About this file
This is a Class Justification and Approval (J&A) document for use of other than full and open competition in federal contracting.
The Department of the Navy, Military Sealift Command (MSC) Norfolk seeks to award contract modifications under existing contract N3220526C1207 to Detyens Shipyard, Inc., for the Mid-Term Availability of the USNS OSCAR V. PETERSON (T-AO 206). The original contract was competitively awarded on January 30, 2026, for $19,473,441.00, with a performance period of February 20, 2026, through May 18, 2026. The modifications cover work items necessary to comply with regulatory requirements imposed by the U.S. Navy, U.S. Coast Guard, and American Bureau of Shipping. The authority cited for bypassing full and open competition is 10 U.S.C. 3204(a)(2) for unusual and compelling urgency. The contracting activity justifies this approach based on corrective actions required to address deficiencies identified by regulatory bodies and vessel officers that must be completed before the ship can depart the shipyard. A competitive procurement is deemed infeasible due to an estimated 501-day lead time, which would result in approximately $6.5 million in additional costs at the established vessel per diem rate of $210,165. The current state of vessel disassembly presents an optimal cost-effective window for executing repairs. A presolicitation notice was posted on sam.gov on July 23, 2025. The Contracting Officer has determined the anticipated cost will be fair and reasonable, and the Government intends to obtain technical data packages or develop performance specifications to support future competition. The Class J&A authority expires one year from Competition Advocate approval, and the work will be funded with fiscal year 2026 Operations and Maintenance, Navy (O&M,N) funds.

J&A No. N10426C1207P00006
CLASS JUSTIFICATION AND APPROVAL (J&A)
FOR USE OF OTHER THAN FULL AND OPEN COMPETITION
1. Contracting Activity: Department of the Navy, Military Sealift Command (MSC) Norfolk
2. Description of the Action Being Approved: Award of contract modifications under contract N3220526C1207, for the Mid-Term Availability of the USNS OSCAR V. PETERSON (T-AO 206), to Detyens Shipyard, Inc., incorporating work items needed to comply with regulatory requirements. The contract was awarded for $19,473,441.00 based on adequate price competition.
3. Description of Supply Services: To accomplish the work items detailed in the enclosure, which are needed to comply with regulatory requirements of the U.S. Navy, U.S. Coast Guard, and American Bureau of Shipping. The total estimated dollar value for all such work items is which will be funded utilizing fiscal year 2026 Operations and Maintenance, Navy (O&M,N) funds. The authority to act under this Class J&A expires one year after the date on which it is approved by the Competition Advocate.
4. Statutory Authority Permitting Other Than Full and Open Competition: 10 U.S.C 3204(a)(2) Unusual and compelling urgency.
5. Rationale Justifying Use of Cited Authority
a. The contracting activity competitively awarded the contract consisting of 104 work items on January 30, 2026, with a period of performance of February 20, 2026, through May 18, 2026.
b. To satisfy regulatory and safety requirements, ensure operational availability, mission readiness and maintain vessel configuration, corrective action is required to address deficiencies identified by the U.S.
Coast Guard, the American Bureau of Shipping, and the USNS OSCAR V. PETERSON Officers. These repairs must be completed before the vessel can be cleared for departure from the shipyard.
c. Full and open competition for these work items is not feasible as it would introduce an unacceptable delay in returning the vessel to a mission-ready posture. A competitive procurement action of this magnitude is estimated to require a 501-day lead time before work could even commence. At an established vessel per diem rate of $210,165, this administrative delay alone would result in an estimated cost to the Government of over $6.5M. Furthermore, the vessel's current state of disassembly—with interferences removed, staging installed, and equipment open—presents the most opportune and cost-effective window for executing these repairs
6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable: The pre-solicitation notice was posted on the Government Point of Entry website (sam.gov) on July 23, 2025, and the award notice was posted on January 30, 2026. For reasons set forth in Paragraph 5, this requirement is not presently a candidate for full and open competition.
7. Determination of Fair and Reasonable Cost: The Contracting Officer has determined the anticipated cost to the Government of the supplies/services covered by this J&A will be fair and reasonable IAW FAR 15.404-1(b).
8. Actions to Removed Barriers to Future Competition: The Government expects to obtain a technical data package or develop a performance specification that will support competition for future acquisitions of the same or similar items.
