO lists the OWS as critical equipment. Failure of the OWS will severely impede the reduction of the ability to comply with current environmental regulations will expose the crew to the possibility of an oil spill. Proper refurbishment and maintenance of the OWS are critical to the safe operation of the USNS JOHN LENTHALL (T-AO 189).

n. WI 562 SCBA Annual Inspection ill Station is Interspiro Inc. Interspiro Inc has numerous authorized vendors to provide service to their equipment. The vendors are required provide documentation with a certificate of approved training for the Interspiro (SCBA units, including backpack with air flask, facemask and harness that is installed aboard the ship. Factory authorized suppliers provide parts and maintains all OEM warranties, ensures equipment reliability, and crew safety therefore precluding consideration of a product manufactured by another company.

SMS number 10.6-002-01-AO lists the Damage Control Equipment as required to allow crewmembers to perform fire-fighting duties while fighting a shipboard fire or addressing a

Force capability control/extinguish a fire and save the vessel from further damage.

o. WI 0563 SCBA Air Compressor & Fill Station Inspection (1YR) authorized vendors to provide service to their equipment. Vendors are required to provide documentation with a certificate of approved training for the MAKO Models installed on the USNS JOHN LENTHALL (T-AO 189). Factory authorized suppliers provide parts and proprietary technical data/drawings only available from the origina vendors. This maintains all OEM warranties, ensures equipment reliability, and crew safety therefore precluding consideration of a product manufactured by another company.

SMS number 10.6-002-01-AO lists the Damage Control Equipment as Compressor and Refill Station is required to refill expended SCBA bottles used when fighting a shipboard fire or addressing a HAZMAT situation. Failure of the SCBA Compressor and Refill Station will severely reduce the control/extinguish a fire and save the vessel from further damage.

p. WI 602, Port Rigid Hull Inflatable Boat (RHIB) Davit Annual Servicing (ABS)

Allied Technical Services is the OEM authorized vendor and supplier of approved repair parts and services to their equipment. Proper refurbishment and maintenance of Rescue Boat Davits is critical to the safe operation of the USNS JOHN LENTHALL (T-AO 189). Factory authorized suppliers provide parts and technical data/drawings from the original manufacturer as required by USCG and ABS regulations. This maintains all OEM warranties, ensures equipment reliability, and crew safety therefore precluding consideration of a product manufactured by another company.

SMS number 10.6-002-ALL lists the RHIB and Davit Assemblies as critical equipment. Failure of RHIB and Davit Assemblies is a major loss in safety and lifesaving equipment required for the vessel to get underway for vessel operations. The loss of major safety and lifesaving equipment poses a hazard to the crew. Proper refurbishment and maintenance of the RHIB and Davit Assemblies is critical to the safe operations of the USNS JOHN LENTHALL

(T-AO 189).

q. WI 605, Falls Renewal and Recertify Life Boat Winches (ABS) supplier of approved repair parts and to service their equipment. Proper refurbishment and maintenance of Lifeboat Winches is critical to the safe operation of the USNS JOHN LENTHALL (T-AO-189).

Factory authorized suppliers provide parts and technical data/drawings from the original manufacturer as required by USCG and ABS regulations. This maintains all OEM warranties, ensures equipment reliability, and crew safety therefore precluding consideration of a product manufactured by another company.

SMS number 10.6-002-ALL lists the Lifeboats as critical equipment. Failure of Lifeboat Winches is a major loss in safety and lifesaving equipment required for the vessel to get underway for vessel operations. The loss of major safety and lifesaving equipment poses a hazard to the crew. Proper refurbishment and maintenance of the Lifeboat Winches is critical to the safe operations of the USNS JOHN LENTHALL (T-AO 189).

r. WI 606, Annual, Lifeboats Inspections & Service (ABS) suppliers of approved repair parts and to service their equipment. Proper refurbishment and maintenance of lifeboats is critical to the safe operation of the USNS JOHN LENTHALL (T-AO 189).

s. WI 653, Annual RHIB/ Rescue Boat/ Fast Rescue Boat Inspection & Davit Inspection (ABS)

Willard Marine Inc. is the authorized vendor and suppliers of approved repair parts and services to their equipment. Proper refurbishment and maintenance of the rescue boats is critical to the safe operation of the USNS JOHN LENTHALL (T-AO 189).

Factory authorized suppliers provide parts and technical data/drawings from the original manufacturer as required by USCG and ABS regulations. This maintains all OEM warranties, ensures equipment reliability, and crew safety therefore precluding consideration of a product manufactured by another company. SMS number 10.6-002-ALL lists the rescue boats as critical equipment. Failure of the rescue boats is a major loss in safety and lifesaving equipment required for the vessel to get underway for vessel operations.

s Palfinger. Palfinger is the OEM authorized vendor and supplier of approved repair parts and services. Proper refurbishment and maintenance of STBD Rescue Boat Davits is critical to the safe operation of the USNS JOHN LENTHALL (T-AO 189).

Factory authorized suppliers provide parts and technical data/drawings from the original manufacturer as required by USCG and ABS regulations. This maintains all OEM warranties, ensures equipment reliability, and crew safety, therefore precluding consideration of a product manufactured by another company. 6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable: The Government intends to post a synopsis and a Request for Proposal (RFP) at the Government Point of Entry, FedBizOpps website, with the intent of awarding a firm-fixed-price contract to the lowest price offeror. Any prospective contractor will be required to use the OEM or OEM authorized vendor(s) as a subcontractor to perform the work in the related WIs.

7. Determination of Fair and Reasonable Cost: The Contracting Officer will determine the anticipated cost to the Government of the supplies/services covered by this J&A will be fair and reasonable in accordance with FAR Part 15.

8. Market Research: The USNS JOHN LENTHALL (T-AO 189) is home ported on the east coast and therefore considered an east coast asset. All non-emergent vessel repairs are required to be conducted on the east or gulf last three (3) vessel repair availabilities. The following contracts were identified: N3220518C4006, N3220517C4006, and N3220516C4006. In researching this information, it was discovered that previous USNS procurements were solicited and awarded as 100% small business set-asides under NAICS code 336611 with a standard business size of 1,000 employees.

9. A Listing of the Sources, if any that expressed, in writing, an interest in the Acquisition: To date, no sources have expressed an interest in performing the requirements of the aforementioned WIs.

10. Actions to Removed Barriers to Future Competition. For reasons set forth in Paragraph 5, MSC has no plans at this time to allow prime contractors to solicit these requirements competitively, other than synopsizing the requirements. If another potential source emerges, MSC Norfolk will assess whether competition for future requirements is feasible.
