4. Statutory Authority: The authority permitting other than full and open competition is as implemented by Federal Regulations (FAR) 13.501(a) under the test program for commercial items.

5. Rationale Justifying Use of Cited Authority:

There are currently twelve (12) active T-AOs in the fleet with two (2) each ROLLS ROYCE SSDG's Model KVGB-16. ROLLS ROYCE is the original equipment manufacturer (OEM) for the SSDGs onboard the T AO vessels. The engineering, construction, drawings and technical characteristics for the manufacturer of parts for these engines are proprietary to Rolls Royce North America, Inc.

Rolls Royce North America, Inc Headquarters is situated at their facility located at 200 JAMES DR. WEST, ST ROSE, LA 70087 Point of contact is Dennis Brennen, Rolls Royce Bergen, Sales. Only Rolls Royce North America, Inc has the capable of meeting the stringent Quality Assurance requirements for these parts.

Consequently, only OEM parts or OEM certified technicians can provide the essential support to the Government's requirement. The procurement of other than OEM components could result in catastrophic damage to these critical propulsion components and loss of use of the vessel for its intended mission.

6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable: In accordance with FAR 5.201(B)(1), the Government intends to issue a synopsis and solicitation on FEDBIZOPPS on a sole source basis for each USNS LEROY GRUMMAN'S requirement. There is only one known resource for the required parts and/or service. The Contracting Officer therefore intends to solicit quotes for ships service generator parts and/or service from this source.

7.Determination of Fair and Reasonable Cost:TheContracting Officer willdeterminethatthepriceisfairandreasonable pursuant to Federal Acquisition Regulations (FAR) Part 13.106-3. The Contracting Officer hasdeterminedthe anticipatedcostto the Government of the supplies/services covered by this J&A will
befair and reasonable based upon FAR 15.404-1 (b) (2) (i) Comparisonof proposed prices received in response to the solicitation, and (ii) Comparison of previously proposed prices andprevious Government and commercial contract prices with current proposed prices.

8. Actions to Remove Barriers to Future Competition:

For the reasons set forth in Paragraph 5, MSC intends to award an Sole Source requirements type contract on a non- competitive basis to ROLLS ROYCE COMMERCIAL MARINE (RRCM) with a base period of one year and four 1-year option periods. For the reasons set forth in paragraph 5, MSC has no plans at this time to compete future contracts for the types of supplies/services covered by this document. If another potential source emerges, MSC will assess whether competition for future requirements is feasible.
