J&A Control Number: N104-16-R-4005

For Official Use Only

JUSTIFICATION AND APPROVAL (J&A)

FOR USE OF OTHER THAN FULL AND OPEN COMPETITION

1. Contracting Activity: The United States (US) Department of the Navy (DON), Military Sealift Command (MSC) – Norfolk contracting agency, Virginia 23511.

2. Description of the Action Being Approved: This is a brand name justification for work to be provided under

Work Items (WIs) 201, 202, 305, 401, 402, 403,404, 405, 408, 502, 504, 505, 506, 507, 508, 607, 608, 609, 610, 611, 613, and 615 of the Statement of Work (SOW) for the Mid-Term Availability (MTA) of the United States Navy Ship (USNS) GUADALUPE (T-AO 200) under Request for Proposal (RFP) N32205-16-R-4005.

This justification is covering only a portion of the overall acquisition, which an Original Equipment Manufacturer (OEM) authorized facility, manufacturer, and/or representative is required, and the approval level requirements will then only apply to that portion.

3. Description of Supplies/Services: MSC – Norfolk requires OEM authorized technical field service representatives and OEM parts to accomplish the requirements of WIs identified in paragraph 2 for 43 days MTA schedule. The total estimated value of the proposed 22 WIs is and will be funded utilizing Fiscal Year (FY) 2016 Operations & Maintenance, Navy (O&MN) funds.

4. Statutory Authority Permitting Other Than Full and Open Competition: Title 10 United States Code (USC) 2304 (c)(1), Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements, as implemented by the Federal Acquisition Regulation (FAR) 6.302-1(a).

5. Rationale Justifying Use of Cited Authority:

a. WI 201, Main Engine Injector Overhaul

The Original Equipment Manufacturer (OEM) for the main fuel injectors is MAN Diesel. There are only two licensed US authorized distributors and service centers, Fairbanks Morse Engines (FME) under licensing agreement, and Motor Services Hugo Stamp (MSHS) as a MAN Diesel SA authorized distributor and service center. Only FME and MSHS are capable of meeting the stringent Quality Assurance (QA) requirements and are certified by the OEM for same. The fuel injectors are required for engine operation. The engineering construction, drawing and technical characteristics for the manufacturer of parts for these propulsion engines are proprietary to MAN diesel SAS-SEMT Pielstick.

The SMS number 10.6-002-ALL lists the main engines as critical equipment. Failure of one main engine will force the ship to reduce speed. The loss of two main engines puts the ship in a C-4 status, thus becoming unable to perform its primary mission of providing underway replenishment services to the fleet. The reduction in speed can also pose a hazard to the crew, due to limited ship maneuverability. Proper refurbishment and maintenance of the main engines are critical to the safe operations of the USNS GUADALUPE (T-AO 200).

b. WI 202, Port Main Engine Clutch Coupling Overhaul

Geislinger is the OEM for the main engine coupling and flexible link. Geislinger and its authorized manufacturers’ representatives and distributors are authorized sources to ensure fit, form, function, and quality of the main engine coupling and flexible link. Eaton and its authorized manufacturers and distributers are the only authorized sources to ensure fit, form, function, and quality of the main engine clutch. Both can supply parts for the clutch coupling. The engineering, construction, proprietary drawings, and technical characteristics for the complete documentation package are proprietary to both Geislinger and Eaton. Only OEM repair parts can be guaranteed to fit and perform as designed for the ship’s port main engine coupling and clutch. This critical system must receive parts that are a one for one direct replacement to ensure high quality performance. No other manufacturers are able to serve the required needs. The procurement of other than OEM certified components could result in catastrophic damage to these critical components. Loss of main engine couplings would result in loss of propulsion and mission readiness. The main engine couplings requires OEM replacement parts.

Using non OEM parts could result in loss of warranty, damage to equipment, and injury to crew. Main engine couplings rotate at a very high Revolutions per Minute (RPM). Catastrophic failure of the couplings would result in severe damage to ship and possible loss of life.

The Safety Management Systems (SMS) number 10.6-002-ALL lists the main engines as critical equipment. Proper refurbishment and maintenance of the main engine clutch coupling is critical to the safe operations of the USNS GUADALUPE (T-AO 200).

c. WI 305, Power Take Off (PTO) Groom

The OEM for the vessel’s PTO generator and synchronous compensators is Siemens. RYNO Enterprises, Marine Automation is an authorized vendor of Siemens for repair parts and service for their equipment. Proper refurbishment and maintenance of the PTO and Sync Compensator are critical to the safe operation of the Electrical Generation equipment onboard USNS GUADALUPE (T-AO 200). Factory authorized suppliers provide parts and proprietary technical data/drawings only available from the original manufacturer authorized vendors. This maintains all OEM warranties, ensures equipment reliability, and crew safety therefore precluding consideration of a product manufactured by another company.

The SMS number 10.6-002-01-AO lists the PTO’s as critical equipment. Failure of the PTO’s will severely impede the ships ability to generate electrical power and degrade mission capabilities. Proper refurbishment and maintenance of the PTO’s are critical to the safe operations of the USNS

This maintains all OEM warranties, ensures equipment reliability, and crew safety therefore precluding consideration of a product manufactured by another company.

The SMS number 10.6-002-ALL lists the radar as critical equipment. Loss of RADAR would essentially leave the vessel blinded during any condition that impairs the human visual or over the horizon detection of obstacles /threats. Without the RADAR systems fully operational this would leave the vessel in a no sail situation. Proper refurbishment and maintenance of the radar ECDIS is critical to the safe operations of the USNS GUADALUPE (T-AO 200).

g. WI 404, Magnetic Compass Annual

The OEM for the equipment is Baker Lyman & Company. A manufacturer’s representative is required to provide proper performance certification. This is the only non electronic means available for determining ships heading and must be certified accurate and available for the vessel during navigation for safe passage. This is a USCG requirement.

The SMS number 10.6-002-ALL lists the magnetic compass as critical eequipment. Failure of the magnetic compass will severely impede the ships ability to navigate and maneuver the vessel. The reduction of the ability to navigate and maneuver the vessel will also pose a hazard to the crew. Proper refurbishment and maintenance of the magnetic compass is critical to the safe operations of the USNS

GUADALUPE (T-AO 200).
