About this file

This document is a Class Justification and Approval (J&A) for use of other than full and open competition, issued by the Department of the Navy, Military Sealift Command (MSC) Norfolk.

The J&A authorizes award modifications under contract N3220526C1231 to Detyens Shipyards LLC for the Regular Overhaul and Dry Docking of the USNS SUPPLY (T-AOE 6). The contract value is $31,378,288.00 and covers 156 work items with a performance period from May 4, 2026, through November 15, 2026. Funding is provided through fiscal year 2026 Operations and Maintenance, Navy (O&M,N) funds. The statutory authority for this non-competitive action is 10 U.S.C 3204(a)(2) for unusual and compelling urgency.

The justification identifies that U.S. Coast Guard and American Bureau of Shipping inspections conducted February 11 through March 11, 2026, revealed deficiencies requiring repair before vessel departure from the shipyard to comply with Safety Management System objectives and maintain vessel configuration. Competitive solicitation is deemed infeasible due to mission-ready timeline constraints, as the procurement and repair completion requires 381 days, with estimated daily losses to the Government of $274,000.00 per day of delay. The Government anticipates obtaining technical data packages and performance specifications to support future competition for similar acquisitions. A presolicitation notice was posted on sam.gov on July 17, 2025, and the award notice on March 13, 2026.
