JUSTIFICATION AND APPRQVAL (J&A)
FOR OTHER THAN FULL AND OPEN COMPETITION – SOLE SOURCE
1. Contracting Activity: Department of the Navy, Military Sealift Command (MSC), Norfolk, VA 23511-2419.

4. Statutory Authority: The Statutory Authority for this commercial procurement is 41 U.S.C. 1901(e)(2) as implemented by FAR Part 13.501(a)Sole Source.
5. Rationale Supporting Use of Authority Cited Above: The Sea Cable Plow is critical to the overall USNS ZEUS mission. The parts used during the repair of the SCP-1 must be OEM certified and approved by NAVSEA. A2Sea is the only qualified supplier/agent of the Original Equipment Manufacturer (OEM) of the Sea Cable Plow. A2Sea is the only known source to have proprietary information and historic operating parameters relating to the repair of this equipment. The use of non- OEM parts will jeopardize the safety of personnel operating the equipment and the reliability of the Sea Cable Plow to accomplish its mission.
MSC does not have manufacturing and technical information required to evaluate and determine whether non-OEM components and replacement parts offered are equivalent to the OEM components and replacement parts. This is proprietary information and the Government did not acquire rights in this data. OEM representatives have access to provide parts and technical data and drawings from the OEM, as
J&A Control Number: N104-16-T-4504 Requisition Number: N322096067U006
For Official Use Only required to properly repair and maintain the equipment. All OEM repair parts are in compliance with USCG and ABS IMO regulatory requirements.
6. Description of Efforts Made to So1icit Offers from as Many Potentia1 Sources as Practica1: The Contracting Officer will continue to synopsize each requirement in FEDBIZOPPS, unless there is an urgent and compelling need for the service and/or parts. In that case, a procurement-specific J&A for unusual and compelling urgency will be executed and included in the file.
7. Contracting 0fficer's Determination of Fair and Reasonable Price. The Contracting officer will determine that the price is fair and reasonable pursuant to FAR Part 13.106-3(a)(2).
8. Actions to Remove Barriers to Future Competition: No action is planned to overcome barriers to competition in subsequent OEM procurements other than synopsizing the requirements. The OEM parts are mission critical and use of other than OEM parts adds a high risk to the operational capability and has the potential of causing the SCP-1 to become non-operational.
