Performance Work Statement (PWS) Niihau Ranch Support Contract

1 Introduction The Contractor provides base and range support services to the Pacific Missile Range Facility (PMRF) on the Island of Niihau. PMRF is a fleet operational training and testing range that is also a designated Major Range and Test Facility Base (MRTFB) providing major Department of Defense level test and evaluation support to Missile Defense Agency (MDA), Naval Sea Systems Command (NAVSEA), Defense Advanced Research Projects Agency (DARPA), Foreign Military customers and other critical Department of Defense Operational and Test programs.

1.1 Mission

Range support services include systems used to support training of Navy, Joint and allied military units, and live testing for weapons acquisition programs. Teamwork with government agencies and other contractors is essential to ensuring mission success. Navy facilities on leased Niihau property provide essential support of PMRF’s Research, Development, Test & Evaluation (RDT&E) and training mission.

1.2 Background

PMRF is primarily located at PMRF Barking Sands, Port Allen, Kokee Park, and Makaha Ridge on the Island of Kauai. PMRF is home to U.S. Navy Active Duty Military and Government Civilians, Hawaii Air National Guard, Hawaii Army National Guard, Government Contractors, and other tenant organizations. Nearly 1,000 people live or work on the base. PMRF’s Range Operations extends throughout the Pacific Fleet’s Area of Responsibility (AOR).

Niihau is a privately owned island and access thereto is restricted to residents only or by prior agreement with Niihau Ranch. Agreements between Niihau Ranch and the Navy allow Government access to Government leased sites on the Island of Niihau, including the Radar Site and Perch Site to perform work on Government equipment.

Access to all sites on Niihau required for PMRF support shall be accomplished in accordance with the Niihau “Terms and Conditions for Use of Niihau Island Facilities/Helicopters Services/Protection of Historical/Cultural Resource.”

PMRF Normal Business Hours are from 0730-1600, Monday through Friday except Federal Holidays.

The contract observes ten (10) Federal Holidays which are the Legal Public Holidays listed in 5 U.S.C. § 6103 (a).

The Legal Public Holidays are as follows:

New Year’s Day.

Birthday of Martin Luther King, Jr.

Washington’s Birthday Memorial Day Independence Day Labor Day Columbus Day Veterans Day Thanksgiving Day Christmas Day

Government Office Closures whether declared by Federal statute, Executive order, in preparation for severe weather events, in response to a disaster (whether natural or man-made) or for any other reason are not Federal Holidays for purposes of this contract).

There will be no work requirements in support of the contract on Sundays except for national emergencies or in life or death instances. Any overtime hours incurred (defined as over 40 hours per week) will be adjusted by means of a modification to the Task Order, in accordance with the current Service Contract Labor Standards or Davis-Bacon Act of 1931 Wage Determination, and upon approval of the Contracting Officer.

1.3 Scope

The contractor provides Base Operations Support (BOS) Services and Range Operations Support (ROS) Services primarily at Government leased sites (reference U.S. Government Lease for Real Property with Niihau Ranch, Lease No. N6274283RP00007 thru Amendment No. 4) located on the Island of Niihau.

The Radar Site includes approximately 0.727 acres of area to be maintained and is composed of Microwave Antennas (upper and lower), Radar Building Number 1, Motor Generator Building Number 2, Communication and

Storage Building Number 3, Fuel Tank (1,000 Gal Cap.) with Fuel Line Building Number 4, Helicopter Landing Site, Solar Array Panels, outhouse, and open areas.

Flight Time: The time that elapses while the Contractor's helicopter is airborne in direct support of a PMRF mission will be known as Flight Time. The Flight Time will include the time from the Contractors hangar to PMRF ("dead head time) and vice versa. The Contractor will utilize a Hobbs meter for tracking flight time to the tenth (1/10) of an hour and report the meter readings at the initial takeoff and final landing when invoicing for Flight Time.

Waiting Time: The time that elapses whenever the Contractor's helicopter must remain on the ground to fulfill the PMRF mission will be known as Waiting Time. Waiting Time includes engine warm up and cool down times.

Cancellation Fee: Requestors may cancel flights 72 hours or more prior to scheduled pickup times without charges to the Government. A cancellation within 72 hours of the pickup time will result in the application of a cancellation fee except as agreed upon by the Niihau Ranch and the Contracting Officer. The Contracting Officer may authorize (in conjunction with the COR and GTM) the flight for an alternate mission. If the Contracting Officer elects not to authorize the flight for an alternate mission, prior to canceling, the charge will be applicable. If a flight is cancelled due to aircraft mechanical problems or other unforeseen factors, the Government shall be charged only that Flight Time/Cycles/Wait Time actually utilized. In the event cancellation results from an act of God, such as hurricane, tsunami, storm condition, lightning storm, etc., or national emergency, cancellation fees will not be applied. Concurrence of the Contracting Officer is required to waive these fees. A cancellation fee will be applied if the cancellation results from program or range-directed stoppage due to technical issues, such as, but not limited to, target, sensor, or participant malfunctions or to range fouling. This cancellation fee policy applies to back-up days as well as to primary mission days.

Landing Fee: A landing fee per mission will be charged to the Navy in the event that a Navy-owned or Navy-hired Contractor helicopter lands on Niihau to carry out mission requirements under any of the following circumstances:

- When not practical to ship by the Niihau helicopter, such as when the equipment is sensitive or too large, and the Program Manager requires shipment by air, rather than shipment by surface, the Navy will be allowed to transport same to the designated site via other Navy-contracted helicopter or by organic DoD helicopter assets subject to imposition of a landing fee.

- When the Niihau helicopter is down for maintenance or is scheduled for other uses, and personnel must be transferred to the site, the Niihau Ranch Manager, at his sole discretion, may opt to contract third party helicopter services (with a valid Aviation Facility Use Permit) to accomplish the mission or to authorize a Navy-contracted helicopter for transport with no landing fee assessed.

- Aside from the situation described in the paragraph above, or in emergencies (as in operational emergency situations, not including aircraft emergencies), when a Navy-contracted helicopter or organic DoD helicopter lands on Niihau, it would be subject to a landing fee which shall be assessed per mission. The government will first obtain approval from the Niihau Ranch manager for each mission. For clarification, a mission is defined as a single evolution involving one landing and one takeoff (including hover transfer of personnel or cargo) from any Niihau site as approved by the Niihau landowner.
