MILITARY SEALIFT COMMAND NORFOLK

SP64 471 EAST C STREET

NORFOLK, VA 23511-2419

J&A No. N104-15-T-2251

JUSTIFICATION AND APPROVAL

FOR USE OF OTHER THAN FULL AND OPEN COMPETITION

1. Contracting Activity: Department of the Navy, Military Sealift Command Norfolk (MSC) Norfolk.

2. Description of Action Being Approved: MSC Norfolk has a requirement to award a firm-fixed price contract on a sole source basis to Carver Pump Company, the Original Equipment Manufacturer (OEM), for Fire Pump Assembly in support of Joint High Speed Vessels (JHSVs) Hulls 1-4.

3. Description of Supplies/Services: This requirement covers the procurement of three (3) Centrifugal Pumps and three (3) Motors to be assembled as unit packaged for long term storage in a non-climate controlled warehouse and a forth motor shall be packaged single. All packaging shall ensure protection against corrosion, deterioration, physical and electrical damage. Outside markings on packaging container need to include part number, serial number and MFG Date for all pumps and motors along with the part number and serial number, if applicable, for the entire assembly. Based on market research, required parts have a long lead delivery time of 24 weeks.

4. Statutory Authority Permitting Other Than Full and Open Competition: The statutory for this procurement is section 4202 of the Clinger Cohen Act of 1996, as implemented by FAR

13.5 – Test Program for Certain Commercial Items. Section 815 of the National Defense Authorization Act of FY 2015 made this authority permanent.

5. Rationale Justifying Use of Cited Statutory Authority: The JHSV Class ship is furnished with the commercially available Carver Pump Company Fire Pump Assembly Model 6X4X13. This system is MSC JHSV Critical Equipment. All components/hardware and structural support for the system built specifically for the Fire Pump Assembly Model 6X4X13 require OEM parts to maintain the integrity of the Pump. Assembling the engine with any other components would result in a multi-year re-design of the structural elements of the JHSVs. Class hardware and structural design would need to be completely re-configured at an unacceptable cost to MSC. It is mission-critical and personnel safety-critical to maintain class configuration and interchangeability across the ship class. Any deviation from the OEM parts could result in personal injury, loss of life, or equipment failure and or damage to the installed Fire Fighting System. Use of the Carver Pump Company Fire Pump Assembly will provide fit, form and function of the Fire Pump Assembly across the class and will ensure required reliability and effectiveness of the Fire Pump Assembly as required by ABS and Safety of Life at Sea (SOLAS) regulation. The manufacturer’s business practice is to provide the Fire Pump Assembly directly to installing shipyards, ship owners and operators in the United States. Carver

Pump Company reserves the right not to go through third-party vendors from its company headquarters and manufacturing in Muscatine, Iowa.

MSC does not have the manufacturing and technical information required to evaluate and determine whether non-OEM components and replacement parts offered are equivalent to the OEM components and replacement parts. Carver Pump Company maintains all proprietary information, technical data, drawings and access to parts as required to properly repair and maintain the equipment. All OEM repair parts are in compliance with USCG and ABS IMO regulatory requirements. Procurement of Fire Pumps from the OEM is critical to the safe operations of JHSVs and for the safety of the crew.

6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable: Carver Pump Company, as the OEM, has access to business sensitive drawings and technical data concerning JHSV Class of ships. The Government intends to synopsize as a sole source procurement at the Government Point of Entry, FedBizOpps website, with the intent of awarding a firm-fixed-price contract to Carver Pump Company.

7. Determination of Fair and Reasonable Cost: The Contracting Officer will determine that the price is fair and reasonable pursuant to Federal Acquisition Regulations (FAR) Part 13.106-3.

8. Actions to Remove Barriers to Future Competition: Procurement will provide sufficient assets to provide Ready-for-Issue (RFI) support of the JHSV program. JHSV vessels are scheduled for annual ROHs and these critical propulsion related items must be available when required by the Ship Management Team (SMT) for immediate installation. If another potential source emerges, MSC Norfolk will assess at that time whether competition for future requirements is feasible.
