J&A Control Number: N104-Geislinger
CLASS JUSTIFICATION AND AUTHORIZATION (J&A) FOR
OTHER THAN FULL AND OPEN COMPETITION
1. Contracting Activity: Department of the Navy, Military Sealift Command, (MSC) Virginia 23511.
2. Description of Action Being Approved: Award of contracts on a source basis for the acquisition of Main Engine Coupling and Geislinger Flexible Link parts for T-AO KAISER class vessels from Geislinger Original Equipment Manufacturer (OEM) . All procurements under this justification and authorization will be " ". The authority to act under this class justification expires on 2018.
3. Description of the Supplies/Services: MSC has a requirement to procure OEM certified parts. MSC normally acquires these as long lead time repair components and provides them as Government Furnished Material (GFM) for installation during regularly scheduled ship repair availabilities.
Accordingly, the actions executed under this class J&A have an estimated value of approximately using FY 2018 United States Navy Working Capital Funds (NWCF).
4. Statutory Authority Permitting Other Full and Open Competition: The statutory authority permitting othe than full and open competition for FAR subpart 13.5 requirements is 41 U.S.C. § 1901.
5. Rationale Justifying Use of Cited Statutory Authority: Use of the authority cited in FAR Subpart 13.5, specifically FAR 13.501(a), is appropriate for this acquisition as this subpart authorizes use of Simplified Acquisition Procedures (SAP) for acquisition of parts or services greater than the Simplified Acquisition Threshold (SAT) and not exceeding . In accordance with (IAW) FAR 13.501(a)
(2) (ii), the estimated class value for contracts to be executed under the authority of this J&A exceeds but does not exceed the million threshold. The MSC competition ad v o c a t e , designated pursuant to FAR 6.501, must approve the J&A.
Geislinger is the authorized manufacturer/distributer and the only authorized source to ensure fit, form, function, and quality of the Main Engine Coupling and Geislinger Flexible Link (GFL). The engineering, construction, proprietary drawings, and technical characteristics for the complete documentation package are proprietary to Geislinger. Only OEM repair parts can be guaranteed to fit and perform as designed for the ship’s starboard main engine coupling. This critical system must receive parts that are a one for one direct replacement to ensure high quality performance. No other manufacturer is able to serve the required needs .
The procurement of other than OEM-Certified Components could result in catastrophic damage to these critical components. Loss of Main Engine Couplings would result in loss of propulsion and mission readiness. The Main Engine Coupling requires OEM replacement. Using Non-OEM parts could result in lossof warranty, damage to equipment, and injury to crew. Main Engine Couplings rotate at a very high revolutions per minute (RPM). Catastrophic failure of the couplings wouldresult in severe damage to the ship and possible loss of life. Factoryauthorized suppliers provide parts and technical data/ drawings fromthe original manufacturer as required by USCG and ABS regulations. Thismaintains all OEM warranties, ensures equipment reliability, and crew safety therefore precluding consideration of a product manufactured by another company.
In accordance with the MSC Safety Management Systems procedure 10.6-002-AO, the main propulsion and Power Take Off (PTO) couplings are categorized as critical ship equipment. Critical Ship Equipment is
J&A Control Number: N104-Geislinger defined as equipment and systems that are necessary to sustain the proper operation and mission capability of the ship. Failure of these equipment and systems would pose a hazard to the ship, its crew, or the environment. This technical risk can be broken down into three subparts: potential for disruption to the ship's mission support operation schedule; potential for degradation in performance through a partial or complete failure of the component; potential to cause harm to the crew or the environment. The systems to be maintained and repaired under this contract are vital contributors to the operations of the vessels. The procurement of other than OEM components in these systems could result in catastrophic damage to these critical propulsion and steering systems and loss of us of the vessel for its intended mission.
MSC does not possess or have the data rights to the manufacturing drawings and processes, OEM specifications, material tolerances, and other technical data pertaining to the parts, and is unable to purchase the data rights due to proprietary reasons. Accordingly, the manufacturing, special tools, and equipment required to manufacture the parts used for the OEM parts is not known to MSC. MSC does not have the manufacturing and technical information required to reverse engineer nor manufacture the parts, and procuring alternative replacement parts will compromise the required reliability and effectiveness of the Couplings installed on the T-AO Class ships.
6. Description of Efforts made to Solicit Offers from as Many Offers as Practicable: The Government intends to post a synopsis and a Request for Proposal(RFP) at the Government Point of Entry, FedBizOpps website, each time parts are needed, with the intent of awarding a firm-fixed-price contract to the lowest price, technically acceptable offeror.
7. Determination of Fair and Reasonable Cost: The Contracting Officer will determine that the price is fair and reasonable pursuant to FederalAcquisition Regulations (FAR) Part 13.109-3(a).
8. Market Research: A sources sought (SS) notice was posted on the FBO website on 6 April 2017 and closed on 20 April 2017. The SS respondents were required to demonstratethe abilityto provide the requested items or alternative solutions that are compatible with the existing Geislinger Coupling
No responses were received to date in response to this notice. The engineering, drawings, and technical characteristics of the parts are proprietary to Geislinger, and therefore not available to other firms.
9. A Listing of the Sources, if any, that Expressed, in writing, an Interest in the Acquisition:
10. Actions to Remove Barriers to Future Competition: For the reasons set forth in Paragraph 5, MSC has no plans at this time to compete future contracts for the type of services covered by this document. If another potential source emerges, MSC will assess whether competition for future requirements is feasible. Future requirements for Geislinger repair parts will be advertised in FederalBusiness Opportunities.
