About this file
This is a Class Justification and Approval (J&A) document for use of other than full and open competition for a contract modification award.
The Department of the Navy, Military Sealift Command (MSC) Norfolk is approving contract modifications under contract N3220526C1207 for the Mid-Term Availability of the USNS OSCAR V. PETERSON (T-AO 206) at Detyens Shipyard, Inc. The original contract was competitively awarded on January 30, 2026, for $19,473,441.00 based on adequate price competition. The modification covers 104 work items with a performance period from February 20, 2026, through May 18, 2026. The work involves regulatory compliance items required by the U.S. Navy, U.S. Coast Guard, and American Bureau of Shipping to address deficiencies identified by these agencies. Funding will be provided through fiscal year 2026 Operations and Maintenance, Navy (O&M,N) funds. The J&A expires one year after Competition Advocate approval.
The justification for other than full and open competition cites 10 U.S.C 3204(a)(2) for unusual and compelling urgency. Full and open competition is infeasible due to the 501-day lead time required for competitive procurement, which would result in estimated administrative delays costing over $6.5 million and operational impacts. The vessel's current state of disassembly presents the most opportune and cost-effective window for executing the repairs. The contracting officer determined the anticipated cost to be fair and reasonable under FAA FAR 15.404-1(b). The presolicitation notice was posted on July 23, 2025, on SAM.gov.
