DIRECTOR

MILITARY SEALIFT COMMAND

SP64 471 EAST C STREET

NORFOLK, VA 23511-2419

N104-18-Q-4154

JUSTIFICATION AND APPRQVAL (J&A) FOR OTHER THAN FULL AND OPEN

COMPETITION

1. Contracting Activity: Department of the Navy, Military Sealift Command (MSC) Norfolk, VA 23511-2419.

2. Nature of Action: MSC Norfolk has a requirement to award a contract on a sole source basis to FLIR Surveillance, Inc., the Original Equipment Manufacturer (OEM) for the Forward Looking Infrared (FLIR) Star Safire III Camera system as a sole source buy for USNS CITY OF BISMARCK (T - EP F 9) .

3. Description of Supplies/Services: Provide the shore based spare parts as listed. Based on market research, these parts have a lead delivery time of 10 weeks . The estimated value for all the parts listed and shipping is $590,000.00. Funding has been provided via Purchase Requisition N297928005SB14 from

PM8.

• P/N 3290003-321 Stabilized Turret FLIR Unit(TFU): (MWIR)Infrared imager 640x512 Detector, Operator Manual, Color: Grey, Video Format: NTSC – 1 Each

• P/N 3203134-321 Central Electronics Unit(CEU): Automatic Video

Tracker(AVT)- 1 Each

• P/N 3204853-4 Universal Hand Control Unit (UHCU)-1 Each

4. Statutory Authority: The statutory authority for this sole source procurement is Section 4202 of the Clinger- Cohen Act of 1996 as implemented by the test program for commercial items, Federal Acquisition Regulations (FAR) 13.501.

5. Rationale Supporting Use of Authority Cited Above: The Expeditionary Fast Transport (EPF) Class ship is built with a FLIR c amera system f or na v igation, secu r ity and safety d uring tr ansit . All control systems, electronics, foundation, hardware and software for the system are built specifically for the FLIR Star Safire III Camera system. If any other camera system were procured, it would result in an extensive re-design of the foundation structure, bridg e inte rfac e, n av igati on s yste m, secur ity requ ir ement s an d sa fe ty pr oced ures of the EPF class. The hardware, software, bridge integration and structural design would need to be completely re-configured at an unacceptable cost. This requirement is mission-critical and personnel safety-critical to maintain class configuration and interchangeability across the ship class. Any deviation from the OEM parts could result in personal injury, loss of life, or equipment failure and possible damage to personnel and to loss of vessel night time and daytime navigation and maneuvering capability. M a i n t a i n i n g a s t a n d a r d i z e d F L I R cam er a s y s t e m c o n f i g u r a t i o n across the EPF class will ensurerequired reliability and effectiveness of the navigation system as required by the ship’s mission requirements, American Bureau of Shipping (ABS), and High-Speed Craft (HSC) and Safety of Life at Sea (SOLAS) regulations.

MSC does not have manufacturing and technical information required to evaluate and determine whether non-OEM components and replacement parts offered are equivalent to the OEM components and replacement parts. This is proprietary information and the Government did not acquire rights in this data. OEM representatives have access to provide parts and technical data drawings from the original manufacturer, as required to properly repair and maintain the equipment. All OEM repair parts are in compliance with United Sta tes Co ast G uard ( USCG) and ABS International M aritime Organiz ation ( IMO) regulatory requirements.

Procurement will provide sufficient assets to provide Ready for Issue (RFI) support of the EPF program. The mission of EPF vessels to provide sealift in austere ports is dependent on the proper operation of the FLIR camera system. This critical e q u i p m e n t must have repair parts readily available when required by the Ship Management Team (SMT) for immediate installation.

6. Description of Efforts Made to So1icit Offers from as Many Potentia1 Sources as Practica1: The Contracting Officer will continue to synopsize and solicit each requirement in FEDBIZOPPS, unless there is an urgent and compelling need for the service and/or parts. In that case, a procurement-specific J&A for unusual and compelling urgency will be executed and included in the file.

7. Contracting 0fficer's Determination of Fair and Reasonable Price. The Contracting officer will determine that the price is fair and reasonable pursuant to FAR Part 13.106-3(a)(2)or 15.404-1 as appropriate.

8. Actions to Remove Barriers to Future Competition:

No specific action is planned to overcome barriers to competition in subsequent procurements, other than synopsizing the requirements. If another potential source emerges, MSC will assess whether competition for future requirements is feasible.
