About this file
This document is a Justification and Approval (J&A) for a Sole Source procurement by the Naval Air Warfare Center Aircraft Division (NAWC-AD) at Patuxent River, Maryland. The contract is for LMB North America, a small business, to provide one Hyperfan and one Hyperfan Controller for the Selex Galileo Vixen 500 AESA radar installed on the U.S. Naval Test Pilot School (USNTPS) C-26 aircraft. The procurement is deemed necessary because Leonardo no longer supports the radar, and the USNTPS cannot troubleshoot current issues or find alternative replacement parts.
The procurement is being conducted under 10 U.S.C. 2304(c)(1), citing only one responsible source that can satisfy agency requirements. The urgency is driven by the need to return the radar to service quickly for the USNTPS curriculum, and attempting to competitively source an alternative part would require extensive and time-consuming hardware development and integration. The USNTPS is simultaneously exploring long-term replacement of the current Vixen radar to support future full and open competition.

1. Contracting Activity.
Naval Air Warfare Center Aircraft Division (NAWC-AD) Patuxent River, MD.
2. Description of the Action Being Approved.
This Justification and Approval authorizes and approved the issuance of a contract action to LMB North America; in support of the U.S. Naval Test Pilot School (USNTPS).
3. Description of Supplies/Services.
This Justification is for the Sole Source procurement of a Firm-Fixed Price (FFP) contract to LMN North America, a small business, that is the builder and supplier of the Hyperfan and Hyperfan controller that is a subcomponent of the Selex Galileo Vixen 500 AESA radar installed on the USNTPS C-26 aircraft. This Sole Source Justification (SSJ) authorizes and approves the issuance of a contract to purchase one Hyperfan and one Hyperfan Controller for installation in the current USNTPS Vixen 500 radar.
Estimated Dollar Value in Thousands
4. Statutory Authority Permitting Other Than Full and Open Competition.
The statutory authority permitting other than full and open competition is 10 U.S.C. 2304(c)(l ), only one responsible source and no other supplies or services will satisfy agency requirements.
5. Rationale Justifying Use of Cited Statutory Authority.
The statutory authority permitting other than full and open competition is 10 U.S.C. 2304(c)(l ), only one responsible source and no other supplies or services will satisfy agency requirements.
The USNTPS purchased the Vixen radar for use in the C-26 aircraft from Leonardo as a teaching tool for syllabus event of the Fixed Wing and Rotary wing course. Currently, Leonardo no longer supports the radar and the USNTPS has been attempting to troubleshoot issues with the radar which is not available for use in the USNTS curriculum. Through troubleshooting, the Hyperfan and Hyperfan controller were noted to be malfunctioning, and the manufacturer and part number were retrieved. To return the radar to service as soon as possible, it is desired to replace the component with the exact, current part. Also, the USNTPS does not have any technical documents that would allow for a search of potential replacement parts nor would USNTPS be able to confirm that other parts would work in place of the LMB Hyperfan.
6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable.
The USNTPS has completed market research to identify companies having the expertise, capabilities, and experience to meet, design, and build like fan equipment. It has been deemed as not feasible for the purchase to go with another company without expensive development of hardware and integration with the Selex Vixen radar. Because of the time critical nature of the radar in the USNTPS curriculum, which is ongoing, the time required to compete a firm to research, design, build and integrate a new fan and fan controller is considered excessive.
Per 10 U.S.C. 2304 (c)(2), In that the supplies or services is of such unusual and compelling urgency that the Government would be seriously injured unless the agency is permitted to limit the number of sources from which it solicits bids or proposals. Per FAR 6.302-2(b)(1) This authority applies in those situations where – (1) An unusual and compelling urgency precludes full and open competition.
7. Determination of Fair and Reasonable Cost.
In accordance with FAR 15.402, the Contracting Officer shall ensure that all supplies and services provided under this contract are provided at a fair and reasonable price. The Contractor will submit a quote with pricing data and sufficient information to support the accuracy and reliability of the estimate. This quote will be reviewed by experienced technical analysts and contract specialists. As these items are considered Commercial Items as defined in FAR 2.101, the Contracting Officer will utilize price analysis as the basis for negotiating a fair and reasonable price.
8. Actions to Remove Barriers to Future Competition.
The USNTPS is looking into the replacement of the current Vixen radar due to the difficulties in sustaining it. Any action to replace the radar will support full and open competition.
Per Navair Instruction 4200.31F dated 22 July 2014, Contracts awarded under FAR Part 13, simplified acquisition procedures, do not require a J&A thus do not need concurrence from our legal counsel.
