JUSTIFICATION AND APPROVAL (J&A)

FOR OTHER THAN FULL AND OPEN COMPETITION – BRAND NAME

1. Contracting Activity:

Department of the Navy Military Sealift Command (MSC) Norfolk, VA

2. Description of the Action Being Approved:

Award of a firm-fixed-price(FFP) type purchase order (PO) to procure brand-name materials in support of the establishment of the Mobile Communications Program.

3. Description of Supplies:

The parts/equipment being procured are required to facilitate an unclassified and classified communications package which is highly mobile to worldwide locations which facilitates established infrastructure or in austere locations. To maintain system integrity and continuity of services, the following brand name parts will be procured from either the Original Equipment Manufacturers (OEM) or their authorized parts and service representatives:

4. Statutory Authority Permitting Other Than Full and Open Competition: The statutory authority that permit contracting without providing for full and open competition is Title 10 U.S.C. § 2304(c)(1), One source or limited sources. The regulatory authority, specific to the Federal Acquisition Regulation (FAR), is FAR 6.302-1(c).

5. Rationale Justifying Use of Cited Authority:

a) Klas Telecom and Tampa Microwave are the manufacturers of parts/equipment which are required to continue the ongoing effort of building the Mobile Communications Program (MCP) communication’s platform. MSC is required by DoD to maintain vendor support on all COTS software and hardware. The MCP will use Sustainment Communication Packages and the performance, size limitations and mobility of the Tampa Microwave 1.3Meter Satellite Terminal meets all requirement factors for the MSC MCP mission. Tampa Microwave owns the proprietary rights to the drawings and procurement of the part/equipment is only available through approved sellers. The MCP will use Klas Voyager ECKs for its flyaway communications kit and Klas Voyager 2 which is only a slight variation in equipment form factor to meet mission requirements and standardize the equipment set within the program. The MCP previously purchased four (4) Voyager ECKs during FY17 and in an effort to minimize total cost of ownership the N613 seeks to standardize the equipment set within the program. KLAS Telecom owns the proprietary rights to the drawings and procurement of the part/equipment is only available through approved sellers.

b) MSC is required by DoD to maintain and upgrade their IT network infrastructure. An ongoing effort to reach the security accreditation package and obtain Risk Management Foundation (RMF) Type Authorization to Operate (ATO) includes Klas Telecom and Tampa Microwave products.

Changing to a like brand would incur additional cost to the government, the most significant of which would be re-engineering of the network and rewriting the Risk Management Foundation pacakage and Standard Operating Procedures to show the new hardware.

c) MSC’s Mobile Communication Program utilizes the DISN Enterprise Classified Travel Kit

Gateway (DECTK-GW) to establish the network infrastructure. This service provided by Defense Information Service Agency (DISA) requires all products which reside to be on their approved products list. The purchase of these parts will align with previously purchased parts for the Mobile Communications Program.

6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable: Market research was conducted by querying government databases and contacting vendors to confirming the viability of sources that could provide the parts/equipment required. The query produced multiple sources, and as such the Government will solicit through www.fbo.gov, with the anticipation of responses from several vendors that can provide the brand name parts specified in this document.

7. Determination of Fair and Reasonable Cost: The Contracting Officer has determined the anticipated price for the supplies will be fair and reasonable.

8. Actions to Remove Barriers to Future Competition: For the reasons set forth in Paragraph 5, MSC has no plans at this time to compete future contracts for different brands of equipment/parts covered by this document. MSC has made a significant investment in Klas Telecom products other solutions would add severe complexity to the implementation plan. If another potential source emerges, MSC will assess whether a competition expanding the brand limitation for future requirements is feasible.
