MILITARY SEALIFT COMMAND
471 EAST C STREET
NORFOLK VA 23511-2419
JUSTIFICATION AND APPROVAL
FOR USE OF OTHER THAN FULL AND OPEN COMPETITION
Upon the basis of the following justification, I, as Contracting Officer, hereby approve the use of other than full and open competition for the proposed contractual action pursuant to the action cited herein:
1. Contracting Activity: Military Sealift Command (MSC) Norfolk, Virginia 23511 intends to make a non-competitive procurement.
2. Description of the Action Being Approved: This action should result in a firm fixed price contract that will provide essential services while MSC undertakes corrective action in response to the GAO protest of the award of RFP No. N00033-14-R-8007. MSC will procure the services described below from the following Contractor: ONE FEDERAL SOLUTION.
3. Description of Supplies/Services: The requirement is to procure limited, essential
Administrative and Human Resource Support Services for various departments within MSC-
Norfolk and its sub - elements. These essential services represent only a portion of the fuller scope Administrative and Human Resource Support Services Solicitation No. RFP N00033-14-R-
8007, which the requiring code has determined are necessary for MSC to avoid mission failure.
The limited scope Administrative and Human Resource Support Services requirement consists of one (1) Program Manager, one (1) Deputy Program Manager, five (5) Medical Records Clerks, three (3) Administrative Assistants, one (1) Supply Technician, one (1) Personnel Assistant III, one (1) Personnel Assistant II, ten (10) General Clerks III, and fifteen (15) General Clerk IIs, for a total of thirty eight (38) contracted personnel. The contractor shall also provide two (2) vehicles to be used for designated personnel to pick up and deliver mail, make mission essential deliveries between facilities and any other mission essential daily activities. The vehicles shall not be used as a shuttle service to drive personnel to and from assigned working areas. These vehicles are to be used for mission essential daily functions only.

4. Statutory Authority Permitting Other Than Full and Open Competition: This contractual action is executed under the authority of 10 U.S.C. 2304 (c) as implemented by FAR 6.302-1, sole source procurement and FAR 6.302-2, unusual and compelling urgency.
5. Rationale Justifying Use of Cited Statutory Authority: The authority under FAR 6.302.2 applies when 1) an usual and compelling urgency precludes full and open competition; and 2) delay in award would result in serious injury, financial or other, to the Government.
As stated above, the purpose of this action is to enable MSC to perform essential operations while
MSC completes corrective action for the long-term competitive procurement for Administrative and Human Resource Support Services under RFP No. N00033-14-R-8007. The limited essential services of this action are needed in order for MSC to avoid mission failure. These services enable MSC to ensure that civilian mariners (CIVMARS) are ready to serve onboard MSC vessels to carry out missions vital to United States national security. They also will provide the minimum level of support necessary to enable MSC as a whole to function.
Without this support, MSC risks failure in the following areas:
- Manning MSC ships: without human resource support services, MSC will not be able to provide the medical records clearance support, drug testing support, required training support, and credential validation of CIVMAR eligibility for assignment. These operations are critical to maintaining the operational readiness of MSC ships worldwide.
Without proper credentials, medical clearance, and required training, CIVMARS cannot be cleared for ship assignments, which will result in mission failure when ships are not manned as necessary to meet mission requirements.
- Ship logistics and operations support: without contractor support, MSC risks communication failures that will disrupt fleet operations. Contractors provide time-sensitive administrative support in coordinating among MSC East and West Coast Port
Officers and five ship class Program Managers. This administrative support provides a critical direct link from MSC headquarters to the fleet that government employees are not able to maintain on their own.
- Command support: without the limited, essential administrative services support, MSC will face several risks:
MSC cannot function without a capable physical and personnel security system. Contractor support is necessary to ensure that MSC employees can access their MSC accounts in performance of their assigned duties.
Moreover, some security requests are extremely time-sensitive. Without contractor support, ship repair contractors and others may not be able to gain access to ships, which could result in a missed ship deployment.
MSC cannot function without its mailroom. MSC’s mailroom is completely contractor-operated, and MSC has no government employees trained in mailroom operations. Failure to support the mailroom will result in MSC’s inability to meet regulatory requirements in labor-employee relations, equal employment opportunity issues, and contracting. In addition, without courier services, MSC will be unable to receive CIVMAR medical documents, preventing CIVMARS from receiving the medical clearances they need to be eligible for assignment.
ONE FEDERAL SOLUTION is the only source that can provide these critical services immediately. ONE FEDERAL SOLUTION has provided Administrative and Human Resource
Support Services for MSC since 31 March 2015 and until a stop-work order was issued on 10
April 2015 in response to a GAO protest. During this brief period, ONE FEDERAL SOLUTION performed successfully. Only ONE FEDERAL SOLUTION currently has CAC badges, background checks, and security clearances completed, and has its employees currently permitted on naval property.
A limited procurement for this bridge contract is impracticable. A sole source contract allows
MSC to focus on the source selection process for the long-term competitive procurement for these services. Simultaneously running two source selections will result in unacceptable delay to the ultimate award in the open competition for all 8(a) small businesses under RFP No. N00033-14-
R-8007.
For the above reasons, it is in the best interest of the Government to issue a sole source contract to
ONE FEDERAL SOLUTION.
6. Description of Effort Made to Solicity Offers from as Many Offerors as Practicable.
There is not sufficient time to solicit offers from other sources for services to begin 11 May 2015.
This action allows time for the competitive follow-on solicitation to be completed, which will result in a competitive award.
7. Determination of Fair and Reasonable Cost. Prior to award, the Contracting Officer will ensure that the anticipated cost to the Government of the services covered by this J&A is fair and reasonable.
8. Actions to Remove Barriers to Future Competition. Open competition is provided under
RFP No. N00033-14-R-8007 for all 8(a) businesses. This action will allow time for a competitive award to be made under that RFP.
