J&A. N3220518P4683

1. Contracting Activity: Department of the Navy, Military Sealift Command (MSC) - Norfolk.
2. Nature of Action: This is a justification and approval (J&A) for the use of other than full and open competition that will result in a firm fix price contract to the Original Equipment Manufacturer (OEM)
Falk in support of the USNS CATAWBA (T-ATF 168).
3. Description of Supplies/Services: MSC Norfolk requires an OEM authorized technical field service representatives and OEM parts to accomplish the requirements of WIs listed below. The estimated dollar value of the contract is which will be funded utilizing FY 19 Operation & Maintenance funds.
4. Statutory Authority Permitting Other Than Full and Open Competition: 10 U.S.C 2304 (c) (1), Only
One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements, as implemented by FAR 6.302-1(a).
5. Rationale Justifying Use of Cited Authority: Falk is the OEM for the vessel’s propulsion reduction gear system onboard the USNS CATAWBA. Marine Systems Inc. is the only Authorized Technical
Representation who is able to perform work on Falk Equipment in accordance with Falk guidance during the period of performance. This system is critical to ship maneuverability and operation, SMS CRITICAL
EQUIPMENT – 10.6-002-01-ATF applies. During the course of the vessel’s October FY19 Voyage Repair
Availability (VRA) this system will be secured and isolated for servicing and repairs for approximately 21 days. At the end of the October FY19 VRA the system will be returned to full operation for dock trials, USCG/ABS inspection and testing, and sea trials. The system must be serviced and repaired to the satisfaction of the attending ABS/USCG representatives in order to receive renewal of the vessel’s USCG
Certificate of Inspection (COI) and completion of ABS statutory surveys. If the system is not serviced and brought back to the original design criteria, the vessel will lose its COI and ABS accreditations, causing a
C4 CASREP, stopping all mission operations. Falk as the OEM for the propulsion system has access to proprietary information, data and OEM materials required to accomplish the required system servicing and to validate that the system responses are within the original OEM design parameters.
6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable: The government intends to synopsize and post a request for quotation at the government point of entry, FedBizOpps website, on a sole source, name brand basis, with the intent of awarding a firm-fixed price contract.

8. Actions to Removed Barriers to Future Competition. For reasons set forth in Paragraph 5, MSC has no plans at this time to compete future contracts for the types of services covered by this document. If another potential source emerges, MSC will assess whether competition for future requirements is feasible.
