JUSTIFICATION AND APPROVAL (J&A)

FOR USE OF OTHER THAN FULL AND OPEN COMPETITION

1.

Contracting Activity:

Department of the Navy, Military Sealift Command (MSC), Norfolk.

2.

Description of the Action Being Approved:

This contract action is for the modification of an existing contract on a sole source basis to Homewood Suites by Hilton North Charleston to extend lodging services in Charleston, SC in support of ship repair services for the USNS SACAGAWEA.

3.

Description of the Supplies/Services:

The contractor shall provide single occupancy extended stay hotel rooms for the MSC Civil Service Mariners (CIVMAR), assigned to the USNS SACAGAWEA during the vessel’s repair period in Charleston, SC. The contractor shall provide 42 single occupancy rooms for the period of twelve (12) days from 3 February 2020 to 14 February 2020 / 15 February 2020 check out. Funding for this procurement is being provided in the amount of $59,976.00.

Additionally, one (1) ten day option period will be added to extend lodging services from 15 February 2020 – 24 February 2020 / 25 February 2020 check-out (42 rooms x 10 nights

= 420 room nights.

4. Statutory Authority Permitting Other Than Full and Open Competition:

FAR 6.302-1 - Only one responsible source and no other supplies or services will satisfy agency requirements.

5. Rationale Justifying Use of Cited Statutory Authority:

In accordance with FAR 6.302-1(a)(2), full and open competition need not be provided for when services are available from only one or a limited number of responsible sources, and no other type of services will satisfy agency requirements. This requirement supports the use of the authority cited in 10 U.S.C. 2304 (c)(1) because only Homewood Suites by Hilton North Charleston, LLC can perform the services described herein within the required timeframe. Re-competing this requirement would result in unacceptable delays involved with the solicitation, evaluation and award of a new requirement. Furthermore, a new contract could require the USNS SACAGAWEA CIVMARs to move from the existing lodging facility to another lodging facility, which could delay repairs and possibly delay the ship’s repair schedule.

Description of Efforts Made to Solicit Offers from as Many Potential Sources as Practicable:

The Contracting Officer intends to post a redacted copy of this J&A for this proposed contract action on the FBO website in accordance with FAR 5.203(a). Market research was conducted to confirm that prices under the current contract are still considered fair and reasonable and that it would be unlikely that MSC would obtain a better rate as a result of re-competing this requirement.

7.

Determination of Fair and Reasonable Cost:

In accordance with 6.303-2(a)(7), the Contracting Officer has determined that the anticipated cost to the Government of the supplies/services covered by this J&A will be fair and reasonable.

8.

Actions to Remove Barriers to Future Competition:

It is expected that the requirements described herein will not exceed the 24 February 2020 end date for the option period. Future lodging requirements will continue to be competed in accordance with agency procedures.
