J&A No. N10419Q4534
January 07, 2019
JUSTIFICATION AND APPROVAL
FOR OTHER THAN FULL AND OPEN COMPETITION
LIMITED SOURCES
1. Contracting Activity: Department of the Navy, Military Sealift Command
(MSC), Norfolk, VA.
2. Nature of Action: Award of a purchase order to Appleton Marine Inc.
(Appleton) on a Sole Source basis for installed Cargo Cranes aboard USNS
WALLY SCHIRRA(T-AKE 8), with a Period Of Performance of 12 June 2019 to 25
August 2019.
3. Description of Supplies/Services: MSC has a requirement to provide Navy fleet support for combat logistics and repair and maintenance of shipboard cranes onboard MSC Vessels to continue ensure safe and reliable operation of
MSC ships in support of mission. Accordingly, the actions executed under this
J&A have an estimated value of approximately $502,256.00
4. Statutory Authority Permitting Other than Full and Open: The statutory authority for this procurement is Section 4202 of the Clinger-Cohen Act of
1996 as implemented by FAR 13.501.
5. Rationale Justifying Use of Cited Statutory Authority: Appleton is the
Original Equipment Manufacturer (OEM) of the Cargo Electro-Hydraulic Extend
Boom Cranes, model EB270-87-47. Proper knowledge and skill from the OEM is required to satisfactorily maintain and repair the Cranes to minimize the downtime and maximize operational ability, and to decrease the danger from faulty weapon/ammunition handling equipment. Any deviations from OEM diagnosis, repairs, or tests of such equipment could result in personal injury or equipment failure, vessel damage, and security breaches. MSC does not have manufacturing and technical information required to evaluate and determine whether non-OEM service and replacement parts offered are equivalent to the OEM components and replacement parts. T-AKE Electro-
Hydraulic Boom Cranes require special technical expertise unique to these systems; only the OEM is authorized to work on the highly sophisticated equipment. The OEM has access to provide parts and technical data/drawings/service as required by U.S. Coast Guard and American Bureau of
Shipping certification for maintenance.
6. Description of Efforts made To Solicit Offers from as Many Offerors as
Practicable: The Contracting Officer will continue to synopsize and solicit each requirement in FEDBIZOPPS, unless there is an urgent and compelling need for the service and/or parts. In that case, a procurement-specific J&A for unusual and compelling urgency will be executed and included in the file.
7. Contracting Officer’s Determination of Fair and Reasonable Price: The
Contracting Officer will determine that the price is fair and reasonable pursuant to Federal Acquisition Regulations (FAR) Part 13.106-3.
8. Actions To Remove Barriers to Future Competition: No specific action is planned to overcome barriers to competition in subsequent procurements, other than synopsizing the requirements. If another potential source emerges, MSC
Norfolk will assess whether competition for future requirements is feasible.
