QUESTIONS AND ANSWERS #2

The following are answers to questions received from potential offerors. The answers provide clarification only and DO NOT constitute an amendment to the solicitation.

1. Can you please provide the insurance schedule that the current contract holder is operating under?

Answer: We cannot provide this information.

2. The insurance limits listed in the RFP are very onerous and appear to be beyond the scope of the intended work. The coverage requested ($350,000,000) seems excessive and the Government’s requirement would entail being a member of one of the mutual clubs. This is beyond most small businesses' capabilities and I do not believe the current contract holder is meeting this requirement. Can you provide more detail?

Answer: The government requirement for $350,000,000 remains as is. It is a level of coverage that protects all parties involved and represents a reasonable approach given the myriad of things that could happen involving the vessel under Government charter.

3. I am reviewing the solicitation requirements and am looking at Section 9 Information Assurance of the Performance Work Statement. After a review of DFARS 252.204-7012 and the associated definitions of "Unclassified Controlled Technical Information,” I don’t think this applies to the Performance Work Statement. Is it mandatory that we develop an Information Security System, have it certified by a third party, obtain the certification and provided documentation as noted in para 9.1.1 and 9.1.1.1 of the solicitation?

Answer: Yes. During the course of operations there is a potential that the chartered vessel’s crew/systems may handle covered technical information (as defined in DFARS 252.204-2012). As such, the requirements of C-9 apply and contractors are expected to meet the requirements.
